Teach the Vote’s Week in Review: Sept. 13, 2019

SBOE Committee on School Initiatives meeting, Sept. 12, 2019

This week, members of the State Board of Education (SBOE) gathered in Austin to hold a series of meetings over Wednesday, Thursday, and Friday, which ATPE’s lobbyists have been attending. View the full SBOE agenda and additional information about this week’s meetings here.

To kick things off, the board on Wednesday discussed the Texas Resource Review (TRR) process, formerly known as the Instructional Materials Quality Evaluation (IMQE). Acting as a rubric for instructional materials for English Language Arts and Reading (ELAR) in grades 3-8, the TRR will serve as a type of “consumer reports”  resources for school districts and educators looking for quality instructional materials. Other topics of discussion during this week’s meetings of the board and its committees include a new procedure for nominating members to the School Land Board (SLB), the ed prep assessment pilot known as “EdTPA,” and the Generation 25 charter application that would establish charters with new operators as opposed to letting existing charter holders expand their operations. ATPE’s Wiggins has more on the discussion of these items in this blog post from Thursday.

The board will wrap up its September meetings today. The full board’s agenda for today includes hearing from Commissioner of Education Mike Morath. The board also took time today to recognize outgoing chair Donna Bahorich for her leadership with an honorary resolution. This will be the last meeting over which Bahorich will preside, pending the governor’s naming of a new chair for the SBOE.

This year’s legislative session saw a slew of bills relating to assessments, from their administration and content to their duration and much more. It was announced this week that Harrison Keller will become the new Commissioner of Higher Education, following the recent retirement of Commissioner Raymund Peredes. The announcement came Wednesday after a unanimous vote by the Texas Higher Education Coordinating Board (THECB). Keller, who assumes the post on Oct. 1, has worked for the University of Texas and was a longtime education policy adviser to a former Texas Speaker of the House, Rep. Tom Craddick (R-Midland).


ELECTION UPDATE: Yet another big retirement announcement came today with Sen. José Rodriguez (D-El Paso) announcing that he will not seek re-election. An attorney, Sen. Rodriguez has described himself as the first member of his family to attend college. He was first elected to the Senate District 29 seat in 2010 and has also chaired the Senate Democratic Caucus.

Early voting for the upcoming November election begins on Oct. 21, just five weeks from now. For more information about what’s going to be on the ballot, check out our previous Teach the Vote blog posts on proposed constitutional amendments and some special elections that will be taking place on the same day. You can also use the resources provided by the Texas Educators Vote coalition to help ensure you are ready to vote. The deadline to register to vote for the November 5 election is Oct. 7, 2019.

New School Year, New Laws: Assessment

In last week’s “New School Year, New Laws” blog series penned by the ATPE lobby team, we discussed several bills passed during the recent 86th Legislative session that will impact curriculum and instruction. This week, the ATPE lobby team will address legislative changes adopted this year that pertain to how the state evaluates teaching and learning through assessment.

House Bill (HB) 1244 by Rep. Trent Ashby (R-Lufkin): Civics questions on U.S. History exams

HB 1244 alters the U.S. History end-of-course (EOC) exam by requiring that it include 10 questions randomly selected by the Texas Education Agency (TEA) and pulled from the United States Citizenship and Immigration Services civics test. This is the test that is used during the naturalization process. Does this mean there will be new curriculum standards (TEKS) for U.S. History? No, the bill specifies that TEA must ensure that the questions on the new exam will be aligned with the existing TEKS. Additionally, TEA will be required to issue an annual report that provides the questions, answers, and student performance regarding the 10 civics questions. Student performance data included in the report will be disaggregated by district and campus. HB 1244 applies beginning with students who enter the ninth grade during the 2019-20 school year.

HB 3906 by Rep. Dan Huberty (R-Kingwood): Multifaceted assessments

HB 3906 makes several test-related changes that are effective with the 2019-20 school year. First, with regard to mathematics assessments: the State Board of Education (SBOE) will determine the sections of the grades 3-8 mathematics assessments on which students can use technology aids. TEA can now prohibit the use of technology on certain parts of the Algebra I assessment. Additionally, students can now use a calculator application on a “computing device” (computer) in place of a graphing calculator.

With regard to how TEA designs assessments, the target time it should take a student to complete a distinct “part” of the test was shortened. For grades three and four, the test should be designed so that 85% of students can complete the part within 60 minutes (previously 120 minutes). For grades five through eight, 85% of students should be able to complete the part within 75 minutes (previously 180 minutes). Lastly, assessments and end-of-course exams can now be split into multiple parts administered over more than one day, and the tests may not be administered on the first instructional day of the week (typically Monday).

Also effective immediately, TEA is required to establish an integrated formative assessment pilot program. Districts can opt into the pilot program, which will be used to determine if formative assessments improve instructional support and if they could potentially replace current assessments. TEA will also begin creating a transition plan for the eventual electronic administration of assessments, develop electronic interim assessments for districts to use, and create both technical and educator assessment advisory committees to provide recommendations to the commissioner and TEA on assessment development.

Some provisions in HB 3906 will roll out in the coming years. The bill eliminates the STAAR writing tests given in grades 4 and 7, which will take effect on Sept. 1, 2021. Under federal law, states are required to teach and assess “reading or language arts.” Texas does assess reading and will continue to do so under HB 3906. Also, by the 2022-23 school year, the amount of multiple choice questions on assessments will be limited to 75% and assessments will be administered electronically pursuant to this bill.

Senate Bill (SB) 213 by Sen. Kel Seliger (R-Amarillo): Continuing the individual graduation committees

Individual graduation committees allow a student to graduate in the event that they have completed all curricular requirements but have not passed their EOCs, even with a re-test opportunity. Students complete remediation and a project or portfolio to demonstrate proficiency in the course. Ultimately, the committee considers a variety of factors before making a decision on whether the student can graduate. The committees first came into existence with the enactment of a 2015 bill also carried by Sen. Seliger, but the law permitting the use of the committees was scheduled to expire. This year’s SB 213 extends the use of individual graduation committees for another four years, until 2023. This bill took effect immediately upon its passage.

HB 3 by Rep. Dan Huberty (R-Kingwood): Test-related provisions in the school finance and reform bill

Earlier this year, a New York Times article and other media reports cited multiple studies indicating that State of Texas Assessments of Academic Readiness (STAAR) tests were written above grade level. Spurred by consternation over such media reports, Chairman Huberty included in his HB 3 language that calls for an “assessment instrument study.” This requires TEA to work with a public institution of higher education to determine if each STAAR test is written at the appropriate grade level. Texas Commissioner of Education Mike Morath is required to submit a report on the findings of this study by Dec. 1 of this year.

The outcomes-based funding mechanism in HB 3 that relies on indicators of college, career, and military readiness will include performance on assessments such as the SAT, ACT, and the Armed Services Vocational Aptitude Battery (ASVAB). HB 3 also includes district reimbursement for the administration of certain college prep assessments. Finally, HB 3 requires districts to create an early childhood literacy and mathematics proficiency plan, which would include annual, quantifiable goals for student performance in reading and math.

New School Year, New Laws: Curriculum and Instruction

When the 86th Texas Legislature convened for its 2019 regular session, members of the state Senate and House of Representatives focused much of their attention on school finance and school safety. Issues that once held center-stage in a legislative session, like accountability, vouchers, and payroll deduction took a backseat (or weren’t even in the car). However, there were several bills passed this year that will impact teachers’ bread and butter – teaching and learning. In this week’s “New School Year, New Laws” post, we will fill you in on legislative changes impacting curriculum and instruction.

House Bill (HB) 391 by Rep. César Blanco (D-El Paso): Printed instructional materials

By law, parents are entitled to request that their child be allowed to take home instructional materials. Districts and charter schools must honor this request. However, in some cases, those instructional materials are online and the parents do not have the appropriate technology at home to access them. In this event, HB 391 dictates that the district or charter school provide the materials in print, which could be printouts of the relevant electronic materials. This law became effective immediately upon its passage.

HB 2984 by Rep. Steve Allison (R-San Antonio): Technology applications TEKS

Technology applications is part of the “enrichment curriculum” offered by school districts. HB 2984 directs the State Board of Education (SBOE) to revise the grades K-8 Texas essential knowledge and skills (TEKS) for technology applications, specifically by adding in curriculum standards for coding, computer programming, computational thinking, and cybersecurity. The SBOE must complete this task by Dec. 31, 2020, so be on the lookout for information from ATPE about opportunities to participate in the process and provide public comment.

HB 3012 by Rep. James Talarico (D-Round Rock): Providing instruction to students who are suspended

Most teachers have probably experienced what happens when a student is placed in either in-school or out-of-school suspension (ISS/OSS). The student often comes back to the classroom having missed days or weeks of instruction that can be hard to make up. HB 3012 requires districts to provide suspended students with an alternative means of accessing all “foundation curriculum” or core coursework (math, science, English language arts, and social studies). The district must also provide at least one option for receiving the coursework that doesn’t require access to the Internet. Whether or not this requirement for providing coursework will trickle down to the individual teacher level is still unclear. This bill became effective immediately.

HB 4310 by Rep. Harold Dutton (D- Houston): Time for scope and sequence

HB 4310 applies to the scope and sequence created by districts for foundation curricula. Under the new law, a district must ensure sufficient time for teachers to teach and students to learn the TEKS in a given scope and sequence. Additionally, a district cannot penalize a teacher who determines that their students need more or less time and thus doesn’t follow the scope and sequence. However, the law does say that a district can take action with respect to teachers who don’t follow the scope and sequence if there is documented evidence of a deficiency in their classroom instruction. This law became effective immediately.

HB 3 by Rep. Dan Huberty (R-Kingwood): G/T programming and funding

The gifted and talented (G/T) allotment was eliminated in this year’s big school finance bill, HB 3, but the requirement that school districts provide G/T programming did not go away. When HB 3 was heard by the House Public Education and Senate Education committees, many parents and students testified on the importance of keeping gifted and talented programming and urged lawmakers to maintain the allotment. In response, Chairman Huberty and other lawmakers explained that funding for G/T through the allotment has been capped at 5% of average daily attendance, even though a district may actually enroll more than 5% of its students in G/T programs. As a result, every district essentially received the maximum amount possible. HB 3 rolls this amount into the new basic allotment as the mechanism for funding G/T, rather than having a stand-alone allotment.

To quell fears that G/T programs might disappear along with the allotment, HB 3 states that districts must provide a G/T program consistent with the state plan for G/T and must annually certify to the commissioner of education their compliance with the law. If a district does not comply, the state will revoke its funding in an amount calculated using the same formula for the old G/T allotment. The bill also requires districts to comply with the use of G/T funds as outlined in State Board of Education (SBOE) rule.

These changes to how G/T programs are funded took effect immediately upon the passage of HB 3. Learn more about the new G/T requirements and funding expectations in this “HB 3 in 30” video provided by the Texas Education Agency (TEA).

HB 4205 by Rep. Tom Craddick (R-Midland): Teacher effectiveness and value-added modeling in turnaround schools

HB 4205 was originally introduced as a bill to allow a campus in Midland ISD to be repurposed by a nonprofit entity while maintaining the same student population. As the bill made its way through the legislative process, it was expanded beyond Midland ISD and amended to include language from Senate Bill (SB) 1412 by Sen. Charles Perry (R-Lubbock) regarding accelerated campus excellence (ACE) plans. ACE is a campus turnaround option that prescribes personnel, compensation, and programming decisions meant to improve student performance. A last-stage amendment also added a requirement that personnel decisions under a school’s ACE turnaround plan must be made using a value-added model (VAM) for determining instructional effectiveness. After this change was made, which ATPE opposed, the House unfortunately voted to concur in the Senate amendments and the bill was signed by the Governor.

Under the final version of HB 4205 as passed, at least 60 percent of teachers assigned to the campus must have demonstrated instructional effectiveness during the previous school year. For teachers who taught in the same district in the prior year, this effectiveness standard is to be determined by classroom observation and assessing the teacher’s impact on student growth using VAM based on at least one student assessment instrument selected by the district. For teachers who did not teach in the district the previous year, instructional effectiveness will be determined by data and other evidence indicating that if the teacher had taught in the district, they would have been ranked among the top half of teachers there. Teacher pay under this type of plan must include a three-year commitment to provide “significant incentives” to compensate high-performing principals and teachers.

In the 2019-20 school year, the ACE provisions in HB 4205 will only apply to one district that received an unacceptable rating for 2017-18, as chosen by the commissioner of education. In 2020-21, the ACE option under HB 4205 will open up to all districts that have been required to complete a campus turnaround plan.

There are many aspects of this new law that ATPE opposes, which we expressed to lawmakers through oral testimony and written input on SB 1412 and HB 4205 as they were moving through the legislative process earlier this year. Our opposition was based on the following formal positions that have been adopted by ATPE members:

  • ATPE opposes the use of student performance, including test scores, as the primary measure of a teacher’s effectiveness, as the determining factor for a teacher’s compensation, or as the primary rationale for an adverse employment action.
  • ATPE believes students’ state-level standardized test scores should not be a component of teacher evaluations until such time as they can be validated through a consensus of independent research and peer review for that purpose.
  • ATPE opposes the use of value-added modeling or measurement (VAM) at the individual teacher level for teacher evaluation purposes or decisions about continued employment of teachers. (Learn more about our VAM concerns here.)
  • ATPE supports incorporating measures of student growth at the campus level or higher into evaluations of educators as long as the measures are developed with educator input, piloted, and deemed statistically reliable.
  • ATPE opposes incentive or performance pay programs unless they are designed in an equitable and fair manner as determined by educators on a campus basis.

Commissioner updates SBOE on HB 3 and other education bills

Texas Commissioner of Education Mike Morath updated the State Board of Education (SBOE) today, June 12, 2019, on recent bills passed by the 86th Texas Legislature affecting public education. His remarks included comments on the major school finance and reform bill, House Bill (HB) 3.

Commissioner Morath began with a review of HB 3906, which makes several changes to how state assessments are delivered. Intended do reduce test anxiety, the bill bthis blog post from the ATPE lobby team.

Under HB 3, TEA is required to enter into a memorandum of understanding (MOU) with a public institution to study the STAAR and ensure that the assessment meets certain criteria: It is to be written at the appropriate reading level; should only include content aligned with the Texas Essential Knowledge and Skills (TEKS) for that grade level or earlier grades; and should only include passages written at or below the reading level of the grade level for the assessment. This report is due to the legislature by December 1, 2019.

The commissioner provided the board with a high-level review of the main components of HB 3, which the agency estimates will provide an average increase of $635 per student in average daily attendance (ADA). You can read the full analysis of HB 3 by ATPE’s lobbyists here.

Aside from new legislation, Commissioner Morath indicated that the agency has found the financial resources to follow through with the SBOE’s request to create a charter school transparency website, which will provide easy access to more information on charter schools. A beta version of the website will be available by spring 2020. This segued into a discussion on TEA’s process of reviewing applications for new charters, and the commissioner walked the board through the five applications he has recommended for approval, which were announced late last week. SBOE member Ruben Cortez (D-Brownsville) pointed out the short notice and requested that the agency provide its charter recommendations further ahead of time.

SBOE member Barbara Cargill (R-The Woodlands) asked the commissioner to review the incentive pay program created under HB 3. Morath noted that local school districts will be able to develop programs based upon the current T-TESS evaluation system, with Texas Tech University tasked with reviewing districts’ programs for quality control. The commissioner added that while “master” teacher designations were envisioned as roughly the top five percent of teachers based on performance, the bill requires that the system enable all teachers to be mathematically able to qualify for the designation. Commissioner Morath pointed out that HB 3 requires that 90 percent of a district’s incentive pay funding must be used to increase the salary of teachers working on the campus at which the incentive pay program is in place, though not necessarily each teacher. With that in mind, Morath suggested that districts could “craftily invest in a teacher group.”

After the commissioner spoke, TEA’s governmental relations team updated the board on how the SBOE’s legislative recommendations fared during the 2019 legislative session. Hunter Thompson walked members through changes the legislature made to governance of the Permanent School Fund (PSF), which the board oversees, as well as incentives to hire and retain teachers, which Thompson suggested were included in the provisions of HB 3. Thompson also credited HB 3 with accomplishing a number of objectives laid out in the board’s Long-Range Plan (LRP) for Public Education. SBOE chair Donna Bahorich (R-Houston) and member Keven Ellis (R-Lufkin) suggested in the future that the board may consider drafting legislative recommendations earlier in order to spend more time educating legislators about those issues in the run-up to a legislative session.

Teach the Vote’s Week in Review: April 5, 2019

It was another groundbreaking week in the Texas legislature, and here’s a look at the headlines from ATPE Governmental Relations:


On Wednesday, the Texas House of Representatives passed landmark school finance reform legislation. By a vote of 148-1, Chairman Dan Huberty’s (R-Kingwood) House Bill 3 passed the lower chamber, clearing the way for its consideration next by the Texas Senate.

The ATPE-supported school finance bill as finally passed by the House allocates billions in new money for public schools, reduces recapture, and provides homeowners with property tax relief. The House added bipartisan compromise language to HB 3 during Wednesday’s floor debate to ensure that all full-time public school district employees in non-administrator roles will also receive pay raises.

The Senate Education Committee and House Public Education Committee both held multiple meetings this week to hear a variety of education bills.

The Senate Education Committee’s meeting on Tuesday, April 2, 2019, largely focused on hearing bills pertaining to dual credit. The agenda for Thursday, April 4, included a host of bills relating to virtual schools, including some bills that ATPE opposes. Other pending bills previously heard by the committee were also voted out with favorable recommendations for the full Senate. On the other side of the Capitol, the House Public Education Committee’s Tuesday hearing covered topics ranging from pre-K to technology and educator preparation. The agenda for the committee’s Thursday hearing also featured a wide variety of issues, including one bill that ATPE opposes to require school districts to let home-schooled students participate in UIL activities. ATPE is urging educators to oppose two Senate bills that would endanger free speech rights and limit the ability to teach students about content that relates to “a political philosophy” or “a matter of public interest.” The bills are Senate Bill 1569 by Sen. Pat Fallon (R-Prosper) and Senate Bill 904 by Sen. Bryan Hughes (R-Mineola), and both of them got a favorable nod from the Senate State Affairs committee this week.

SB 1569 and SB 905 would expand current laws that restrict the use of public resources for “political advertising.” The bills are unnecessary, since state law already prohibits using school resources for electioneering which is enforced by the Attorney General, and these two bills will have harmful unintended consequences.

SB 1569 would broaden the definition of political advertising, impose harsh restrictions on political speech by public school employees, and make it nearly impossible to teach students about elections or civic responsibility or anything deemed to fall under the vague category of “a matter of public interest.” SB 904 also tries to limit political speech by restricting access to government communication systems like a school district’s Wi-Fi network. It also calls for fining any third party that sends political advertising to a government email address. SB 904 will unreasonably penalize innocent third parties and have a chilling effect on free speech and political involvement by educators, even making it hard to teach students about anything related to politics.

Both SB 1569 and SB 904 appear to be reactions to the surge in educator participation in elections last year, and both bills are likely to spark constitutional challenges if passed. Based on their obvious targeting of the education community, both bills are reminiscent of unsuccessful efforts last legislative session to dissuade educators from joining professional associations that advocate for public education. With yesterday’s committee vote, these two bills have the potential to reach the full Senate for a floor debate very soon. ATPE is urging educators to contact their senators and ask them to reject SB 1569 and SB 904. Read more about the bills in this blog post. As we have been reporting here on Teach the Vote, the legislature is considering ATPE-supported bills to increase contributions into the TRS pension fund. This week the House Committee on Pensions, Investments and Financial Services considered one of the bills, Senate Bill (SB) 12 by Sen. Joan Huffman (R-Houston), which the full Senate has already passed unanimously.

SB 12 is being sponsored on the Senate side by Rep. Greg Bonnen (R- League City), who chairs the Article III (education) subcommittee in House Appropriations and is the author of another bill to increase funding for TRS via House Bill (HB) 9. (That bill, which ATPE also supports, was already heard by the House Pensions committee last week.) ATPE Senior Lobbyist Monty Exter reports that during this week’s hearing on SB 12, Chairman Bonnen offered a committee substitute version of Senate Bill 12 that would replace its language with the language from his HB 9. After a brief hearing on the bill, the committee took the somewhat unusual step of immediately voting the committee substitute version of SB 12 favorably out of committee and recommending that it go to the full House for further consideration. The bill, which appears to be on an expedited track, will next go to the House Calendars Committee which has the authority to set the bill on a House calendar for a scheduled for debate. Once the bill has been approved by the full House, which it is expected to easily do, it will return to the Senate where Sen. Huffman will likely send SB 12 to a conference committee to work out differences between the House and Senate language.

While both versions of the bill would increase the overall contribution rate into the TRS pension system and provide current retirees with a 13th check, the House language does so by focusing the entire increase on the state’s contribution rate without raising the rates of educators or school districts. Additionally, the House version provides for a substantially larger 13th check, up to $2400 per retiree vs $500 dollars per retiree in the Senate version of the bill.


 

House Public Education Committee hears bills on pre-K, tech apps, educator prep, data transparency, and more

On Tuesday, April 2, 2019, the House Public Education Committee heard several bills related to a variety of topics.

ATPE registered positions in support of three of the bills heard in committee:

  • House Bill (HB) 1517 (Coleman, D-Houston): Would require schools, including charters, to notify parents if they do not have a full-time nurse for 30 or more consecutive instructional days. The bill excludes schools that enroll fewer than 10,000 students.
  • HB 2030 (Turner, John, D-Dallas): Would allow eligible three-year-olds enrolled in pre-K to continue their eligibility the next school year, which helps parents avoid intensive paperwork of re-registration and reduces the administrative burden on districts.
  • HB 2184 (Allen, D-Houston): Would create collaborative policies for improving a student’s transition from an alternative education setting back to the regular classroom. A committee substitute for the bill clarifies that teachers who implement the transition plan are included on the planning committee.

The following bills were also heard by the committee:

  • HB 963 (Bell, C., R-Magnolia): Would add technology applications courses to the career and technical education (CTE) allotment, so that students in those courses would receive the same weighted funding as students in CTE courses.
  • HB 1468 (Talarico, D-Round Rock): Would create a “public school mental health task force” to determine the effectiveness of school counseling programs and ways to improve school climate and report that data to the Texas Education Agency (TEA).
  • HB 2984 (Allison, R-San Antonio): Would require the State Board of Education (SBOE) to add essential knowledge and skills (TEKS) to the technology applications curriculum related to coding, computer programming, computational thinking, and cybersecurity. One witness noted that the TEKS are set to be revised in 2021 regardless.
  • HB 3007 (Turner, Chris, D-Grand Prairie) Would require TEA to provide districts all source data that was used in computing their accountability ratings. Rep. Turner stated that districts are not given access to all the data used to determine their A-F accountability ratings and that his bill gives districts the opportunity to view the data during the appeals process. Witnesses representing Arlington ISD, who requested the bill, testified that their college, career, and military readiness data was missing information on 206 students.
  • HB 3217 (Ashby, R-Lufkin): Would reauthorize institutions of higher education to offer a bachelor’s degree in education and eliminate the 18-semester-hour cap on the number of education courses allowed for a degree. One witness testified against the bill, stating that Texas needs subject matter specialists and that content hours should not be decreased. The Texas Association of Colleges for Teacher Education spoke to the importance of pedagogy and testified that students would not experience longer degrees as a result of the bill.
  • HB 3323 (Burns, R-Cleburne): Would require a school district to post employment policy documents on its website.
  • HB 3435 (Bowers, D-Garland): Would establish March 1 as Texas Girls in STEM Day.
  • HB 3966 (Raymond, D-Laredo:  Would require the governor to designate Holocaust Remembrance Week in public schools.
  • HB 3710 (Bell, K., R-Forney): Would require TEA to develop free, electronic tutorials for end-of-course assessments at an estimated cost of $3/student.
  • HB 4310 (Dutton, D-Houston): Would require districts to allow teachers sufficient time to teach a given curriculum and states that districts may not penalize a teacher for failing to follow the scope and sequence timeline if the teacher determines that the students need more learning time.
  • HB 4487 (Frullo, R-Lubbock): States that students sent to the campus behavior coordinator are not considered to have been removed from the classroom for purposes of reporting in the Public Education Information Management System (PEIMS).
  • HCR 59 (Guillen, D-Rio Grande City): Would designate the second week of November as School Psychologist Appreciation Week.

The House Public Education Committee will meet again on Thursday, April 4, to hear bills on UIL and student health, and again on Tuesday, April 9, to hear bills related to charter schools. House Public Education Committee hears bills and testimony on assessment

On Tuesday, March 6, 2019, the House Public Education Committee heard six bills related to testing and the State of Texas Assessments of Academic Readiness (STAAR).

The committee began by hearing seven panels of invited testimony from superintendents and other district leaders, teachers, Texas Education Agency (TEA) staff, and parents. Their comments generally centered around the reliability of STAAR testing in light of recent articles reporting that reading tests are written at a grade level above that of the students being tested (Texas Monthly, The New York Times, Washington Post, Houston Chronicle). Many issues arose during the rich discussion, including the misalignment between the Texas Essential Knowledge and Skills (TEKS) curriculum standards and how the TEKS are tested; the misalignment of expectations between TEA and school districts; the negative impact of testing on students; and the flawed public narrative that inaccurate tests create.

The first panel was composed of superintendents from Alief ISD, Northside ISD, San Marcos ISD, and Granger ISD. The general sentiment among the panelists was that the state should have assessments with appropriately rigorous standards, but make sure they are valid, fair, meaningful, and timely. Additionally, witnesses testified that the tests should undergo rigorous review and field-testing. The danger lies in misalignment between the expectations of test and the expectations of standards, as well as misalignment with other assessments and what teachers know about tests. This results in the STAAR tests creating an inaccurate narrative and in students giving up on their passions.

The second panel included Texas Education Commissioner Mike Morath, who stated that the STAAR tests were meant to predict post-secondary outcomes. Morath emphasized that National Assessment of Educational Progress (NAEP) outcomes have remained flat or declined over the past decade, and he defended the reliability of the STAAR tests. He did admit that the Texas student population has increased significantly over time and grown progressively poorer. Appearing with Morath were three reading experts, one of whom was from the organization that developed lexile scores, Meta-Metrics. Dr. Sanford-Moore of Meta-Metrics explained that lexiles are based on a computer algorithm and measure language structure based on the number of ideas in a sentence and the vocabulary used.

Reps. Gary VanDeaver (R-New Boston), Morgan Meyer (R-Highland Park), and Mary Gonzalez (D- Clint) all made compelling points about the tests. VanDeaver stated, “These are children and not machines. What happens when we reach that level that goes beyond challenging and becomes frustrating and the child shuts down?” Similarly, Meyer shared a story of his fourth-grade daughter, who cried on the way to school the day of the STAAR test and came home defeated. Meyer said, “You call it challenge, I call it frustration.” Gonzalez reiterated her previous comment that it is imperative for the public purpose of the tests to be clear.

This led to a flurry of discussion, bouncing from issue to issue within the educational system, including the A-F accountability grading system; expectations for teachers and district leadership to understand the STAAR test; the use of tests for grade promotion and teacher evaluations; teacher and student stress; curriculum; professional development; and educator preparation. Overall, the range of topics that arose seemed to point to a disconnect between the agency’s expectation of teachers, districts, and students, and the practices and understandings of school districts.

At the four-hour mark of the hearing, the testimony of the third through seventh panels proceeded much more quickly. Another panel of superintendents from Comal ISD, Wylie ISD, and Frisco ISD testified that they used multiple interim assessments and instructional quality improvements to perform well on the STAAR. Additionally, Dr. Mike Waldrip of Frisco ISD said that the timing of the STAAR test at the end of the year wasn’t particularly useful for making preparations for the next year. A fourth panel composed of district leaders in literacy and learning expressed a key takeaway: that there is a disconnect between the reading level of instruction using the TEKS versus the reading level of assessment. The fifth panel, composed of teachers and an interventionist, was deemed the best panel of the day by Rep. Dr. Alma Allen (D-Houston), a long-time member of the committee who is also an educator. Notably affecting the committee members, one of the panelists announced that the time elapsed in the hearing was about the same amount of time students sit for a STAAR test. This panel also spoke to the needs of students and teachers in having the appropriate tools to provide relevant and effective instruction so that students can succeed on state tests. The sixth and seventh panels, which included other district leaders, parents, and stakeholders echoed much of the sentiments in of the previous panels, such as the negative impact of testing on students.

After nearly six hours of testimony from the invited panelists, who provided invaluable insights on the reliability, validity, and usefulness of testing to the state’s educational system, the committee turned its attention to hearing the bills posted on the agenda.

ATPE Lobbyist Andrea Chevalier testified neutrally on House Bill (HB) 671 by Rep. Ken King (R-Canadian). HB 671 would eliminate end-of-course (EOC) examinations and replace them with a school district’s choice of  either the TSI or a nationally recognized, norm-referenced assessment such as ACT or SAT, to be administered in grade 11. Under the bill, the commissioner would contract with a vendor to administer the assessment. HB 671 also mandates that each district require students to attend a preparation course to succeed on the test and defines college readiness. Chevalier expressed that while ATPE supports the reduction in mandated state tests, we want to ensure that any test used to replace the STAAR is both appropriate as an input into the state accountability system and provides the appropriate accommodations for students receiving special education services, students under a 504 plan, and English language learners.

ATPE registered positions in support of the following bills:

  • HB 525 (Tinderholt, R-Arlington): Would limit the required assessments to just mathematics, reading, and science (eliminating writing, social studies, English II, and US History tests)
  • HB 851 (Huberty, R- Kingwood): Would eliminate the September 1, 2019 expiration date of the law authorizing Individual Graduation Committees (IGCs)
  • HB 1480 (VanDeaver, R- New Boston): Would create an accelerated learning committee (ALC) for students who do not perform satisfactorily on third, fifth, or eighth grade reading or math assessments. Also would allow accelerated instruction to be provided to the student in the following year. The ALC would develop an educational plan for the student, provide assistance to student, and perform additional duties if the student doesn’t meet the standard for a second time after accelerated instruction. HB 1480 would also eliminate the requirement that assessments are used for promotion. The bill would eliminate social studies and US History assessments and require the commissioner to gather input from districts on an assessment schedule that minimizes disruption and maximizes instruction time.

Other bills heard in committee were:

  • HB 843 (Springer, R-Gainesville): Would allow for the inclusion of optional post-secondary readiness assessments in Algebra II and English III in the accountability system under the student achievement domain
  • HB 1244  (Ashby, R- Lufkin): Would eliminate the US History EOC and create an electronic civics test as a requirement for graduation, which would contain all questions on the U.S. Citizenship test in a multiple-choice format.

The House Public Education Committee plans to meet again next week. On Tuesday, March 12, the committee will to hear Chairman Huberty’s comprehensive school finance reform bill, HB 3, filed earlier this week. Chairman Huberty also said he expects HB 3 to reach the House floor by the first week of April. Over half the members of the Texas House have already signed on as co-authors for HB 3. The State Board of Education (SBOE) met this week to discuss a variety of topics in what would be its last series of meetings before the year’s end.

On Wednesday, the board voted to increase its distribution from the Public School Fund to 2.9%.  This action takes place after a dispute earlier this year between the SBOE and the General Land Office’s School Land Board (SLB). Both the SBOE and the SLB manage investment portfolios that fund public education, but an unusual move by the SLB to bypass the SBOE and put funding directly into the Available School Fund (ASF) means that the SBOE will have less money to support classrooms directly.

Other topics of discussion this week included the streamlining of the Texas Essential Knowledge and Skills (TEKS) for social studies, the board’s final discussion on the Long Range Plan (LRP) for public education, and the SBOE’s legislative priorities for the upcoming session in 2019.

The Board also heard from Texas Education Agency (TEA) Commissioner Mike Morath. The commissioner addressed concerns that the agency’s Legislative Appropriations Request (LAR) seeks less state funding than in previous years, telling the board the agency is simply following the funding formulas established by the legislature.

During the Board’s discussion with Commissioner Morath, members also requested updates on issues such as Senate Bill (SB) 1882, a bill passed during the 85th legislative session that allows public school districts to partner with privately-run charter schools; the recent ruling by the 5th Circuit Court of Appeals that upheld the U.S. Department of Education’s punitive actions against Texas for underfunding special education programs; and transparency regarding the instructional materials portal launched in 2017.

 


In a press conference earlier this week, state Rep. Dennis Bonnen (R-Angleton) announced that the race for Speaker of the Texas House of Representatives was “over,” as he had secured enough pledges for votes to make him the definitive winner. While the Speaker’s race won’t officially be over until January, when the House convenes for the 86th legislative session and formally votes for the next speaker, that hasn’t stopped Bonnen from proceeding as the presumptive speaker-elect, hiring key staff and putting in place a transition team.

Rep. Bonnen suggested that school finance will be the top priority of the Texas House in the upcoming legislative session, and he has vowed to work with his counterpart across the rotunda. Bonnen and Lieutenant Governor Dan Patrick released a joint statement this week affirming their commitment to unity and working together in the upcoming session. Rep. Bonnen wrote, “The Lieutenant Governor and I share a strong commitment to doing the people’s business.”

On Tuesday, the Texas Commission on Public School Finance working group on revenues discussed the issue of wealth equalization through recapture, which is commonly referred to as “Robin Hood” under the current school finance system.

Led by state Sen. Paul Bettencourt (R-Houston), the group heard testimony from a variety of stakeholders, including former state Sen. Tommy Williams, who testified on behalf of the governor’s office. Williams delivered the first public explanation of the governor’s plan to cap local tax revenue. SBOE wraps meeting with strong statement on school funding

The Texas State Board of Education (SBOE) concluded its September meeting Friday with final votes on a number of subjects.

One of the first orders of business was to approve a draft of the Long-Range Plan for Public Education (LRP). The board will delay final approval until the November meeting in order to give stakeholders longer to review the plan and changes suggested by the board Tuesday night. Member Ruben Cortez (D-Brownsville) voiced concern that the board was under pressure from the office of Gov. Greg Abbott to remove the recommendation in favor of “formula funded full-day pre-K.”

The board also approved Texas Essential Knowledge and Skills (TEKS) for Ethnic Studies: Mexican American Studies, as well as streamlining changes to the social studies TEKSMembers also voted on a number of items from each committee, including finalizing a rejection of problematic rules proposed by the State Board for Educator Certification (SBEC) that would have negatively affected teacher quality. Member Georgina Perez (D-El Paso) concluded discussion by pointing out that if certain areas are having trouble hiring teachers, the remedy should be more pay — not weakening standards. The SBEC will have a chance to fix the rule and submit changes to the SBOE in November.

Members also finalized a letter to the General Land Office (GLO) regarding a dispute over funding that could short schools roughly $450 million over the next biennium. The board voted unanimously to request the GLO reconsider its actions and provide an additional $500 million in funding for schools.

The board concluded with its annual ethics training. The next meeting is scheduled for November.

 

SBOE begins September meeting with social studies TEKS

The Texas State Board of Education (SBOE) kicked off its September meeting Tuesday with a lengthy day of public testimony regarding revisions to the Texas Essential Knowledge and Skills (TEKS) for social studies.

Some of the commentary came in response to edits to the portion addressing the Alamo that received a significant amount of news coverage and political attention over the past several days. A member of the TEKS review team, which is composed of educators who are experts in the subject matter and volunteer their time, explained the reasoning behind the edits and suggested the extraordinary attention was due to a misreading of the team’s notes, as well as a lack of outreach to team members for clarification. He offered an alternative phrasing that would satisfy all parties’ concerns, and which board members seemed amenable to adopting.

Testimony also focused on the proper way to treat slavery as the cause of Texas’s secession in the Civil War period, as well as how to discuss the role of religion, specifically Moses, as it pertains to the framing of the U.S. Constitution.

The board concluded the meeting with a discussion of the Long-Range Plan (LRP) for Public Education, which sets the state’s educational goals through the year 2030 and was released Monday. The LRP Steering Committee held ten in-person community meetings and solicited feedback from thousands of stakeholders via an online survey. Educators, parents, and community leaders were consulted at every step of the way. ATPE Lobbyist Mark Wiggins, who has followed the plan’s development for more than a year, lauded the board for an inclusive and thoughtful process that gave meaningful consideration to input from educators.

Wiggins offered a number of broad recommendations to perfect the plan, including adding language to increase the rigor of Educator Preparation Programs (EPPs). Wiggins also cautioned the board that when discussing programs that aim to place top tier teachers in schools with large numbers of at-risk students by offering differentiated pay, it’s important to ensure that the evaluation programs used to identify those top tier teachers are not based upon student test scores. Wiggins also suggested that due to the short period of time stakeholders have had to evaluate the LRP, the board would be justified in postponing final approval.

Chair Donna Bahorich (R-Houston) introduced a number of perfecting amendments, many of which addressed elements of ATPE’s general recommendations. The board discussed allowing the public more time to review the proposed amendments before voting on final adoption at the November meeting.
