New School Year, New Laws: Mentoring, Training, and Professional Support

Thank you for joining us on Teach the Vote to learn more about how the bills passed during the 2019 legislative session will impact the Texas public education system. So far, we have looked into changes made to laws governing student discipline, school safety, curriculum and instruction, assessment, and special education. In this week’s “New School Year, New Laws” post, we will talk about something just for educators – professional opportunities.

House Bill (HB) 3 by Rep. Dan Huberty (R-Kingwood): Mentor teacher program

HB 3, the multi-billion dollar school finance bill passed this session, included a mentor program allotment and an updated mentor teacher program. The allotment will provide funds to school districts that are implementing a mentor teacher program for educators with less than two years of experience. This allotment will help districts provide stipends to mentor teachers, schedule release time for mentors and their “mentees,” and fund mentor training.

Under the requirements of the bill, a mentor teacher must agree to serve in that role for at least one school year and must start their assignment no later than 30 days after their mentee begins teaching. Additionally, districts must assign a mentor to a new classroom teacher for at least two years. Commissioner of Education Mike Morath will adopt rules to specify how many mentees can be assigned to a mentor.

The qualifications for serving as a mentor teacher are much the same as they were under previous law. For example, mentors must complete certain mentor training and have at least three full years of teaching experience. HB 3 adds that, to serve as a mentor, a teacher must also demonstrate interpersonal skills, instructional effectiveness, and leadership skills. Lastly, mentors must meet with their mentees at least 12 hours per semester, which can include time the mentor spends observing the mentee. During these meetings, HB 3 outlines specific conversation topics such as orientation to the district, data-driven instructional practices, coaching cycles, professional development, and professional expectations.

Districts are required to provide mentor training and training on best mentorship practices before and during the school year. Districts are also required to designate mentor-mentee meeting times and schedule release time or a reduced teaching load for mentors and their mentees.

This provision of HB 3 took effect immediately upon the final passage of the bill.

HB 3 by Rep. Dan Huberty (R-Kingwood): Autism training

HB 3 allows school districts and charter schools to provide financial incentives to teachers who complete training through an education service center (ESC) on serving students with autism.

This provision also became effective immediately.

HB 3 by Rep. Dan Huberty (R-Kingwood): Teacher literacy achievement academies

HB 3 includes a focus on improving reading instruction for students in kindergarten through third grades. By the 2021-22 school year, districts must ensure that each classroom teacher in grades K-3 and each principal at a campus with grades K-3 has attended a teacher literacy achievement academy. Created in 2015 by the 84th Texas legislature, teacher literacy achievement academies are targeted professional development opportunities to enhance instruction, especially for special populations. Additionally, HB 3 now requires that each K-3 teacher or principal must have attended a teacher literacy achievement academy before their first year of placement at a campus in the 2021-22 school year.

Current law regarding teacher literacy achievement academies states that, from funds appropriated, teachers who attend an academy are entitled to receive a stipend in an amount determined by the Commissioner from funds appropriated by the legislature for the program. The academies have been funded through the appropriations process since their inception, and this program will receive $9 million over the next biennium.

This provision of HB 3 also took effect immediately.

Senate Bill (SB) 1757 by Sen. Brandon Creighton (R-Conroe): Math and science scholars loan repayment

Under previous law, the math and science scholars loan repayment program was open to teachers who met the following criteria: they completed an undergraduate or graduate program in math or science; are certified to teach math or science (or on a probationary certificate); have been employed as a full-time math or science teacher in a Title I school for at least one year; are U.S. citizens; are not in default on any other education loan; and have not received or are not receiving any other state or federal loan repayment assistance. Additionally, the teacher must have had a cumulative GPA of 3.5. Under SB 1757, this GPA requirement is lowered to 3.0 for the loan repayment program.

The teacher must also enter into an agreement with the Texas Higher Education Coordinating Board (THECB) to complete four consecutive years of employment as a full-time classroom math or science teacher in a Title I school. Under previous law, the teacher also had to commit to an additional four years teaching in any public school, though not necessarily a Title I school. SB 1757 changes this requirement to allow the THECB to determine how many additional, non-Title I school years (not to exceed four) a teacher must teach.

Also, SB 1757 now allows student loan repayment assistance for education taking place at a nonprofit, tax-exempt, regionally accredited college or university. This bill was effective Sept. 1, 2019.

SB 37 by Sen. Judith Zaffirini (D-Laredo): Student loan default

If you’ve ever renewed your teaching certificate, you might have noticed that the State Board for Educator Certification (SBEC) can deny your renewal if you are in default on a student loan. SB 37 changes the law so that SBEC is prohibited from considering student loan status. This law took effect Sept. 1, 2019. However, SBEC still has to change its own administrative rules regarding student loan default and certificate renewal requirements. The board will discuss this at the next SBEC meeting on Oct. 4, 2019. Follow us on Twitter and check back on our Teach the Vote blog for updates about this meeting

SBEC considers EdTPA pilot, special education certification, and more

SBEC meeting, April 26, 2019

On Friday, April 26, 2019, the State Board for Educator Certification (SBEC) met in Austin to take up an agenda including several important items. Items considered by the board included final approval of the EdTPA pilot, discussion of a new framework for special education certification exams, and approval of final details for the new “Principal as Instructional Leader” certificate.

Some action items on the board’s agenda last week will result in a public comment period that will run from May 31, 2019, through July 1, 2019. These include proposals to prompt a routine four-year review of rules regarding the certification of appraisers and rules establishing the certificate categories within the certificate class for classroom teachers (e.g. Science 4-8, Social Studies 7-12, Music EC-12). The board is also proposing changes to rules regarding how districts are required to make personnel assignment decisions. For instance, if you have a certificate in Ethnic Studies: Mexican American Studies 9-12, you are allowed to teach a variety of social studies and history courses. Due to public testimony, three changes were made to the proposed rules following the February meeting: allowing with agriculture certificates to teach Principles of Architecture: Principals of Construction, Grades 9-12;  allowing those with Physics/Math certificates to teach Robotics 1, Grades 9-12; and allowing those with technology education certificates to teach Transportation, Distribution, and Logistics, Grades 9-12.

Another major rule-making item on the SBEC agenda that will require a public comment period was the approval of proposed changes to rules on Teacher Certification Redesign, including certification requirements, testing requirements, and types of certificate classes and permits issued (probationary, intern, etc.). The proposed changes include the following:

  • A maximum 45-day waiting period between test attempts, which supports test reliability.
  • The option of a four-week, intensive pre-service pathway towards an intern certificate, which is meant to incentivize alternative certification and post-baccalaureate programs to have pre-service teaching.
  • The use of EdTPA, a portfolio-based performance assessment, as a testing option that educator preparation programs (EPPs) can opt into using during a two-year implementation pilot.
  • Updates to fees, including a shift to subject-matter-only assessments for EPPs that require pre-admission content tests (PACT), which would cost $106 (proposed effective January 1, 2020). EdTPA would cost $281 and only affect candidates who choose to use EdTPA and participate in an EPP that is in the pilot, with a cost of $111/task for retakes (three tasks total).

Testimony on the EdTPA proposal was voluminous during Friday’s meeting. An overwhelming majority of EPPs (university, alternative, and post-baccalaureate) testified in opposition to the proposed new assessment, citing concerns with test integrity, cost to candidates, and pilot design. Those in favor of the change, including Teach Plus Texas and four Teach Plus Texas policy fellows, stated that authentic assessment will be effective at inciting change in EPPs that will lead to better prepared teachers. While the board voted in favor of beginning the pilot, certain board members such as Dr. Art Cavazos, Dr. Rex Peebles, Dr. John Kelly, Carlos Villagrana, and Tommy Coleman expressed concerns with the structure and viability of data obtained from the pilot. Dr. Cavazos strongly advocated for a simultaneous alternative to EdTPA to be developed, so that additional data and options are available after the two-year pilot concludes, should the EdTPA data turn out to be inconclusive or negative. Again,a  public comment period on these proposed changes to the certification exam rules will run from May 31, 2019, through July 1, 2019, and will be published in the Texas Register.

Here are additional agenda items on which SBEC took action last Friday:

  • Final approval of the review of rules regarding educator disciplinary proceedings, sanctions, and contested cases. This is a standard four-year review that all state agency rules are subject to on an ongoing, cyclical basis.
  • Final approval of a new rule specifying certification standards for the English as a Second Language (ESL) Supplemental Certificate (proposed effective July 21, 2019). One of the changes to the standards is a section on culturally responsive teaching in order to construct mutually adaptive learning environments for English language learners.
  • Final approval of the deadline for candidates to qualify and apply for the current Principal Certificate (August 31, 2019) so that all certificates under this category can be issued by October 30, 2019. SBEC also heard an update on the 59 EPPs that have been approved to offer the new Principal as Instructional Leader Certificate. See more about Principal Certification Redesign here.
  • Approval of the membership of the Bilingual Education certificate advisory committee, which will work with TEA staff to draft educator standards that define the content of EPPs and certification exams. The committee will convene in June 2019.
  • Approval of the rest of the EPP accountability ratings (56), as most others (77) had been approved during the February SBEC meeting.
  • Approval/action on disciplinary cases involving educator misconduct.

The following additional items were on the board’s agenda last week for discussion only:

  • Discussion of changes to rules regarding accountability standards and procedures for EPPs, including new commendations for high-performing EPPs, adoption of the accountability manual, and how accreditation statuses are determined.
  • Discussion of proposed changes to admission requirements into EPPs to reflect changes to the PACT, which is a part of the Teacher Certification Redesign mentioned above. The purpose of the PACT is to allow candidates admittance to EPP programs by demonstrating subject-matter-only knowledge (if they don’t have the commensurate coursework and minimum 2.5 GPA). Currently, candidates can gain admission through a content pedagogy test, which tests for teaching strategies that the candidate hasn’t been exposed to yet. The proposed revisions would also implement SB 1839, HB 2039, HB 3349 of the 85th Legislature, which created an Early Childhood through Grade 3 (EC-3) certificate and a Trade and Industrial Workforce Training: Grades 6-12 certificate.
  • Discussion of recommendations made by the Special Education policy forums and an update on the upcoming certification test development process. This includes four new special education certifications and a Deaf/Blind supplemental certification. The four new certification tests would be a “Mild/Moderate Support, Grades EC-8”, “Mild/Moderate Support, Grades 6-12”, “High Support, Grades EC-8”, and “High Support, Grades 6-12”.
  • Discussion of the 5-year EPP continuing approval review process and the current results for the 2017-2018 and 2018-2019 reviews. This item will come up again at the October 2019 meeting as an action item.

SBEC will hold a work session on July 25, 2019 and will hold its next formal meeting on July 26, 2019. There will be an opportunity for public testimony at the July 26 meeting for items that will result in a public comment period (see above) and for the discussion items above. State leaders continue to discuss school safety measures

The office of Texas Governor Greg Abbott issued a report today on school safety, specifically highlighting actions being taken by school districts to respond to growing concerns about violence in schools and related safety measures. The “School Safety Action Plan Summary” follows an earlier School and Firearm Safety Action Plan shared by the governor’s office earlier this year. The governor also convened a group of stakeholders back in July to discuss the issue, and ATPE’s state officers were invited to weigh in.

Among the safety measures noted in the governor’s summary report out today are training programs for educators, including the Mental Health First Aid course that is available at no cost to public school employees through their local mental health authorities. The eight-hour course for which educators can earn CPE credit focuses on identifying the signs and symptoms of mental health and substance abuse problems in students. The governor’s report out today also highlights an increase in the number of school marshals, who are school employees trained and authorized to provide an armed response to violence incidents on a school campus. The school marshal program has existed since 2013 when the legislature passed House Bill 1009 by Rep. Jason Villalba, but relatively few school districts have opted into it. As ATPE Lobbyist Monty Exter noted in this article for the Dallas Morning News, “Whether it’s due to a lack of knowledge of the programs available or a lack of will to implement them, school boards have clearly not made arming educators a priority.” Money is also an ongoing issue in the debate over keeping schools safe, as school districts that are already facing deficiencies in their revenue struggle to find ample cash to pay for additional training, make building updates, or provide mental health resources.

SBOE Chair Donna Bahorich addresses school safety issues as part of a federal panel on Aug. 28, 2018.

On Tuesday, Texas State Board of Education chair Donna Bahorich was a panelist in a listening session for the Federal Commission on School Safety. The event held in Montgomery, Alabama, was part of a series of listening sessions held around the country with the goal of devising strategies to improve school safety.

Bahorich talked about the mental health aspect of curbing violence in schools, including the need to remove the stigmas associated with seeking mental health treatment. “We need to do a paradigm shift around mental health,” Bahorich told the panel before sharing statistics about the prevalence of mental illness among schoolchildren. She also mentioned the concerns over expecting school counselors to fulfill both a mental health treatment function and academic counseling responsibilities, noting that Texas has been discussing whether such roles should be bifurcated. Expect school safety to remain a top issue for consideration during the 2019 legislative session. A Senate Select Committee on Violence in Schools and School Security held hearings on the issue this year and released an interim report of its findings earlier this month. Teach the Vote’s Week in Review: May 18, 2018

Here’s your weekly wrap-up of education news from ATPE Governmental Relations:


Today is the last day to vote early in the primary runoff elections taking place on Tuesday, May 22. Following historical trends, early voting returns have so far been less than stellar.

The May runoff election seems designed to create low turnout. It follows the May uniform election date by only about two weeks. It’s right at the edge of summer when many people, certainly educators and parents, are already distracted and some school districts will have already ended their school year. Also, the types and quantities of the races are much more scattershot, and the rules have many voters confused about whether or not they are even eligible to vote (Hint: if you didn’t vote at all in the primary back in March, you are still eligible to vote in the runoff, as long as you were registered to vote before the deadline.)

All of the reasons above drive down turnout, which is why ATPE and a coalition of education partners are working to instill a culture of voting in the education community. A culture of voting cuts through individual races and impediments and instills a mentality that educators will vote in every election – no matter what. Unfortunately, changing culture is a slow business, and despite the fever of rhetoric about voting that has become a mainstay since 2016, the majority of educators haven’t yet taken the message to heart. However, each election the momentum of the education vote continues to build. Perhaps this, the lowest turnout of all elections, will be the one where you and your group of colleagues will join the movement.

TEA needs you! The Texas Education Agency (TEA) needs “new” teachers to complete a survey to help improve educator preparation. A completed survey is worth 10 Continuing Professional Education (CPE) credits. ATPE Lobbyist Kate Kuhlmann reports about the TEA survey in her blog post earlier this week, but here are some additional quick details:

What is the survey about and how will responses be used?
The survey is designed to determine how well Educator Preparation Programs (EPPs) are preparing teachers to enter the classroom. The results will be used to help improve EPPs and the educational experience of teacher certification candidates who attend those programs.

Who is eligible to take the survey?
TEA has invited “new” teachers, which in this case refers to teachers teaching in their first year under a standard certificate, to participate in the survey.

When is the survey open?
You should have received an email with a link to the online survey on or before April 18, 2018. You have until June 15, 2018 to complete the survey. If you believe you are eligible to take the survey but did not receive an email with a survey link, please contact TEA at pilotteachersurvey@tea.texas.gov.

How do I get started?
Once you receive the email, simply click on the link and take the survey. You can complete the survey in one session or multiple sessions.

Do I receive a benefit for taking the survey?
Once you submit your completed survey, you can download a certificate worth 10 CPE credits.

 



The State Board for Educator Certification (SBEC) is meeting today in Austin. Its discussion includes creating an accelerated pathway for certain teachers to enter the classroom without satisfying traditional training requirements. It’s the result of House Bill (HB) 3349, a bill by Representative Barbara Gervin-Hawkins, passed by the 85th Legislature last year that requires SBEC to implement the new abbreviated training program for candidates seeking the Trade and Industrial Workforce Training certificate.

The board spent significant time this morning discussing a new rulemaking proposal responsive to the bill. The proposal on today’s agenda, which board members saw today for the first time, was vastly different from an initial proposal discussed at previous meetings. ATPE and other educator groups opposed the new plan and were not part of the unidentified group of “stakeholders” that singularly drove the new proposal. In laying out our opposition to the proposal which we view as weakening teacher training standards, ATPE stressed the board’s recent efforts to raise standards for teacher training in Texas.

In Washington, DC, educators and military groups have united to defeat a federal voucher proposal for students from military families. ATPE and other groups believe the measure would drain dollars currently sent to public schools that aid those students.

The U.S. House is preparing its annual reauthorization of the National Defense Authorization Act (NDAA). Included in the act is the Impact Aid program, which helps fund schools that lose local revenue because their districts contain federal lands, including military bases, which do not pay local school property taxes. An amendment filed by Rep. Jim Banks (R-Ind.) this week would create an Education Savings Account (ESA) voucher for certain military families and would pay for the voucher by defunding the Impact Aid Program.

Banks is facing stiff opposition even from some members of his own party. Stripping the Impact Aid Program would significantly impact the very schools that serve a vast majority of children of active duty military personnel.

ATPE’s Washington-based lobbyists have been working to oppose the addition of the Banks voucher amendment. This week, ATPE sent a letter of opposition to Congressman Pete Sessions (R-Texas) who chairs the powerful House Rules committee, and others. For an amendment like the Banks voucher amendment to be considered on the House Floor, it must first be deemed eligible by Chairman Sessions’s committee. The rules committee will meet early next week to determine which proposed amendments to the NDAA will be in order.
