Teach the Vote’s Week in Review: March 11, 2016

Happy Friday! Here’s a recap of this week’s news:


The March 1 Texas primary elections were historic in many ways. Some closely watched races resulted in narrow margins of victory and even prompted recounts and further analysis of the ballots in some instances.

In House District 55, incumbent Rep. Molly White (R) faced a tough challenge by Hugh Shine (R), who was endorsed by Texas Parent PAC. Shine defeated White in the Republican primary election on March 1, but White asked for a recount. As reported this week, Shine remained the winner by a margin of 104 votes upon completion of the recount, and White conceded her loss to him. Shine will become the new state representative for the central Texas district since there are no Democratic, third-party, or independent candidates on the ballot in November.

Meanwhile, in the closely watched race to succeed Sen. Kevin Eltife (R) in Senate District 1, there is still no answer as to which candidate will earn the second place spot and a right to compete in a runoff against front-runner Bryan Hughes (R). It was initially reported that David Simpson (R) edged out James K. “Red” Brown (R) for second place by only 13 votes, but officials have been busy this week counting all the votes, including provisional ballots and military ballots often submitted by mail from members of the armed services who reside in the district but are currently stationed outside the country. Our friends at The Texas Tribune reported yesterday that Simpson and Brown “traded places intermittently throughout the week as results from provisional ballots across the district’s 16 counties came in. At various points on Thursday, each candidate appeared to have won by a handful of votes as they contended for a chance to face state Rep. Bryan Hughes, R-Mineola, in a runoff to replace retiring state Sen. Kevin Eltife, R-Tyler. Once official canvassed results are finalized, the third-place candidate will have the opportunity to request a recount.” Stay tuned to Teach the Vote for updates on this extremely close race.

ATPE Lobbyist Kate Kuhlmann contributed the following update on education-related developments in the nation’s capital this week.

The U.S. Senate Committee on Health, Education, Labor and Pensions (HELP) met Wednesday, March 9, to consider the nomination of Dr. John King to serve as Secretary of Education. Dr. King is currently functioning as the acting secretary after serving as the Deputy Education Secretary at the Department of Education (ED) under Secretary Arne Duncan. After being nominated by President Obama to fill the post, the HELP committee convened a confirmation hearing on the nomination in late February where King was asked to weigh in on issues of importance to public education.

In its markup this week, the HELP committee voted 16-6 to advance King’s nomination to the full Senate. In his closing comments, Chairman Lamar Alexander (R-TN) said he hoped the Senate would promptly confirm Dr. King, highlighting the need for accountable leadership as ED works to implement the new Every Student Succeeds Act (ESSA). The six no votes came from Republican members of the committee, but Democratic Senator Elizabeth Warren of Massachusetts also expressed hesitation. She said she would not be able to support Dr. King’s nomination in the full Senate until she gets answers to her policy questions on student loans and for-profit colleges.

In related news, Dr. King continued his Capitol Hill budget tour this week. King testified Thursday before the Senate Appropriations Subcommittee on Labor, Health and Human Services, Education and Related Agencies. We reported late last month that he testified before the House Committee on Education and the Workforce. King is making the rounds to defend President Obama’s FY 2017 budget proposal.

 


ThinkstockPhotos-152142396_preschoolThe Texas Education Agency (TEA) recently posted proposed new commissioner’s rules to implement a major pre-Kindergarten grant program pursuant to Rep. Dan Huberty’s (R-Kingwood) House Bill (HB) 4 that passed in 2015. Under the program, school districts and charter schools that implement certain quality standards for curriculum, teacher qualifications, academic performance, and family engagement may apply for grant funding starting in 2016. The commissioner is required to propose and adopt rules to determine parameters for the grants. ATPE Lobbyist Monty Exter contributed the following additional information about the rulemaking process that is underway now:

ATPE submitted formal written input on the proposed rules earlier this week. Our comments addressed funding, flexibility, standards, and reporting. First, we suggested adding some simple procedures to give grantees a better sense of certainty on funding levels for budgeting purposes. We called for additional flexibility in choosing or creating instruments to assess the progress of pre-K students. We praised the agency for upholding high standards for pre-K teachers while requesting clarification that grantees can use their grant dollars to help educators meet those higher standards. Finally, we cautioned against making the same mistakes on overemphasis of accountability measures, particularly those driven by standardized assessment data, that have plagued middle and upper grade levels for years, if not decades.

A week of education-related hearings in Washington, D.C.

ThinkstockPhotos-492905119-USCapIt was a busy week for education in Washington, D.C., as Congress held four hearings on a variety of topics. Two of those hearings were dedicated to oversight as the Department of Education (ED) implements the Every Student Succeeds Act (ESSA), another was focused on President Obama’s education budget proposal, and a final hearing concentrated on the confirmation of current acting U.S. Secretary of Education John King as Secretary of Education.

ESSA Implementation

The Senate Committee on Health Education Labor and Pensions (HELP) kicked the week off on Tuesday with a hearing entitled, “ESSA Implementation in States and School Districts: Perspectives from Education Leaders.” Seven invited witnesses delivered testimony on the topic. The witness list included a governor, two superintendents, two think tank representatives, and two teacher union representatives. All panelists welcomed the new law, specifically with regard to more state-controlled decision making, and expressed the importance of quality regulations delivered under an appropriate timeline.

Committee Chairman Lamar Alexander (R-TN) stated that the Committee wants states to have plans ready by July 1, 2017, and one panelist hoped that initial regulations would be finalized by this coming fall. While most panelists agreed with the need for rapid response to the law, there was some concern that moving too quickly could mean states will merely tinker with current systems as opposed to taking the time to really rethink the systems in place. The importance of teacher involvement in the implementation process was also discussed. Watch the full Senate committee hearing here.

The House Committee on Education and the Workforce also held a hearing dedicated to ESSA implementation. The hearing took place Thursday morning and was entitled “Next Steps for K-12 Education: Upholding the Letter and Intent of the Every Student Succeeds Act.” This is the second ESSA oversight hearing held by the House (read more about the first hearing here). Acting Secretary King was the only witness at the hearing yesterday morning.

While members did ask King about specific issues pertaining to the new law, Committee Chairman John Kline (R-MN) kicked off the meeting with comments and questioning on the federal government’s role under ESSA. He specifically pointed to comments made by former Secretary of Education Arne Duncan late last year that seemed to imply ED was already looking for ways around some of the new law’s restrictions that limit the department from intervening in states’ policies. King understood the limitations but also assured members that ED would adequately enforce the civil rights aspects of the law. Watch the full House committee hearing here.

Dr. John King’s Confirmation as Secretary of Education

Since Arne Duncan stepped down from his post as the nation’s top education official, one of his previous top advisers, Dr. John King, has served as acting U.S. Secretary of Education. Following a few months on the job, President Obama decided to put forth the acting secretary as his nominee to officially replace Duncan. Such a nomination requires the approval of the U.S. Senate. The process of confirming acting Secretary King began Thursday with a Senate confirmation hearing in the Senate Committee on HELP.

King was asked to weigh in on some issues of major importance to the education community.

  • On ESSA, King said they have begun the negotiated rulemaking process on several pieces of the law and are listening to stakeholders. On the importance of maintaining the civil rights legacy of the Elementary and Secondary Education Act (ESEA), he said that with the added flexibility under ESSA at the state level, states would have the opportunity to focus on increasing equity.
  • On teacher shortages, King said there is an opportunity to reset our conversations around the teaching profession. He recognized that states have their own specific issues with regard to teacher shortages. He acknowledged that compensation is often low and student growth is quickly rising in many areas.
  • On teacher evaluation, King agreed with Chairman Alexander that evaluation systems are to be designed and implemented at the state level, but he pointed to equity plans and federal Title II dollars that can help states build effective evaluation systems and provide equitable access to teachers.
  • On testing, King said that while test participation is important, it is also important to ensure all tests are necessary and beneficial. He believes thoughtfulness on the part of state leaders and flexibility under the new law will give states the opportunity to address the overemphasis on testing. He pointed to new guidance ED has already released on using state and federal funds to review state’s testing regimes and better understand what is appropriate.
  • On vouchers, King stated that he does not personally believe that programs like the DC voucher program cannot be scaled to a larger level as a solution for creating greater and more equitable access to education. Chairman Alexander acknowledged that Congress was unable to pass voucher and school choice amendments, and he asked that King respect that the body failed to come to a consensus.
  • On charters, King said the key is highlighting innovative practices and scaling up strong charter-management organizations.
  • On Common Core, which he oversaw the implementation of in New York state, King promised to adhere to the spirit of the ESSA law and not intervene with state’s standards adoption.

Dr. King formerly served at ED as the Deputy Education Secretary under Duncan. Prior to joining ED, he was the commissioner of New York state public schools, founded a Boston charter school called Roxbury Preparatory Charter School, and worked as managing director for a charter management organization. He began his education career as a high school social studies teacher.

The HELP committee will meet to vote on his confirmation on March 9.

 

President Obama’s Budget

Acting Secretary King was also on the Hill Wednesday, this time to defend the president’s budget request for ED. The request is a 1.9 percent increase over the 2016 appropriation, requesting $69.4 billion dollars. King told lawmakers on the House Committee on Education and the Workforce that the K-12 portion of the proposal prioritizes equity and the teaching profession. Chairman John Kline (R-MN), however, was concerned that the proposal flatlines programs like the Individuals with Disabilities Act (IDEA).

Other Republicans expressed concern that the proposal would cause budget deficits to rise over the long term. The proposal seeks to considerably expand preschool education; Republican members pointed to the hefty price tag associated, while Democrats defended the expanded programs. King also pointed to high graduation rates and waning drop-out rates across the country saying that the budget seeks to build on progress.

Policies centered on the teaching profession were a hot topic of discussion. Acting Secretary King pointed to a billion dollar proposal called “RESPECT: Best Job in the World.” According to ED, the competitive grant program funds could be used to create advancement opportunities for teachers, provide teachers with flexibility to focus on professional development, or improve working conditions. The program would be focused on supporting “comprehensive, locally-developed, teacher-led efforts in our highest-needs schools.”

The president’s budget proposal faces a long and unlikely road to passage.

ATPE representatives visited the U.S. Department of Education this summer to discuss the state’s ESEA waiver request. Texas received an extension of the waiver this week but learned that our state has been placed on “high-risk status.”

In 2013, Texas asked the U.S. Department of Education to waive certain outdated accountability provisions in the Elementary and Secondary Education Act (ESEA), also known as No Child Left Behind (NCLB). The federal government granted us flexibility on a temporary basis, conditioned on Texas’s agreeing to change the way it evaluates educators. As TEA has been developing and piloting a new state-recommended system for evaluations of teachers and principals (T-TESS and T-PESS), the state has sought and received short-term extensions of the waiver. Now, the feds are giving Texas a January 2016 deadline to show that it is prepared to meet the Obama administration’s demands on requiring all schools to use the state’s new evaluation model and base personnel decisions upon it. If you plan to submit written feedback to the State Board for Educator Certification (SBEC) about its troubling plan to allow superintendents to become certified despite having no master’s degree or prior experience as an educator, the public comment period ends Monday, Oct. 5. At ATPE’s request, Texas congressmen ask U.S. DOE for NCLB waiver extension

As previously reported on Teach the Vote, members of the ATPE staff and state officers recently met with several members of the Texas congressional delegation in Washington and asked them to support our effort to advocate for an extension of time on the state’s NCLB waiver. A majority of the Texas congressional delegation granted our request to sign a letter of support for giving our state a waiver extension.

Texas has been granted a preliminary waiver of accountability measures in the federal ESEA/NCLB law, which was conditioned on the state’s changing its system for teacher evaluation. The Texas Education Agency (TEA) announced plans in May for a new system that would be piloted in the 2014-15 school year and implemented statewide in 2015-16 in accordance with expectations of the U.S. Department of Education. ATPE voiced concern that the timeline should be extended so that results of the pilot can be analyzed and adjustments can be made, if necessary, before TEA attempts to roll out new evaluations statewide.

On Wednesday, July 23, TEA announced that Commissioner Michael Williams has sent a letter to U.S. Secretary of Education Arne Duncan asking for a one-year extension of time. Similarly, 22 members of the U.S. House of Representatives from Texas sent a letter at ATPE’s request to Secretary Duncan on July 24, asking for additional time for the implementation of any teacher evaluation changes in Texas and urging him to grant our state an extension of the NCLB waiver. ATPE is grateful for the assistance of the 22 congressmen, including House Committee on Education and the Workforce members Kenny Marchant and Rubén Hinojosa, who signed our bipartisan letter of support. We also appreciate the willingness of the commissioner to request an extension of time before proceeding with statewide implementation of a new evaluation system. Finally, we hope that Secretary Duncan will consider our request and enable Texas adequate flexibility to continue working to improve public education without being hamstrung by outdated federal accountability laws.

Commissioner requests extension of NCLB waiver and time for teacher evaluation pilot

Texas Commissioner of Education Michael Williams has written to U.S. Secretary of Education Arne Duncan requesting an extension of time for piloting a new teacher evaluation system. In doing so, Commissioner Williams has responded to the growing chorus of educators and others questioning the feasibility of a timeline imposed by the federal government for Texas to overhaul its teacher evaluation system.

Duncan previously granted Texas a waiver of certain accountability measures in the Elementary and Secondary Education Act (ESEA), more commonly known as No Child Left Behind (NCLB). The outdated federal law has become problematic for most school districts, prompting Texas Education Agency (TEA) officials to join most other states in seeking flexibility in the form of waivers. Duncan offered Texas a conditional waiver that requires the state to change the way it evaluates teachers and principals. In fulfillment of that condition, TEA announced a plan in May to pilot a new Texas Teacher Evaluation and Support System (T-TESS) in the 2014-15 school year in several districts and implement the new system statewide in the 2015-16 school year.

ATPE and other groups have voiced concerns that the implementation timeline mandated by the federal government is unreasonable, primarily because it does not allow time for analysis of the pilot results and modifications to the new evaluation system prior to full implementation. (Read about ATPE’s recent discussions with the Texas Congressional delegation in Washington, D.C. about the need for an extension of time.) Commissioner Williams echoed those concerns in his letter to Duncan, stating, “If Texas is to develop an evaluation system that truly supports our teachers, we need time to complete the pilot year and then utilize the constructive feedback we will receive from our school districts, charters and educators.”

If the state’s request for an extension is granted, it is likely that there will be two years of piloting for the new teacher evaluation system, known as T-TESS. According to TEA officials, it is too early to know whether the same school districts participating in the 2014-15 pilot year will participate in a second year of piloting the new system.

ATPE officers make the rounds in D.C.

Things were certainly heated in Washington, D.C. last week—June 16–19—as ATPE State President Ginger Franks, Vice President Richard Wiggins, Executive Director Gary G. Godsey and Governmental Relations Director Brock Gregg brought Texas weather (98 degrees) and hot issues to the Texas congressional delegation and U.S. Department of Education.

Our team attended meetings with key Texas Congressmen who serve on the U.S. House Committee on Education and the Workforce as well as majority and minority staff members of other Congressmen on the committee. We met with the two Texas Senators, Sens. Cornyn and Cruz, and Texas Congressmen serving on the House Ways and Means committees, which oversees the Social Security system.

We focused on educating Congress about the recent federal requirement that Texas institute a new principal and teacher evaluation system (that accountability based on student test scores) as a condition of receiving a waiver from the Elementary and Secondary Education Act (ESEA). The waiver exempts Texas from accountability sanctions from the outdated accountability standards under current law; the outdated accountability standards are a result of more than a decade of Congressional gridlock and inability to update the ESEA. The DOE is using this inaction to force states to adopt several “reforms,” including the teacher evaluation piece, in exchange for flexibility under current law.

ATPE has worked hard with Texas Commissioner of Education Michael Williams and the Texas Education Agency to create an evaluation system primarily based on recently adopted state standards of practice for what an educator should know and be able to do. On the test score portion of the evaluation, ATPE recommended using student scores aggregated at the campus level so that all educators are held accountable for every student on the campus, instead of using classroom scores at the individual teacher level. We have also asked for an extension of the pilot program’s timeline so that the program’s first year can be properly evaluated prior to full implementation of the system in all districts.

During our meeting with the DOE, we were pleased to hear that the department has recently decided to consider requests for more flexibility, and we are hopeful Commissioner Williams will request and receive more time. We also hope that the Commissioner will continue conversation about using campus scores, which we believe are more accurate and create a sense of campus collaboration instead of competition, anger and fear of the unknown.

Our message to our Congressmen was to please help us persuade the DOE that Texas does need that flexibility and that we would prefer to handle our own state-level teacher evaluation system. In addition, we advocated for changes to the Windfall Elimination Provision (WEP), a Social Security provisions that effects public servants who don’t contribute to Social Security for at least thirty years. The formula used for the WEP is arbitrary and is not proportional to the number of years paid in, unlike the formula that applies to all other Americans who are covered by Social Security.

ATPE expresses concern over teacher evaluation plans during House committee hearing

The House Public Education Committee held an interim hearing yesterday, May 14, to discuss the state’s new plans for teacher and principal evaluations and other issues relating to teacher quality. The Speaker of the House asked the committee to study these issues during the interim.

Yesterday’s hearing consisted of four panels of invited witnesses, followed by public testimony from several stakeholders, including ATPE member Stephanie Stoebe. Stoebe served on a steering committee of teachers appointed by the Texas Education Agency (TEA) to give feedback on the new evaluation system and proposed teaching standards. The first panel of invited witnesses yesterday consisted of teachers and principals who shared their experiences with innovative instructional practices, such as using flipped classrooms. For the second panel, former Commissioner of Education Jim Nelson appeared on behalf of the Texas Teaching Commission. He explained the commission’s 2012 study of issues relating to the teaching profession and noted that most of the time was spent discussing teacher evaluation and compensation. Representatives of the state’s four largest teacher groups who initially served on the commission withdrew from it in late 2012 because they could not support directions being taken by the commission on several issues, including evaluation. Nelson testified that commission members believe student growth should make up more than 20 percent of a teacher’s evaluation.

Representatives from TEA made up the third panel. Michele Moore, Associate Commissioner for Educator Leadership and Quality, and TEA Deputy General Counsel Von Byer were there to provide updates on teacher quality initiatives and explain the new teacher and principal evaluation system developed by TEA. Legislators on the committee expressed concern regarding the timeline for implementation of the system, which calls for piloting in the 2014-15 school year and full statewide implementation in 2015. TEA staff acknowledged that without a special session, the Texas Legislature would have to change state law to require statewide implementation prior to receiving feedback from the pilot study. TEA also confirmed that the value added-portion of the new evaluation system as proposed will not even be completed until mid-June.

ATPE Governmental Relations Manager Jennifer Canaday testified as part of the fourth panel along with representatives of TCTA, Texas AFT and TSTA. All four invited witnesses stressed concern over TEA’s decision to include a value-added measure at the individual teacher level in the new evaluation plans. Each of the panelists pointed to an abundance of research suggesting VAM is an inaccurate measure of teacher performance for purposes of high-stakes employment decisions. Due to this research, Canaday conveyed that  ATPE had suggested to Commissioner of Education Michael Williams that VAM be used only at the campus level or higher for evaluation purposes, as opposed to the individual teacher or classroom level.

Canaday also explained how the design of the new evaluation system had been dictated by the terms of an NCLB waiver that Texas has been trying to secure from the U.S. Department of Education. In a letter sent to House Public Education committee members on the eve of the hearing, Commissioner Williams insisted that the NCLB waiver was not the reason for the evaluation changes. However, as Canaday explained to legislators yesterday, the federal government, through Secretary of Education Arne Duncan, has demanded that student growth make up at least 20 percent of teacher evaluations and has used the NCLB waiver process as a means of forcing states to adopt controversial reforms, such as tying teacher evaluations to test scores or adopting the Common Core national curriculum.

All members of the panel of teacher group advocates encouraged TEA to continue to negotiate with the U.S. Department of Education and seek an extended timeline in which to work. At minimum, an additional year is needed before statewide implementation so that any data or feedback from the pilot year can be incorporated and changes made where necessary. “We should tell Secretary Duncan that we are Texas and we have 5 million students and we want to get this right,” Canaday told the committee. “We need to be negotiating from a position of strength and asking for an extension of time or different parameters.” Canaday also pointed out that parents would never tolerate the use of controversial VAM methods, which she likened to “secret statistical voodoo” in some instances, to make high-stakes decisions about students, such as determining their class rank or course grades. “If VAM is not good enough for students, why are we insisting that it be used on teachers?” she asked rhetorically.

Additionally, Canaday reiterated ATPE’s belief that in order to improve the profession and better recruit and retain teachers we should raise standards to enter the profession, offer all new teachers mentoring opportunities, pay teachers more professionally and give them career advancement opportunities that don’t necessarily require them to leave the classroom. She also told members about the TELL Texas survey on teachers’ working conditions, which is taking place now and has the potential to generate valuable data that can assist us with teacher retention efforts and improving student achievement without the use of test scores. Canaday urged legislators on the committee to follow up with school leaders back in their districts to encourage full participation in the TELL Texas survey, which ends May 31.

TEA announces details of teacher evaluation pilot, submits plan to USDE for approval

The Texas Education Agency (TEA) announced today that it has submitted its formal plan for a new teacher evaluation system to the U.S. Department of Education. Through Secretary Arne Duncan, the federal government has demanded that Texas adopt new teacher and principal evaluation instruments as a condition of a No Child Left Behind (NCLB) waiver the state received earlier this school year. Duncan is using the waivers to compel states to adopt educator evaluation systems that consider student growth as a significant factor in the appraisals.

TEA will pilot the new instrument in 72 school districts this fall. The agency hopes to roll out the new evaluation model statewide in the 2015-16 school year. Under the proposed new system, 20 percent of a teacher’s evaluation will be based on student growth. For teachers of certain tested subjects and grades—primarily math and reading—the student growth portion will be assessed using a new value-added measurement developed by the state. The statistical calculation will determine if the teacher’s students are meeting expected rates of growth from year to year on STAAR tests.

The remainder of the teacher’s evaluation will be based on an observation rubric that includes indicators related to planning, instruction and the learning environment. Professionalism is also an element of the evaluation, encompassing professional practices, ethics, goal-setting, self-assessment and professional development.

The U.S. House Committee on Education and the Workforce is scheduled to meet tomorrow, April 29, at 9 a.m. CST for a hearing entitled “Reviewing the President’s Fiscal Year 2015 Budget Proposal for the Department of Education.” The hearing will give members of the committee an opportunity to review President Obama’s education budget request. Secretary Arne Duncan will testify and be available to answer any members’ questions during the hearing.

Congress is currently working on appropriations measures to fund the government for 2015. Secretary Duncan appeared before a House Appropriations subcommittee earlier this month to discuss his budget. The Committee on Appropriations will ultimately be responsible for drafting legislation to fund the Department of Education and its various programs in fiscal year 2015.
