Teach the Vote’s Week in Review: Oct. 25, 2019

Here’s your weekly wrap-up of education news from ATPE Governmental Relations:


ELECTION UPDATE: Early voting began this week for the Nov. 5 constitutional election. Voters statewide will be deciding whether or not to approve 10 proposed amendments to the Texas Constitution, as well as other local ballot measures. Voters in three House districts will also be electing a new state representative in a special election on the same day.

Early voting continues through Nov. 1. We at ATPE encourage all educators to vote in every election and take advantage of the convenience of early voting at any polling place in your area. Make a voting plan! Use the weekend to learn about what’s on your ballot, and then build and print a sample ballot to take with you to the polls. (Remember that cell phones aren’t allowed to be used in the voting booth!) For additional voting resources, visit TexasEducatorsVote.com.

In other election news, Texas House Speaker Dennis Bonnen (R-Angleton) announced this week that he will not seek re-election in 2020, paving the way for the election of a new speaker in 2021. ATPE Lobbyist Mark Wiggins reported on the announcement, which comes on the heels of a scandal involving a secret recording and allegations of bribery. This week we wrapped up our blog series, “New School Year, New Laws,” in which ATPE Lobbyist Andrea Chevalier shared weekly highlights of many education bills passed by the Texas Legislature earlier this year. In the final installment this week, we’re looking at how school districts around the state are implementing the requirements under House Bill (HB) 3 to increase teacher compensation. New School Year, New Laws: Compensation Update

Welcome to our final blog post in ATPE’s “New School Year, New Laws” blog series for Teach the Vote. In last week’s post, we summarized new laws that will impact charter schools. This week, we will investigate how the changes to funding and compensation in House Bill (HB) 3 are being implemented in several school districts across the state.

HB 3 by Rep. Dan Huberty (R-Kingwood), the major school finance bill passed earlier this year, included some important provisions aimed at increasing compensation for many educators. More specifically, lawmakers required that school districts use 30% of their increase in funding under the bill to increase compensation for full-time district employees, excluding administrators. Of that dollar amount, 75% must be spent on compensation for full-time, certified teachers, librarians, nurses, and counselors. The other 25% can be used to improve compensation for other full-time employees. HB 3 also specifies that there should be a prioritization for teachers, librarians, nurses, and counselors with more than five years of experience, but the bill largely leaves this open for interpretation at the local level.

The combination of differences in how much additional funding each district gets and the flexibility districts have to create unique compensation packages makes it very important for us to gain a “lay of the land” in our current post-HB 3 environment. In this post we have summarized what some districts are doing by gathering news articles and information from district websites. The charts below break down some of dollar figures and percentages by which the districts shown are increasing educator compensation as a result of HB 3.


Lubbock-Cooper ISD, Region 17:

Up to 5 yrs. of exp. (teachers) 5.68%, avg.

With a 2018-19 average teaching salary of just over $45,000, we estimate that the LCISD’s average pay raise of 8.08% is about $3,640.


Klein ISD, Region 4:

Klein ISD will also provide a retention incentive to teachers, counselors, librarians, and nurses who were employed in the district on May 31 of the previous year and are returning. This incentive is in the form of a one-time payment of $1,500. All other previously employed full-time employees who are returning to the district will receive $1,000. The district has built in similar retention and healthcare payments at reduced rates for those who work less than full-time.


Clear Creek ISD, Region 4:

Clear Creek is also implementing an “honors teacher experience” program, in which teachers who reach milestones such as 5, 10, 15, etc. years of experience can receive additional compensation of up to $2,800. This could result in a total pay raise of 9.49% for some teachers. The district is also adding staff, especially in special education and is implementing safety and security upgrades.


San Marcos CISD, Region 13:

What does it all mean?

There are over 1,000 school districts in Texas, each with varied funding under HB 3. In some cases, the bill may have even provided districts with the same or less funding if not for a hold harmless provision in the bill (which expires after the 2023-24 school year). Considering this and the fact that each district also has different needs and economic factors affecting compensation, the implementation of raises is going to be varied all over Texas. Among the districts we read about, teacher salaries were raised from 3% to 9.5%. To keep up with inflation, basic yearly pay raises in other professions typically hover around 3%. We know from district salary schedules, such as this one from Leander ISD, that typical step increases are closer to 1%. With this in mind, the impact of HB 3 in some districts may have been that teachers simply got the standard raise necessary to keep up with the cost of living.

What’s next? Stay engaged!

It is important to note that there have been reports of districts that have under-calculated what they would receive in HB 3 funding, which impacts the amount they are required to spend on compensation. Additionally, some districts have relied almost exclusively on one-time stipends, which are less stable and do not necessarily count toward compensation for purposes of TRS or the amount an educator will receive for their retirement pension. ATPE is working with state officials to solve these issues so that districts comply with HB 3’s efforts to increase educator compensation.

Across the sources we gathered, it seems that district leaders are happy to have the raise but still think that there are further improvements to be made. Clear Creek ISD Deputy Superintendent Paul McLarty wants to see more from the state, like getting closer to a 50-50 split between local and state funding. Klein ISD Superintendent Dr. Jenny McGown remarks that the state is still ranked 41st in the nation in spending. Lubbock-Cooper ISD Superintendent Keith Bryant says that he would like to eventually be able to provide teachers with a competitive wage.

ATPE agrees with these sentiments and urges educators to return to the polls during the 2020 primary and general elections when voters will have a chance to decide who will represent them in the next legislative session. The raises for educators and public education funding increases that resulted from the 2019 legislative session are a direct result of educators’ votes in the 2018 elections. State leaders announce deal on school finance, property tax relief, and TRS legislation

At a press conference held this afternoon, Gov. Greg Abbott, Lt. Gov. Dan Patrick, and Speaker of the House Rep. Dennis Bonnen announced that a deal has been reached on legislation to address school finance, property tax relief, and the Teacher Retirement System (TRS). Flanked by members of the conference committees that worked on the bills, the “big three” shared highlights of the final negotiated versions of House Bill 3 and Senate Bill 12 and thanked those who worked on the compromise.

A flyer was shared with reporters touting major components of the agreement, including increasing the basic allotment for schools; providing $5 billion in property tax relief; funding full-day pre-K for low-income students and increasing the funding to serve other students with special needs; calling for outcomes-based funding tied to college, career, and military readiness; reducing recapture by 47% in the next two years; and offering $2 billion in various forms to assist with “dynamic teacher compensation.”

Specific details on the educator compensation piece are unknown at this point, but the new version of HB 3 has been characterized as including both a merit pay program and funding to increase salaries for veteran teachers (those with at least five years of experience), librarians, counselors, and school nurses. Immediately following the press conference, HB 3 author and House Public Education Committee Chairman Dan Huberty told reporters that the merit pay program would not be test-focused but would use T-TESS to help determine which teachers are eligible to become recognized, exemplary, or master teachers. Chairman Huberty added that Texas Tech University would be tapped to act as a “referee” for the program.

The deal announced today also provides for increased funding into the TRS pension program in order to make it actuarially sound. Also, it is believed that the state would substantially raise its contributions for active educators’ healthcare premiums under this agreement.

Actual bill language has not yet been released, but ATPE will update our Teach the Vote blog with additional details as soon as our lobbyists have a chance to see and analyze the new bills.

Texas Senate approves school finance reform bill, but opts not to fund it with a sales tax hike” was first published by The Texas Tribune, a nonprofit, nonpartisan media organization that informs Texans — and engages with them — about public policy, politics, government and statewide issues.

The Texas Senate on Monday approved a bill to massively overhaul public school finance, but did so while backing away from a proposal to use an increased sales tax to lower school district property taxes.

After an hours-long debate on dozens of proposed changes, the Senate voted 26-2 on House Bill 3, which under the version passed by the upper chamber would increase student funding, give teachers and librarians a $5,000 pay raise, fund full-day pre-K for low-income students, and lower tax bills.

The House and Senate will have to negotiate their significant differences over the bill — including how to offer teacher pay raises and property tax relief — in a conference committee before it can be signed into law.

“When you’re doing something as complex as this, there’s going to be something you don’t like,” said state Sen. Larry Taylor, R-Friendswood, the bill’s author, anticipating tension throughout the day’s debate.

Since school districts levy the majority of property taxes in Texas, many lawmakers have been seeking ways to help reduce those portions of Texans’ tax bills. But since the state is required to ensure school districts have enough money to educate students, any tax relief effort would have a significant cost — requiring the state to reimburse schools, if they’re unable to collect enough from local property taxes.

Taylor had originally included several provisions that would provide ongoing tax relief, paid for by an increase in the sales tax by one percentage point.

Republican leaders, including Gov. Greg Abbott, had thrown their support behind that sales tax swap, arguing it would help Texans who are currently being taxed out of their homes. But the proposal has serious detractors in lawmakers from both parties in both chambers who are opposed to a higher sales tax.

So Taylor stripped the increase from HB 3 and offloaded some of the more expensive property tax relief provisions in the bill. The bill no longer includes an expansion in the homestead exemption from school district taxes. It lowers property tax rates by 10 cents per $100 valuation, instead of 15 cents, saving the owner of a $250,000 home $250 instead of $375.

The legislation would still limit the growth in school districts’ revenue due to rising property values, a proposal pitched before session began by the governor. School districts that see their property values significantly increase would have their tax rates automatically reduced to keep tax revenue growth in line. That would now start next year, instead of in 2023.

“The bill before us today has no linkage to the sales tax and is not contingent upon a sales tax,” Taylor said.

Instead, the bill creates a separate “Tax Reduction and Excellence in Education Fund” to fund school district tax relief. State Sen. Kirk Watson, D-Austin, said a working group came up with a plan to get $3 billion from several sources, including the severance tax on oil and gas extraction and an online sales tax.

“This does not increase any taxes of any kind,” he said.

A few senators didn’t vote yes on HB 3 because they didn’t know the cost of the bill or how their school districts would be affected by it.

“The lack of a fiscal note delineating the total cost of the bill was unacceptable,” said state Sen. Charles Schwertner, R-Georgetown, who voted against the bill along with state Sen. Brandon Creighton, R-Conroe.

Creighton echoed those concerns about not knowing the legislation’s price tag, though he said he agreed with its policy.

“Before the session ends, I will have another chance to vote on the final bill, and I look forward to supporting it once I have a clear understanding of the impacts on school districts in Senate District 4, and the true cost of the legislation, which will have implications for all Texas taxpayers,” he said in a statement after the vote.

State Sens. Angela Paxton, R-McKinney, Paul Bettencourt, R-Houston, and Bob Hall, R-Edgewood, marked themselves “present, not voting.”

The House and Senate have passed versions of HB 3 that are similar in some ways: Both would raise the base funding per student — a number that hasn’t budged in four years — and would provide about $780 million for free, full-day pre-K for eligible students.

Among the disagreements: how to make sure school employees get much-needed raises. The Senate has prioritized $5,000 pay raises for all full-time teachers and librarians. The House has directed districts to give all school employees about $1,388 in raises on average statewide and designated extra money for raises to be given at districts’ discretion.

Senate Democrats’ efforts to extend those $5,000 raises to full-time counselors and other employees failed along party lines Monday.

Also controversially for some, the Senate includes money providing bonuses to schools based on third-grade test scores and funding districts that want to provide merit pay for their top-rated teachers. Many teacher groups have opposed both, arguing it would put more emphasis on a flawed state standardized test.

State Sen. Beverly Powell, D-Burleson, failed to get an amendment to the bill approved that would strike tying any funding to third-grade test scores.

Teachers, parents and advocates following on social media had paid attention to Powell’s amendment, mobilizing in support through a Twitter hashtag “#NoSTAARonHB3.”

Taylor pointed out that the bill also allows school districts to use assessments other than the state’s STAAR standardized test, which has lately come under renewed scrutiny, with researchers and advocates arguing it doesn’t adequately measure students’ reading abilities. He approved an amendment requiring the state to pay for school districts to use those alternative tests, which he estimated would cost about $4 million.

Senate Education Committee postpones merit pay and school finance discussion for one week

The Senate Education Committee, meeting today, has postponed its consideration of a major school finance bill, House Bill (HB) 3, until next week. Originally on the agenda for today’s meeting, the hearing of the bill by Rep. Dan Huberty (R-Kingwood) was pushed back a week to allow the Senate more time to complete its drafting of a Senate committee substitute for the bill.

HB 3 is now expected to be heard by the Senate Education Committee on Tuesday, April 23.

As we have reported here on Teach the Vote, the engrossed version of HB 3 passed the Texas House with a near unanimous vote of 148-1. The House bill language reflected changes made in the House Public Education Committee, which Rep. Huberty chairs, to address concerns of ATPE and numerous other stakeholders. Significant changes made to the original bill as filed included removal of a controversial merit pay plan that would have tied teacher pay to student performance (likely measured by standardized test scores), which the overwhelming majority of the education community including all of the state’s major teacher organizations opposed. Language that would have enabled school districts to opt out of the state’s minimum salary schedule was also removed from HB 3 as filed by the House Public Education Committee. During floor debate of HB 3, the House also added a provision requiring an across-the-board pay raise for all school district employees except administrators. For these reasons and its addition of $9 billion into funding Texas public schools and property tax relief, ATPE was proud to support the House’s engrossed version of HB 3.

ATPE is urging educators to contact their senators now about HB 3 to share feedback on this important bill that is expected to be heard next week. Of particular concern is the language in the bill pertaining to educator pay. Although the Senate has already passed its own bill calling for a $5,000 pay raise for teachers and librarians, leaders in the Senate have also expressed interest in adding merit pay to any school finance bill that passes this session. For instance, Senate Education Committee Chairman Larry Taylor (R-Friendswood), who is sponsoring HB 3 in the Senate, also filed his own school finance reform bill that includes both merit pay for select teachers and controversial outcomes-based funding tied to students’ test performance (Senate Bill (SB) 4).

Now that HB 3 has made its way to the upper chamber, ATPE is urging the Senate to keep merit pay out of HB 3 and avoid changing the bill in such a manner that would erode its widespread support and momentum this session.

Teach the Vote’s Week in Review: April 12, 2019

Here’s your weekly wrap-up of education news from ATPE Governmental Relations:


On Tuesday, April 9, the Texas Senate passed its version of the state budget for the next two years. The Senate’s substitute version of House Bill (HB) 1 received unanimous approval from the upper chamber.

Like the House, the Senate set aside $2.7 billion in the budget bill for “tax relief,” although it is yet to be determined exactly how the money will be spent to achieve that goal. The Senate also dedicated $6.3 billion to public schools, $4 billion of which is reserved for a $5,000 across-the-board pay raise for all full-time teachers and librarians through Senate Bill (SB) 3. That leaves only $2.3 billion in the Senate’s bill to try to make changes to the larger school finance system.

The Senate’s budget proposal differs from the House’s plan, which delivers more than $6 billion to school districts with instructions to spend the first 25 percent of any increase in the basic allotment, or approximately $2.4 billion, on salary increases for all non-administrative staff. While amounts of such a pay raise, if passed, would vary from district to district, the House’s plan would average out roughly to about $1,300 per full-time employee.

Next, each chamber will appoint members to a conference committee that will work out the differences between the version of HB 1 that the Senate passed this week and the version of the bill that the House passed last month. For its part, the House has already appointed its five members of the critical budget conference committee: House Appropriations Chairman Rep. John Zerwas will chair the committee, joined by Reps. Greg Bonnen, Sarah Davis, Oscar Longoria, and Armando Walle. Once the Senate appoints its conferees, negotiators will have until the session ends in late May to reach an agreement. The budget is the only bill the Texas Legislature is constitutionally required to pass, so any failure to come to an agreement within the 140-day regular session would result in legislators being called back for a 30-day special session to finish the budget.

 


The state’s ongoing difficulty in providing resources for students with disabilities continues to make headlines. On Thursday, April 11, Representative Mary González (D – Clint) and Representative Morgan Meyer (R – Highland Park) held a press conference to address Texas’s consistent underfunding for students with disabilities and lack of compliance with federal spending requirements under the Individuals with Disabilities Education Act (IDEA). ATPE and other stakeholder groups representing educators, students, and advocates for people with disabilities participated in the bipartisan press conference.

The state’s inadequate spending on students with special needs could cost Texas as much as $223 million in lost federal funding. Under the IDEA’s maintenance of financial support requirement, each state must spend at least as much on special education as it did in the previous year or face a financial penalty. The Senate Education Committee convened twice this week to take action on bills pertaining to virtual schools and other miscellaneous items. The first meeting of the committee on Tuesday featured testimony about which entity should manage the Permanent School Fund and a discussion of school turnaround options. The committee also heard an ATPE-supported bill by the committee’s chairman, SB 1895 by Sen. Larry Taylor (R-Friendswood), that would help educators receive professional development on blended learning.

Among the legislation voted out favorably by the committee on Tuesday were two bills pertaining to virtual schools, which ATPE opposed when they were heard by the committee the previous week. The committee advanced SB 2244 by Sen. Angela Paxton (R-McKinney), which prevents school districts from charging fees for virtual classes and makes it easier to enroll in virtual schools, and SB 1455 by Sen. Larry Taylor (R-Friendswood), which also expands virtual schools. ATPE previously submitted written testimony opposing both bills and citing research that calls into question the quality and performance of existing virtual schools. The committee also voted out a number of other bills, including SB 1256 by Sen. Paul Bettencourt (R-Houston) that cleans up portions of his educator misconduct bill passed last session.

During the Senate committee’s second hearing on Thursday, the bills discussed were mostly unrelated to each other. ATPE supported bills including SB 426 by Sen. Eddie Lucio,. Jr. (D-Brownsville), which would ensure that counselors spend the majority of their time counselling students as opposed to being assigned other duties such as test monitoring. The committee also took action on some pending bills, including a major school safety bill. Chairman Taylor’s SB 11, which ATPE had also supported, received a favorable vote by the committee on Thursday. SB 11 follows up on recommendations of the Senate Select Committee on Violence in Schools and School Security that met during the interim last year.

On Tuesday, April 16, the Senate Education Committee is slated to meet again and is expected to hear the House’s major school finance bill, HB 3. ATPE urges educators to contact their senators about this widely support bill and keep up the momentum for passing meaningful school finance reform and an educator pay raise this session.

 


The House Public Education committee held a marathon meeting on Tuesday, hearing 38 bills that mostly pertained to charter schools. Several of the bills were aimed at regulating the expansion of charter schools and how charter schools handle student discipline, eliciting hours of public testimony. Other bills heard on Tuesday included the ATPE-supported HB 228 by Rep. Matt Krause (R-Fort Worth) that would create new eligibility standards for Districts of Innovation (DOI), and HB 1853 by Rep. Leo Pacheco (D-San Antonio), which would require charter schools to hire certified educators and protect the rights of educators. ATPE also provided neutral testimony on HB 3904 by Chairman Dan Huberty (R-Kingwood), which is considered a clean-up bill for Huberty’s HB 22 that was passed last session.

The committee will meet again on Tuesday, April 16, where it will consider a diverse agenda, including some virtual schooling bills similar to those acted upon by the Senate committee this week. ATPE is encouraging educators to contact their senators asking them to oppose two bills that would infringe on educators’ free speech rights and limit the ability to teach studentsSB 1569 by Sen. Pat Fallon (R-Prosper) and SB 904 by Sen. Bryan Hughes (R-Mineola) both deal with “political advertising” laws and are aimed at limiting the ability of school district employees and school board members to talk about political content while they’re at school.

SB 1569 has been placed on the Senate Intent Calendar for next week, meaning that it could come up for a floor vote as early as Tuesday. SB 904 has not yet been placed on the Senate Intent calendar but may also appear there at any time. While the authors did make some changes to these two bills compared to their versions as filed, ATPE remains concerned about likely negative consequences of SB 1569 and SB 904 and the chilling effect they would have on educators. Senate passes bill to raise pay for teachers, librarians

On Monday afternoon, March 4, 2019, the Texas Senate unanimously passed Senate Bill (SB) 3 by Sen. Jane Nelson (R-Flower Mound). The bill, which calls for an across-the-board pay raise for numerous educators, is considered to be among the Senate’s highest priority legislation this session and aligns with the governor’s declaration of teacher pay as an emergency issue for the 86th Legislature. The vote yesterday by the full Senate moves the bill one step forward in the legislative process, as it still would have to be approved by the House and by Gov. Greg Abbott in order to take effect.

ATPE State Vice President Tonja Gray was among several educators who testified before the Senate Finance Committee about SB 3 on Feb. 25, 2019.

As filed, SB 3 was intended to provide all full-time public school teachers with a $5,000 pay raise above their current compensation. Responding to concerns voiced that the bill does not cover certain other education personnel who are involved in delivering instruction, Sen. Nelson amended her bill on the Senate floor to add a provisions offering librarians the same raise. Recounting memories of her own time spent working as a teacher and the assistance that was provided by the librarian at her school, Sen. Nelson spoke about the importance of librarians and noted that Texas certification rules also require librarians to have prior classroom teaching experience.

A number of senators rose to speak yesterday from the Senate floor about SB 3, and there were mentions of the other school personnel who are not included in the proposed pay raise. Sen. Nelson acknowledged the concerns and referred to her bill as a step in the right direction. By the time SB 3 was passed out of the upper chamber yesterday, all members of the Senate had signed on as co-authors of the bill.

As previously mentioned, SB 3 heads next to the Texas House for its consideration. The House is rolling out its own major school finance reform bill today, which includes a proposal to increase the minimum salary schedule that covers teachers, librarians, school counselors, school nurses, and educational diagnosticians. Leaders in the House have expressed less support for across-the-board pay raises this session, instead favoring giving school districts local discretion, and have criticized the approach taken by senators in SB 3 as being too narrowly focused on teacher pay to the exclusion of other school funding needs. Sen. Larry Taylor has said that he will also be filing a more comprehensive Senate version of school finance overhaul.

Teach the Vote’s Week in Review: Feb. 8, 2019

Here’s your chilly edition of this week’s education news highlights from the ATPE Governmental Relations staff:


Andrea Chevalier

ATPE is excited to welcome Andrea Chevalier, the newest lobbyist to join our Governmental Relations team.

Andrea joins us most recently from the office of state Rep. Mary Gonzalez (D-Clint), where she served as Legislative Director and oversaw a host of issues, including public education. She is also a former classroom teacher with experience working in both the traditional public school and charter school environments. Andrea attended the University of Texas at Austin, where she studied chemistry; earned her Masters of Education in Secondary Education at the University of North Texas; and is currently working on completing her doctoral degree in Educational Leadership and Policy from UT.

Andrea will be lobbying and reporting on a variety of issues being debated by the legislature this session, working closely with the House Public Education Committee, and covering educator quality regulations considered by the State Board for Educator Certification (SBEC). On Tuesday, Gov. Gregg Abbott addressed a joint session of the 86th Legislature, delivering his traditional “State of the State” address. He outlined his legislative priorities for the session, punctuated by the declaration of six issues as emergency items that would warrant expedited action by lawmakers. All six of the issues bear close ties to public education, including most notably school finance, school safety, and teacher pay. Abbott’s declaration of these school-related emergency issues is a testament to the impact of the 2018 election cycle in which the Texas public education community was much more noticeably vocal and active. Tuesday was also the day for President Donald Trump to deliver his State of the Union address. That speech, which had been postponed due to the recent federal government shutdown, contained far less education-related content. The two legislative committees that oversee public education policy issues in Texas have begun holding regular meetings and hearing testimony. The Senate Education Committee held its first meeting of the legislative session this week, receiving an overview presentation by Texas Education Commissioner Mike Morath. The committee also learned about the status of special education programs in Texas. ATPE Lobbyist Mark Wiggins attended the meeting and provided this detailed summary for Teach the Vote.

The House Public Education Committee, which began its work a little earlier this session, held two meetings this week, both heavily focused on the topic of school finance. The committee similarly heard from Commissioner Morath, along with members of the Texas Commission on Public School Finance. The committee is slated for two more meetings next Tuesday and Wednesday, and the agenda will include testimony by stakeholders about school finance and the recommendations of the commission that studied the issue last year. On Monday of this week, the House Appropriations Committee announced its subcommittees that will work on various sections of the state budget. Committee members were also briefed by staff of the Texas Education Agency (TEA) and Teacher Retirement System (TRS). ATPE Lobbyist Mark Wiggins attended the meeting and provided an in-depth report here for our blog. On the other side of the Capitol, the Senate Finance Committee has also been holding several meetings to review the draft budget. Next week, Senate Finance committee members turn their attention to Article III, which contains the education budget. ATPE Senior Lobbyist Monty Exter will be there for those meetings starting Monday and will provide updates next week for Teach the Vote.

 


SPECIAL ELECTION UPDATE: Voters in San Antonio’s House District 125 will head to the polls Tuesday to elect a new state representative. Early voting has taken place this week for the special election to fill the vacant seat of former Rep. Justin Rodriguez, after he resigned to serve as Bexar County Commissioner. The five candidates vying for the HD 125 seat are Steve Huerta (D)Ray Lopez (D)Fred Rangel (R)Coda Rayo-Garza (D), and Art Reyna (D).

There also remains a vacancy in Houston’s HD 145, where Democrats Melissa Noriega and Christina Morales have advanced to a runoff in that special election. The date of the runoff election for HD 145 has not yet been announced, but is likely to be held in March. Governor Abbott declares emergency items, includes teacher pay

Texas Governor Greg Abbott announced a total of six emergency items in Tuesday’s State of the State address to a joint session of the 86th Texas Legislature. The State of the State is traditionally delivered by the governor at the beginning of each legislative session, and is the state equivalent to the national State of the Union address delivered by the president.

The governor often uses the State of the State as an opportunity to announce emergency items for the current legislature. The first 60 days of the legislative session are meant for organization and bill filing, and legislators cannot vote on bills until after 60 days have passed. Emergency items declared by the governor are the only exception.

Governor Abbott listed six emergency items on Tuesday: School finance reform, teacher pay, school safety, mental health, property tax relief, and disaster response.

What does this mean functionally? The legislature may vote on bills under these emergency headings immediately instead of waiting for the March 8 deadline, theoretically granting them a one-month head start ahead of other bills. Yet few of these bills have been filed, and none have begun the committee process that marks the first major step in a bill’s journey to becoming a law. For this reason, the practical impact of designation as emergency items has more to do with sending a signal to legislators and the public that these are the governor’s top priorities.

In addition, each of these items is expected to require a significant amount of state funding. The budget offered by the Texas House would provide $7.1 billion in new revenue for public education, contingent upon spending a significant portion of that money on providing property tax relief, ostensibly by rebalancing the state and local share of education funding. Increasing the state’s share will ease the burden on local property taxpayers, but will not increase overall public school funding. To increase overall school funding will require spending additional money on top of what is required to ease local tax pressure.

Increasing teacher pay will require another tranche of state funds. The Texas Senate has proposed Senate Bill (SB) 3, which would grant teachers a $5,000 annual raise. The bill’s cost is tagged at $3.7 billion for the first biennium. Gov. Abbott’s comments today on teacher pay implied that he prefers a plan under development by House leaders to provide a differentiated pay program that could create a path for select teachers to earn as much as $100,000. This would apply to far fewer teachers than the Senate’s plan and consequently carry a much smaller price tag.

School safety, mental health, and disaster response will each require further funding. Fortunately, the biennial revenue estimate delivered by Texas Comptroller Glenn Hegar in January projects legislators will have roughly $12 billion more than they budgeted the previous two years. It’s important to note that some of that money will be taken up by inflation and population growth. Some of the emergency items, such as disaster response, are prime targets for one-time spending from the Economic Stabilization Fund. The state’s “rainy day fund,” as it is often called, is projected to total $15.4 billion by the end of 2021.

ATPE’s Shannon Holmes facilitates teacher pay discussion

ATPE Executive Director Dr. Shannon Holmes moderated a panel discussion on teacher compensation Thursday at a conference for the Texas Association of Midsize Schools (TAMS). The discussion included state Reps. Gary VanDeaver (R-New Boston), who is a member of the Texas House Public Education Committee, and Travis Clardy (R-Nacogdoches), who filed a high-profile teacher compensation bill in 2017 during the 85th Texas Legislature.

Both representatives agreed about the need to increase teacher compensation, which has become a major topic of discussion heading into the 86th Texas Legislature. Some of the most serious plans proposed thus far have featured differentiated pay, in which top-performing teachers are eligible for higher paychecks. Rep. VanDeaver noted that the major concern with these plans revolves around how top-performing teachers are identified. ATPE has consistently warned that student test scores should not be the primary metric for this purpose.

Rep. Clardy acknowledged that a critical part of any raise this session will be identifying state funding for that purpose. Legislation addressing teacher pay during the 2017 special session did not include state funding and instead asked districts to pay for raises out of their own pockets, which effectively tabled the discussion.

The conference featured other panels related to public education, including one featuring state Reps. Diego Bernal (D-San Antonio) and Ken King (R-Canadian), both members of the House Public Education Committee, as well as State Board of Education (SBOE) Member Keven Ellis (R-Lufkin). All three serve on the Texas Commission on Public School Finance, which was created in part by the failure of a House-sponsored school finance reform bill last session. Rep. Bernal vowed that if the commission fails to come up with a real plan to reform the finance system before the new session begins, the House will come up with its own plan and challenge the Senate to pass it.

Thursday’s event furthered underscored the extent to which the focus will be on public education in the upcoming legislative session. Many lawmakers who have seemed uninterested in addressing school finance in the past are now championing reform efforts. Rep. King and others suggested Thursday that the results of the most recent election sent a strong message that Texas voters want legislators who will advance the interests of public education.
