Coronavirus tests with results in 15 minutes or less are coming to a few Texas schools as part of a new pilot program announced Wednesday by Gov. Greg Abbott.

“As more students return to campus for in-person instruction, the State of Texas is working alongside school officials to provide resources to mitigate the spread of COVID-19 among students and staff,” Abbott said in a news release.

The program is meant to help schools conduct rapid tests of employees and students who have written permission from parents. Health experts have said accessible, rapid testing could help the state achieve substantive widespread COVID-19 testing, an elusive public health goal for Texas and much the country.

John Wittman, a spokesperson for the governor, said the tests are part of the millions being provided to Texas by the federal government. The medical company producing the tests said the antigen tests require a nasal swab, cost $5 and are about the size of a credit card.

Through the program, the Texas Division of Emergency Management will provide the tests to school systems, which will receive personal protective equipment to administer them to willing participants, according to the release. The Texas Education Agency said in an email that it will provide a monthly allotment of tests to each school system. The agency said school systems will determine how the tests will be conducted because they know “what works best for their school and community,” and each school system will provide test administrators to give the tests.

“Thank you to the U.S. Department of Health and Human Services for providing these advanced antigen tests to the State of Texas,” Abbott said. “This rapid testing pilot program will be an effective strategy to protect the health and safety of students and staff while helping to further ensure that Texas students have access to a quality education throughout the pandemic and beyond.”

Eight school systems are participating in the launch of the program: Bob Hope School in Port Arthur, Fabens Independent School District, Grace Community School in Tyler, Granger Independent School District, Lampasas Independent School District, Longview Independent School District, Harlingen Consolidated Independent School District and Ysleta Independent School District. Other public and private schools interested in the program can apply through the TEA no later than Wednesday, Oct. 28, the release said.

Wittman said implementation and testing will be “ramped up significantly,” he said, but first any issues need to be worked out in the pilot program.

Rapid antigen tests, which can detect proteins on the outside of the virus, are more prone to giving false negative results than other coronavirus tests that use genetic material.

The U.S. Food and Drug Administration says that a positive test result on an antigen test is “highly accurate,” but “antigen tests are more likely to miss an active coronavirus infection compared to molecular tests.”

But Joseph Petrosino, chair of molecular virology and microbiology at Baylor College of Medicine, said in a previous interview that the tests are most useful in settings such as schools because the same people can be tested every three to four days, eliminating the chances of having a false negative result.

The Texas Legislature meets in less than 100 days. Nobody knows how the session will look.

The Texas Capitol is a bustling place when the Legislature is in session — the elevators are crowded, the hallways are packed, the committee hearing rooms are overflowing and the chamber floors are covered with state lawmakers.

But with less than 100 days until the 87th regular session and the coronavirus pandemic still upending once-regular ways of life, it’s unclear what typical functions at the Capitol will look like in January, or whether they will even exist.

That uncertainty this close to the session could have ramifications for what members say will be one of the toughest legislative sessions in recent years: tackling billions of dollars in shortfalls to the state budget, undergoing the process of redrawing the state’s political maps, and navigating issues like health care and public education that have been a focus during the pandemic.

On top of that, the Capitol has been closed to most everyone for months, prompting questions about the access that the public will have to the legislative process.

Senate and House members spearheading logistical discussions say that while much remains up in the air, the two chambers are working together to implement session rules that are consistent for both chambers. With wildly different dynamics in the 31-person Senate and the 150-person House, though, some suggest that the two chambers may not end up on the same page.

“Our primary concern is safety, transparency and public access,” said state Rep. Donna Howard, an Austin Democrat who serves as vice chair of the House Administration Committee. “There’s so much up in the air.”

State Rep. Charlie Geren, R-Fort Worth, chair of the committee, said the House is “in conversation with the lieutenant governor’s office,” but noted that “until there’s a presumed speaker, we don’t have a lot of guidance” in the lower chamber.

To Geren’s point, there’s only so much the House can do to prepare for the next session when its speaker is retiring and control of the lower chamber could flip to Democrats in November. There aren’t any declared candidates yet in the race to replace Republican House Speaker Dennis Bonnen. However, if a member collected the votes needed to win before January, they could become the presumptive speaker and informally lay the groundwork on what protocols would be in place.

On the Senate side, rumors have lingered for weeks over what Lt. Gov. Dan Patrick has told senators to expect come January. On a recent call with Senate chairs, according to several people who had knowledge of the call but weren’t authorized to speak on the record, Patrick outlined a worst-case scenario that involved limiting the legislation allowed for consideration and banning the public, press and lobbyists from entering the chamber.

A senior adviser for Patrick declined to comment for this story. And state Sen. Bryan Hughes, a Mineola Republican who chairs the Senate Administration Committee, did not respond to requests for comment.

Some decisions have already been made. Plexiglass dividers have been installed in several House committee hearing rooms, Geren said. Such barriers, he said, won’t be installed on the 150 House floor desks in the chamber after a trial run with a couple of them because they would interfere with the light used by new mobile sanitizing machines, as The Dallas Morning News first reported. House and Senate offices have also offered free webcams to offices in preparation for conducting more business virtually.

The Legislature, though, still faces a list of seemingly never-ending questions: Should temperature checks or some other form of screening be required before people enter the building? How can the House spread out 150 desks on the chamber floor — and will press and essential staff still be allowed on it? How can the public testify on legislation in committee hearing rooms, particularly on measures that generate a lot of interest?

Buoying those questions are layers of uncertainty about whether the virus will spike this winter, whether a vaccine will be available — and accessible — and, heading into the November election, whether Democrats will have control over the House, which could mean a change in leadership style to counter the GOP-controlled Legislature.

In August, Geren sent members results from a House survey over how and when the Capitol should reopen. Not every member responded, but those who answered questions about requiring temperature checks upon entering the Capitol and requiring face masks while inside committee rooms and public meeting spaces overwhelmingly supported those measures.

Howard told the Tribune that members are considering different sorts of screening protocols for how the public enters the Capitol but that no decisions have been made on what that could look like.

Since mid-March, the Capitol has been closed to the public, preventing members from holding interim committee hearings inside the building with public testimony. Those hearings are usually scheduled to help members consider or research business that could come up during the next session.

On Monday, hearing notices were posted for Senate Higher Education and Education interim committee hearings, both of which are set to happen next week. Each notice states that access to the Capitol “is limited to legislators and staff only” — and that only invited testimony will be allowed. “Invited testimony will be conducted via video-conference,” the notices say.

As a sort of workaround in the House, the speaker’s office released a memo in July detailing three options for how to conduct committee business while also adhering to lower-chamber rules, which do not allow for virtual hearings. Some committees have carried out interim business following that guidance.

Still, Democrats and Republicans have called on Gov. Greg Abbott, who oversees the Capitol, to reopen the building in recent weeks, arguing that if in-person fundraisers and public schools can resume, so can interim committee hearings. Such requests have gone unanswered publicly, and a spokesperson for the governor did not respond to a request for comment for this article. A spokesperson for the State Preservation Board also declined to comment.

“It certainly looks like we’re not going to have anything open before session starts,” Howard said. “We’ve really had no opportunity to have interim hearings, which has been extremely frustrating.”

State Rep. Phil King, a Weatherford Republican who chairs the House Redistricting Committee, said that “right now, we’re just locked out” — and added that it’s his “strong preference” that the Capitol reopen as soon as possible.

“I think it’s time now,” he said.

In the meantime, some members are already mapping out what office-specific guidelines they may issue for the 87th session. While most members say they are waiting to finalize those plans until closer to January, a number of them have already laid out protocols.

State Rep. Jon Rosenthal’s office, for example, has established a set of guidelines that staff and the lawmaker “will adhere to independent of rules and procedures the House Administration Committee provides the members for the 87th Legislative session,” according to a memo from the Houston Democrat’s office and assuming he wins reelection.

Masks will be required to enter Rosenthal’s Capitol office, which will not allow more than six people inside at a time. Rosenthal and his staff, the memo says, will also be tested for the virus “a minimum of once per week.” And interns, should they be hired, will work from home unless “dramatic changes happen” to prevent the spread of the virus.

On the other hand, state Rep. Briscoe Cain, a Republican from Deer Park and a member of the hardline conservative House Freedom Caucus, said he and his staff “absolutely will not” mandate masks — and that his “office will be open to all just as it has been since I was first elected.”

“It won’t bother me if visitors want to wear [a mask], I’m not going to make them take them off,” Cain told the Tribune. “In 2017 or 2019, if someone wanted to wear a mask, I would not have cared.”

Another Republican, state Rep. Dade Phelan of Beaumont, said his office is considering limiting staff and the number of visitors allowed in the office at one time. He said his office is also thinking about trying to move meetings online, though no decisions have been made yet. Across the rotunda, state Sen. Borris Miles’ staff members said they have already installed a plexiglass shield at the front desk in the Houston Democrat’s office.

Meanwhile, a group of House Democrats including state Reps. Joe Moody of El Paso and John Turner of Dallas have spent the past several months working on a governance platform to add to the conversation about what the session should look like.

“Keep the ‘People’s House’ accessible to all who wish to safely participate,” read a line in a one-pager that was presented at the House Democratic Caucus’ recent virtual retreat. “Institute daily COVID checks for everyone entering the Texas Capitol,” reads another. Another one: “Propose penalties to discourage anyone from flouting pandemic rules.”

The pandemic has, of course, impacted other issues tied to the Legislature and its usual timeline. In addition to addressing the billions of dollars in shortfalls to the state budget and other core issues during session, state lawmakers are also set to undergo the once-in-a-decade process of redrawing the state’s political maps.

The pandemic has already halted several hearings that both the House and Senate redistricting committees had scheduled across the state during the interim. And, on top of that, King, chair of the House Redistricting Committee, said the census data that helps lawmakers draw political maps is not expected to arrive until at least June — which could put the Legislature on track to work beyond the 140-day regular session.

“I think we’re headed for a special session on redistricting regardless,” King told the Tribune.

Others agree. At a virtual event in July, the lieutenant governor said the Legislature could be in session until at least September, citing the budget and redistricting.

“I’ve told my staff and I’ve told senators,” Patrick said, “don’t plan any vacations until maybe after Sept. 30 of next year.”

With fuzzy guidance from the state, school districts grapple with remote learning and timelines for resuming in-person instruction

Plans for resuming in-person instruction remain in flux across the state as many districts near the end of their allowed four-week transition period to move from virtual to in-person learning.

The latest Texas Education Agency (TEA) update to its statewide “Attendance and Enrollment” guidance reflects that some school districts may feel a need to request more than eight weeks of flexibility on resuming in-person instruction. “Any additional transition window will require board approval after preliminary TEA plan feedback has been received,” notes the TEA document released September 24, adding the agency will expect any district seeking additional transition time to be steadily increasing the number of students on campus during that period. But, despite assurances that the agency will take health-related metrics such as hospitalization data into consideration when reviewing such requests, the state’s decision-making remains discretionary and impossible to predict—leaving school districts grappling with how to proceed. ATPE believes this isn’t fair to administrators, teachers, parents, and certainly not students.

Since early summer, ATPE has urged the governor, Commissioner of Education Mike Morath, and other state officials to use objective, health-related data as the basis for school reopening decisions that are made at the local level. While we are glad to see the state’s recognition of some data on COVID-19 infections as a valuable consideration, ATPE believes it is unfair to leave school districts guessing as to whether the state ultimately will grant them additional flexibility if they believe it is unsafe for students to return to campus.

As we have reported, Gov. Abbott announced last week an easing of restrictions on restaurants and certain other businesses, but the changes were not applicable to three areas of the state that remain “danger zones”: Victoria, Laredo, and the Rio Grande Valley. Gov. Abbott said further reopening decisions would be based upon COVID-19 hospitalization data in the area, noting that the hospitalization numbers remained too high in those three areas, which include 13 Texas counties.

Rio Grande Valley school district leaders have been pleading with the commissioner and elected officials for additional flexibility on resuming in-person instruction. Today’s updated guidance notes that when reviewing district requests for extension of the transition period, TEA will consider “whether school systems are located in whole or in part in areas” identified as hot spots under the criteria referenced by the governor.

ATPE issued a press statement today in response to the new information from TEA. ATPE Governmental Relations Director Jennifer Mitchell stated in the release, “ATPE is pleased that state officials are finally listening to our recommendations on the importance of basing reopening decisions on objective, health-related data. However, TEA’s promise merely to ‘take into consideration’ such data offers little comfort for schools being pressured to reopen their facilities before it may be safe to do so under local health recommendations.”

School district approaches to reopening vary widely. COVID-19 has not affected every community to the same degree, and differing political views about the pandemic have put pressure on school boards. Not surprisingly, many districts have revised their initial plans and may still be considering further changes. Several districts are announcing plans to terminate virtual instruction, while others are looking for ways to extend it. The shifting landscape and fluctuating directives from school district leaders have been frustrating for educators and parents alike, resulting in emotional debates on social media and in school board meetings. Also frustrating is the red tape surrounding the decision-making process: Districts seeking to stretch out their return timeline must first secure initial board approval, then submit a request to TEA for “preliminary feedback,” and then ask for another board vote.

A few examples from across the state:

  • Fort Worth ISD began its school year with four weeks of remote instruction set to expire October 5. Last week, the FWISD board voted 5-4 against a motion that would have extended the district’s remote learning plan an additional four weeks. But this week, the board held another meeting and voted 5-4 in favor of adding two more weeks to the transition period. The change came after educators and parents testified at the 10-hour meeting, with some circulating petitions and organizing rallies on both sides of the issue. ATPE submitted testimony urging FWISD to base its decision on local public health data, paying close attention to the recommendations of Tarrant County Public Health.
  • Hardin ISD posted a notice on its website this week stating, “Due to less than acceptable virtual participation and student results, please be advised that Hardin ISD will cease virtual learning on Friday, October 2, 2020.”
  • Louise ISD sent a letter to parents September 22 stating, “The effort required of our teachers and administrators will no longer be divided by the requirements of offering remote learning beginning Tuesday, September 29, 2020 … I am not mandating that your family chooses to return to school. Yet, I am suggesting that you make a decision that continues to provide the appropriate needs of your children.” Superintendent Garth Oliver lists “suitable” options for parents to consider: returning to school in-person, transferring to a district that offers remote learning, or withdrawing from the public school system to either home-school or enroll in private school.
  • Brownsville ISD’s superintendent has urged stakeholders to lobby TEA for more flexibility. The Brownsville Herald reported September 19 that Superintendent Rene Gutierrez asked the state to allow BISD “to continue at 100% distance learning so that we can ensure everyone’s safety,” but the district plans to begin hosting students on campus September 28 because of state limitations on the timeline for operating remotely.

Commissioner Morath clarified on a call with superintendents today that no school district is required to offer remote instruction, but any parent who wants their child to continue attending school virtually must be allowed to transfer to a school district that offers it.

Meanwhile, the number of confirmed COVID-19 cases among on-campus students and staff is being reported by each school district and shared via an online dashboard. There is a lag in the reporting time, however, and the numbers reflect only test-confirmed cases of COVID-19 among individuals who have been on the campus. TEA posted this updated FAQ document about the COVID-19 data reporting today.

Senate task force includes ATPE recommendations in letter to education commissioner

The Texas Senate Democratic Caucus issued a letter signed by all 12 caucus members to Texas Education Commissioner Mike Morath last week with recommendations to assist Texas schools as the fall semester begins amid the ongoing COVID-19 pandemic.

The recommendations came from a task force comprised of education organizations and stakeholders that included ATPE. Several of ATPE’s suggestions, such as including “meaningful input from parents, staff and other stakeholders” and using “objective criteria” in making back-to-school operational decisions, as well as, “seek[ing] the appropriate federal waivers to pause the State of Texas Assessments of Academic Readiness (STAAR),” were included in the senators’ final letter to Commissioner Morath.

The senators also called on the commissioner to provide districts with adequate and reliable funding, plus sufficient flexibility to enable them to meet students’ needs while also protecting health and safety. The full text of the recommendations approved by the task force can be found here. The senators also included a document with detailed rationales for each of the recommendations.

From The Texas Tribune: Many Texas students will return to classrooms Tuesday. Little will be normal.

As students across Texas return to schools for in-person classes, there will be masks, distancing and lunches eaten at desks. Many students will remain at home, joining in on laptops and phones.

On a normal first day of school, Texas children would wake up early to cram into school buses, eager to huddle and chat with their friends in the hallways before streaming toward their classrooms.

On Tuesday, as many of the state’s biggest urban and suburban districts return for their first day of in-person instruction, there is anxiety mingled with that excitement. Many parents will not be allowed to walk their kindergarteners inside for their first day. Teenagers will be shooed away if they congregate around their lockers. Meals will be grab-and-go, often eaten in classrooms instead of raucous cafeterias. Students and teachers will wear masks, trying to stay as far apart from one another as possible even as they come together for the first time in months.

Many kids will not be entering their schools at all. Some of the state’s biggest districts, including Houston and Dallas independent school districts, will not open their classrooms for in-person learning until late September or October, and they may even ask the state for more time if the virus isn’t under control.

In-person instruction will look very different from campus to campus. Some districts will bring students back in phases, starting with those who most need in-person education, like students with disabilities or those learning English. In San Antonio’s North East ISD, no more than five students will be in each classroom this week. Other districts are welcoming back all students who opted for in-person instruction at the same time.

Only about half of Seguin ISD’s students are expected to head into classrooms Tuesday morning for the first day of in-person instruction. They will walk past thermal scanners, which can measure the body temperature of about 30 people at a time and detect fevers that may be signs of illness. Middle and high school students will sit in desks spread apart, in many cases less than 6 feet with dividers, and younger students will be separated by dividers at large round tables.

Most teachers will be simultaneously instructing 12 to 16 students in their classrooms and more at home tuning in from cellphones or laptops. Some teachers will sit in empty classrooms and broadcast lessons to 20 or 30 students. A small number who have health conditions or young children received waivers to teach virtually from their homes.

“Things are ever changing. The one thing I’ve appreciated that stayed constant was the interest in students returning has been at 50%,” Superintendent Matthew Gutierrez said of his 7,200-student district east of San Antonio. “I believe that we can safely social distance at that number in our buildings.”

Parent interest in in-person instruction varies greatly across the state. In some hard-hit parts of the state, like Mercedes ISD in South Texas, the vast majority of parents are opting for virtual learning. In Texarkana’s Bowie County, where coronavirus cases have stayed relatively low, most Maud ISD parents have already sent their kids to school in person.

Local health authorities continue to clash with school districts over whether it’s safe to open, concerned that Labor Day festivities could lead to higher case numbers, as Memorial Day did this spring. Fort Bend County health officials sent Katy ISD a letter in late July urging it not to open classrooms or start extracurricular activities “before late September in the vast majority of cases,” until the “effect of the Labor Day holiday can be determined.”

Katy ISD, which has schools in Fort Bend, Harris and Waller counties, plans to reopen classrooms Tuesday.

When schools were forced by the pandemic to hurriedly switch to virtual learning in the spring, most Texas districts didn’t require teachers to conduct live virtual lessons, but more are attempting that type of instruction this year. That means many teachers will have to simultaneously instruct two groups of students: those in front of them, and those watching from their iPads and laptops.

In Seguin ISD, most of the lessons will also be recorded for students who couldn’t find time to log in and watch live, important in a district with 71% low-income students, Gutierrez said. “You have parents that have multiple jobs. They’re shift workers. To expect that our students are going to go through their entire day at home alongside the face-to-face learners is really unreasonable when they don’t have that support, that structure or that supervision at home. They would be missing out on instruction.”

He acknowledged that those students will be missing out on the benefits of live instruction: having a teacher correct their pronunciation of a challenging word or being able to ask questions about a complex math problem in real time.

Austin ISD starts virtually Tuesday and plans to open classrooms in early October. Eight-year-old Isla Arb will start third grade at Graham Elementary School online Tuesday and will continue virtually to avoid endangering her grandmother, who has cancer, said her mother, Katie Arb. Both Katie Arb and her husband work full time, so they hired another mother to watch Isla and her 4-year-old sibling on weekdays. They’re paying her about $15 per hour, as well as paid sick leave and vacation, replacing some of the pay she had received as a dental hygienist before the pandemic.

“The bulk of her responsibilities are going to be to keep the 4-year-old away from our 8-year-old,” Katie Arb said.

Isla is excited about getting to wear a unicorn onesie to virtual school every day at the messy desk in her bedroom. But she got quiet when she thought about her classmates and teachers returning to campus in October. “I don’t want them to get coronavirus,” she said sadly.

Even students who return to Austin ISD’s campuses will effectively be learning virtually. When she goes back to school in early October, Austin ISD high school theater teacher Rachel Seney will sit in a classroom, with a mask on, leading a virtual class through musical numbers or dramatic exercises. Students spread 6 feet apart will sit in front of her on their laptops, each one completing assignments or watching a different teacher deliver instruction.

Students will spend nearly the entire day, including lunch, in one classroom, a plan intended to reduce the public health risks during a pandemic. If one child or staff member gets infected, it will be easy to trace exactly who they were in contact with — meaning there’s no need to shut down entire campuses or districts.

Seney, who teaches at predominantly white and high-income Anderson High School, said she sees the model as more equitable since all students end up learning virtually in some way. “You’re not teaching equitably if you have some students in front of you and some students online. Now that some schools have started going back and are using that model, I’m already seeing it’s not happening,” she said. “It’s not really effective.”

Her sister Blair Seney will be doing just that at Cypress Falls High School in Cypress-Fairbanks ISD, miles away in Harris County’s suburbs. A special education educator, she helps modify assignments or provide extra time on testing for students with disabilities alongside a primary classroom teacher.

“We’re expected to teach at the same time the kids that are in the classroom who don’t have access to technology and the students at home who are on the computer,” Blair Seney said. She has been a constant agitator for more safety requirements in schools and more flexibility for teachers terrified to return in person. In August, she stood in the back of a school board meeting with a sign that said, “Your attendance is required at my funeral,” while her mother, also a teacher at the school, spoke at the public hearing. That month, Cypress-Fairbanks ISD teachers unsuccessfully sued the district, asking not to be required to report to their campuses for training.

About 42% of students have decided to attend school in person, according to a district survey. Often, Blair Seney pulls students into her office, a tiny storage closet with no ventilation, for one-on-one assistance. “I’m not sure how that’s going to work,” she said. “It is definitely a thought that’s keeping me up at night, trying to figure out how we’re going to make all this work.”

Health precautions vary among districts and schools. Under Gov. Greg Abbott’s order, everyone over the age of 10 must wear a mask. But guidance from the Texas Education Agency leaves districts largely on their own to design protections against a virus that spreads undetected in as many as 40% of those who have it. In many districts, maintaining 6 feet of distance among students will simply not be possible.

“It’s very scattershot,” said Monty Exter, a lobbyist for the Association of Texas Professional Educators. “There’s a huge variation in the policies that are being put in place within districts to protect the health and safety of educators, from physical structures to logistics to access to [personal protective equipment]. Absolutely there have been districts that say, ‘Here’s your two gloves and your mask, that’s all you’re getting.’”

In Houston-area Humble ISD, where kids have been back in classrooms since late August, “it has been surprisingly normal,” said Timbers Elementary School fifth grade teacher Stacey Ward. “Question mark?”

The 10- and 11-year-olds who tramp in for Ward’s science and social studies classes have been surprisingly compliant about wearing their masks, though she sometimes has to remind them, with a single word — “mask!” or “nose” — to ensure the fabric covers their noses, too. Every other student sits behind a plexiglass barrier, spaced out as far apart as possible, but with 18 to 20 students per class, it has not been possible to keep 6 feet among them.

Instruction stops five minutes early so kids can wipe down their desks. Ward collects their books at the end of the day. There is no sharing of supplies.

And Ward has made one more adjustment. Typically, when students enter or exit her classroom, they get three options: high-five, hug or handshake.

This year, she’s pivoted: “Now, it’s an elbow, a knee or a foot,” she said in a phone interview after her fourth day of in-person school. Elbow bumps are the runaway favorite.

Afterward, the students know to take a squirt of hand sanitizer. “It’s normal to them now,” she said.

Food for thought: School nutrition and COVID-19

When the COVID-19 pandemic struck Texas in March, one of our first concerns was how students who normally relied on the school for meals would continue to have access to nutritious food. Public school districts went above and beyond to ensure students continued receiving meals, parking at motels for meal distribution, initiating drive-thrus, and packing different foods that worked better for grab-and-go. These efforts contributed to higher costs for public school nutrition services this spring, which put a financial strain on districts’ ability to continue providing meal service to those who need it the most.

But it isn’t just the higher costs associated with out-of-school meal service that is a concern; it is also the lower numbers of students accessing meals that is straining districts. According to recent reporting by Politico, the National School Lunch Program served 28 percent fewer meals in March 2020 compared to March 2019. North East ISD estimated a $2.6 million shortfall this spring due to increased costs from serving more expensive foods for grab-and-go consumption and decreased revenue from fewer meals served. While census data is used for meal service planning purposes, districts are actually reimbursed for nutrition services based on the number of meals served and whether students qualify for free or reduced-price meals. Students who purchase meals at school, or even a la carte food items, help provide extra revenue to districts that enable them to break even in their food operations.

Federal waivers provided in the spring allowed school districts to serve meals at any campus, without students present, and at no cost to all students, regardless of their eligibility for free and reduced-price meals.This flexibility has not been extended by the U.S. Department of Agriculture, which could inhibit districts’ ability to receive enough reimbursement to maintain operations without needing financial support from other district funds (which are also tight at the moment). Furthermore, the expectation for families to fill out and districts to process free or reduced-price meal eligibility paperwork could create an unnecessary burden for families and schools. It is expected that millions of children have become eligible for free and reduced-price meals due to the economic effects of the pandemic. Pending legislation in Congress could address meal service flexibility in schools, as well as general funding, but negotiations are currently stalled due to debates over unemployment benefits.

Schools are part of larger district systems, which are part of state systems and federal systems. These systems work together to ensure that students’ basic needs are met, such as having a nutritious meal to eat, which allows for learning to occur. When school nutrition services are strained, these basic needs can also become strained. Other benefits such as the Pandemic Electronic Benefit Transfer (P-EBT) have provided essential funds to families, but P-EBT does not guarantee the “square meal” nutrition of the school nutrition programs. In order for schools to continue acting in creative and courageous ways to get meals to students, more will have to be done to ensure financial stability for these programs.

Teach the Vote’s Week in Review: July 24, 2020

With the start of school just around the corner, it’s been another busy week for ATPE and the education community. Read about this week’s developments below from the ATPE Governmental Relations team:


CORONAVIRUS UPDATE: ATPE’s incoming State Vice President Karen Hames and Governmental Relations Director Jennifer Mitchell spoke on CNN’s Chris Cuomo Prime Time show Thursday night, July 23, to contribute their perspectives on school reopening. Hames and Mitchell stressed that teachers care about their kids and want to be in school with them, but that educators have concerns about being exposed to the coronavirus in a classroom setting. Hames shared reasons why school choice would not provide any real solutions to parents’ concerns about COVID-19, and Mitchell emphasized the need for additional federal funding and better guidance at the state level to help school districts prepare for reopening amid the pandemic. In other news related to COVID-19, the University Interscholastic League (UIL) released a long-awaited announcement this week that delays the schedules of 5A-6A conferences. Additionally, UIL shares that marching band practice in all conferences may not begin until September 7, 2020. Updates to TEA’s COVID-19 Support and Guidance Page this week included a new summary of the agency’s reopening guidance, several new “Strong Start” resources, and new CARES Act and attendance and enrollment information.

This week, ATPE submitted formal public comments on the U.S. Department of Education’s (ED) interim final rule directing how districts spend their CARES Act federal emergency dollars on equitable services for students in private schools. The interim final rule, effective July 1, 2020, is estimated to cause public school districts to spend over $44 million of their Title I-derived emergency funds on private school students regardless of poverty — more than $38 million more than they would normally spend under the longstanding interpretation of equitable services in federal law. ATPE’s comments urge the department to rescind its inequitable and distorted interpretation of the CARES Act, which goes against congressional intent. Over 5,200 comments have been submitted, but the department is not required to respond to them because of the emergency rulemaking process. ELECTION UPDATE: Last week saw one of the most unusual elections in recent memory: A runoff postponed due to a global pandemic that proceeded to intensify in Texas as the new election date approached. Early voting was expanded from the usual one week to two weeks in order to reduce the load on polling locations. Some voters also took advantage of alternative methods of casting their ballots to avoid contracting COVID-19 at the polls, although Texas broke ranks with other parts of the country by refusing to expand the ability to vote by mail amid the pandemic. Despite the failure of lawsuits aimed at expanding mail-in ballot options, Texas saw a substantial increase in mail-in voting during this runoff election, which caused official results to be delayed by a few days but did not result in changes to any of the unofficial race outcomes revealed on election night. The July 14 election also exposed troubling voting issues that will have to be corrected before the November election.

With double the time to vote early, this month’s runoffs saw double the turnout over the primary runoff elections in 2018, 6.61% to 3.22%, respectively. After all of the debate over voting by mail, 30% of Democrats and 24% of Republicans who voted early cast their ballots by mail. That’s actually down from 36% of all early voters who cast mail-in ballots in the 2018 runoffs. Democrats had a huge turnout — nearly 956,000 voted in the primary runoffs, but comparable statewide numbers aren’t available for Republican turnout because there wasn’t a statewide GOP runoff like there was on the Democrats’ ballot. Party turnout in primary elections is not always an accurate predictor of turnout in the general election. But based on the turnout for a runoff election in July, in the Texas heat, in the middle of a deadly pandemic, it’s probably safe to assume that overall turnout for the November general election will be enormous. That makes researching candidates and making your voting plan for November more important than ever! See more election results in last week’s recap by ATPE Lobbyist Mark Wiggins.


CONGRESSIONAL UPDATE: The U.S. House Education and Labor Subcommittee on Early Childhood, Elementary and Secondary Education met Thursday, July 23, for a hearing on the safe reopening of schools. The discussion bounced back and forth between the health risks for children and health risks for teachers and staff, with implications across the board for future funding to get schools on the path to a safe reopening. While a proposal for additional federal emergency aid (dubbed the Health and Economic Recovery Omnibus Emergency Solutions or “HEROES” Act) was approved by the U.S. House several weeks ago, the U.S. Senate has now agreed on its own $105 billion aid package for education, which includes $70 billion for K-12 schools. The proposal would tie the K-12 funding to in-person instruction by sending $35 billion to schools that open for in-person instruction and splitting the remaining $35 billion among all schools, regardless of their method of instruction. The $30 billion for colleges will not be tied to in-person instruction, and governors will receive the last $5 billion to spend on either K-12 or higher education. The details of the proposal are expected to be made public on Monday.



After a week-long delay, the U.S. Centers for Disease Control (CDC) released updated guidance for the reopening of public schools during the COVID-19 pandemic. The brunt of the new guidance issued last night, July 23, consists of justifying the push to reopen schools for in-person instruction. New items include recommending that schools group students and teachers into isolated cohorts or “pods” meant to limit in-person contact. There is also a checklist intended to assist parents in deciding  whether to send their children to school. A new mask guidance document suggests masks can be worn by anyone older than two years old, though some groups of students may need special adaptations and alternatives. Even as the guidance encourages reopening, it urges caution to those considering to do so in areas of substantial, uncontrolled transmission. Furthermore, the guidance recommends tying operational decisions to local epidemiological conditions. The guidance states as follows:

“Schools should be prepared for COVID-19 cases and exposure to occur in their facilities. Collaborating with local health officials will continue to be important once students are back to school, as they can provide regular updates about the status of COVID-19 in the community and help support and maintain the health and wellbeing of students, teachers, and staff.”

The State Board for Educator Certification (SBEC) met today, July 24, to take action on several items implementing the Science of Teaching Reading exam requirements from last year’s House Bill (HB) 3 and to discuss COVID-19 considerations related to certification. Additionally, the board approved a proposal to transition Legacy Master Teacher certificate holders into lifetime certificates, as HB 3 barred the Master Teacher certificate from being issued or renewed. ATPE Lobbyist Andrea Chevalier testified before SBEC in support of this proposal, continuing our months-long advocacy for a fix for Master Teachers. SCHOOL FINANCE UPDATE: Texas Comptroller Glenn Hegar created buzz this week with the release of his certification revenue estimate, which shows that the state faces a $4.6 billion deficit due to both COVID-19 and the largest drop in oil prices in decades. While some revenue sources have helped to soften the blow, including federal coronavirus aid and new revenue from online commerce, the uncertainties ahead will make the state budget lawmakers’ top concern in the upcoming 2021 legislative session. In other school finance news, Just Fund It, a non-partisan group of parents, students, and community members across Texas advocating for increased public school funding, has begun a petition aimed at urging Gov. Abbott to ensure stable and predictable school funding. Specifically, the petition asks the governor to extend the 12-week “hold harmless” period for calculating funding based on attendance as recently announced by the Texas Education Agency (TEA) for the coming school year. The group presents a compelling argument for extending the hold harmless to cover the entire 2020-21 school year.

ATPE House of Delegates adopts resolutions on COVID-19 educational considerations

This week, over 2,000 educators convened for the 2020 ATPE Summit, held virtually for the first time. The ATPE House of Delegates (HOD) met Thursday, July 9, for the association’s annual business meeting. Delegates from every region of Texas convened to elect state officers and adopt policies and official legislative positions of the association on behalf of its 100,000 members.

The HOD adopted two new resolutions pertaining to education and safety concerns of school employees as a result of the COVID-19 pandemic:

RESOLUTION #1:

RESOLVED, that ATPE urge the state to safeguard the health and safety of students and educators by delaying in-person instruction until Texas has demonstrated a flattened curve in the number of COVID-19 cases; and

RESOLVED, that ATPE urge the state to require local school districts to include educators and parents in the development of plans for the safe re-entry of students and district employees; and

RESOLVED, that ATPE urge the State of Texas and our U.S. federal government to allocate emergency funds for substitutes in case of mandatory quarantine requirements for district personnel.

During debate on the resolution, ATPE members cited the fears expressed by teachers who have compromised immune systems or pre-existing conditions, especially in light of a recent, rapid increase in the number of cases. Delegates also spoke about the difficulty of containing viral spread, especially if teachers are placed in classrooms with students who may not be required to wear masks, and expressed doubt about the ability to carry out contact tracing in schools. With some teachers feeling that they are being asked to make unreasonable sacrifices in order to hasten a reopening of schools that is motivated by economic factors or political pressure, ATPE members are recommending a delay in returning to campuses in order to keep everyone safe. Only one delegate spoke against the resolution noting that ATPE has already been urging the state to take steps to safeguard the health and safety of educators and students.

RESOLUTION #2:

RESOLVED, that ATPE urge the State of Texas and the U.S. Department of Education to waive requirements to administer the 2020-21 STAAR and TELPAS due to the disruption of in-person instruction caused by the COVID-19 pandemic.

The author of this resolution on standardized testing argued that students have lost critical learning time as a result of the pandemic and that teachers’ time should be devoted to fostering student learning rather than test preparation. Speakers observed educational quality varied widely as COVID-19 forced a sudden shutdown of schools. Texas Gov. Greg Abbott and the U.S. Department of Education both waived requirements to administer STAAR exams this spring. The ATPE resolution was amended yesterday to include the Texas English Language Proficiency Assessment System (TELPAS) as well as the State of Texas Assessment of Academic Readiness (STAAR), based on discussion about the importance of both tests and a plea to prevent English language learners who are struggling in an online learning environment from being subjected to unfair testing through the TELPAS.

ATPE expects more from state efforts to protect educators

Earlier this week, the Texas Education Agency released final public health guidelines for the return to in-person schooling in the fall. The guidelines were similar to the agency’s previously released “draft” public health guidance, with a few exceptions. ATPE’s statement on the guidance (see below) reflects our overall disappointment in the lack of clarity and specificity provided to educators who are concerned for their health and safety when returning to school.

TEA’s guidance prioritizes getting kids back in an in-person school setting without equal care for the educators who will stand alongside them in the classroom. Most educators would probably agree that students are experiencing setbacks due to the pandemic and that for some children, being away from the school environment means a lack of safety and stability amid a reported rise in child abuse. These are some of the reasons that would favor returning students to their campuses as soon as feasible, but it is equally important that educators and other school employees are able to work in a healthy and safe environment; otherwise the quality and effectiveness of teaching and learning may suffer.

The TEA guidance document follows the same framework as what was in the agency’s initial health and safety guidelines draft and recommends designating an individual or group responsible for dealing with COVID-19 issues. ATPE’s Recommended Health and Safety Guidelines pressed the state to require districts to develop a more robust planning committee and COVID-19 policy approval process that includes educator and community input. Instead, the agency has opted to require districts to create a plan that is only posted for parent and public review one week in advance of the the school year and is not subject to school board approval, leaving it mostly to the discretion of superintendents.

One of the main differences in the new guidance document is that districts are granted flexibility in the form of a three-week back-to-school transition. During this time period, districts can require some students to engage in virtual or distance learning, if they have the internet and devices. Another big change in the new guidance versus the draft document is that, consistent with the governor’s recent mask order, schools must comply with face covering requirements. Gov. Greg Abbott’s recent executive order includes exceptions, such as for those under age 10, those who have disabilities that prevent them from wearing masks, and other circumstances.

TEA has strengthened some of the language in the document to require districts to practice certain health and safety protocols, while continuing merely to suggest other practices. For example, educators and staff must self-screen, visitors must be screened, and parents must ensure that they are not sending their child to school with COVID-19 symptoms. Additionally, the new guidance says school systems must provide daily on-campus instruction for students who follow TEA’s public health guidance and whose parents want them to attend school in person.

Similar to the previous guidance, schools are encouraged to provide hand sanitizer, watch students wash their hands twice a day, and consider separating desks by six feet where possible, among many other health and hygiene suggestions. The guidance also suggests that schools reduce large assemblies and in-person staff meetings where possible.

Overall, the TEA guidance falls far short of what educators expect in terms of assurances that they will be safe when returning to work with students. ATPE will continue to work with education stakeholders and state leaders to gain better specificity for educators, as outlined in our recommendations, and to press for educators’ voices to be included in the decision-making process at all levels. Educators, and especially those who are cautious to return to school due to their age, pregnancy or nursing, health conditions, or the presence of vulnerable individuals in their household, deserve peace of mind and a seat at the table as we approach the fall.

ATPE Statement on TEA’s Final Public Health Guidance
State’s largest educator association frustrated by TEA plan: “Too many questions are left unanswered by TEA’s guidelines.”

ATPE has reviewed the Texas Education Agency’s “SY 20-21 Public Health Planning Guidance” document posted on the agency’s website this afternoon.

Part of TEA’s “Strong Start” plan, the nine-page document lists minimal requirements and recommendations for school districts to consider as they prepare to start the new school year. While the final guidance contains a few more requirements than a draft leaked in mid-June, the responsibility for ensuring student and educator safety has been placed squarely on school administrators. Included in the new document are references to Gov. Greg Abbott’s recent executive order calling for masks to be worn in public, which will also apply to schools for as long as the statewide order remains in effect.

ATPE is frustrated that TEA has not heeded our call to provide more explicit guidance, nor is TEA requiring the involvement of educators and parents in developing COVID-19 protocols.

On July 2, ATPE released its own set of recommendations for state policies and district-level guidelines related to COVID-19. We urge school district leaders to follow ATPE’s recommendations as they work to fill in the gaps. Our recommendations would require each district to develop a COVID-19 advisory committee including non-administrative-level staff, parents, and community medical experts.

“Too many questions are left unanswered in TEA’s guidelines,” said Shannon Holmes, ATPE Executive Director. “We urge school district leaders to step in and fill this leadership vacuum to keep Texas children and educators safe, particularly as pockets of our state face rising COVID-19 outbreaks. All Texas students, parents, and educators deserve to be safe and have a firm understanding of the steps being taken to provide a safe learning environment.”

Teach the Vote’s Week in Review: July 3, 2020

This week, we celebrated the anniversary of the 26th Amendment to the United States Constitution, which was ratified July 1, 1971. Since the 26th Amendment lowered the voting age from 21 to 18, now is the perfect time to celebrate with all the young people in your life as you make plans to early vote in the primary runoffs. Here is our wrap-up of this week’s education news from the ATPE Governmental Relations team. We wish you a safe and relaxing Independence Day weekend!


CORONAVIRUS UPDATE: On Thursday, Gov. Greg Abbott made headlines with an executive order requiring that Texans wear masks in public spaces in counties with 20 or more positive COVID-19 cases. There are a few exceptions to the mask order, including for children under 10 years old, those with a medical condition that prevents wearing a mask, and in some specified circumstances such as driving. Violating the order is punishable by fine, but jail time for violations is prohibited. See the full executive order with a list of exceptions and exempted counties here. Abbott also reduced the limits of most allowed gatherings from 100 to 10 people. Both changes take effect at 12:01 p.m. Friday, July 3, 2020.

According to an article by the Texas Tribune republished here on our blog, Gov. Abbott gave an interview on Thursday afternoon in which he speculated about restarting schools this fall. ““If COVID is so serious, it may mean that students are having to learn from home through a distance learning program,” the governor is reported as saying, despite giving earlier assurances that it would be safe for schools to reopen soon. Meanwhile, we continue to wait for the Texas Education Agency (TEA) to provide school districts with health and safety guidance needed to begin the new school year. The agency posted a public health document last week only briefly before quickly pulling it down and calling it a working draft.

ATPE has shared its own Recommended Health and Safety Guidelines to the state and districts, urging them to address the safety concerns of school staff, students, and parents well ahead of a return to in-person classes, especially with the current spike in Texas coronavirus cases. Our recommendations urge TEA to release COVID-19 reopening guidelines and require that prior to the start of the 2020-21 school year, each school district disseminate a local policy describing health and safety measures it will take to mitigate and respond to the threat of COVID-19. ATPE believes TEA should require districts to involve non-administrative, campus-level staff and parents as they develop such policies. Districts should promptly notify employees and parents of their policy, and they must also be ready to adjust their policy should pandemic conditions change. We also provided a list of other considerations for districts to consider as they develop their policy, which include accommodating varying levels of risk factors among their student and staff populations, minimizing person-to-person contact, planning for special populations, adjusting staff  leave policies as necessary, and addressing child care needs of their staff, especially since many districts are now contemplating staggered student schedules or mandatory remote instructional days.

ELECTION UPDATE: Early voting for the primary runoffs and the Texas Senate District 14 special election started this Monday. Polls are closed today for the holiday, but early voting will continue through July 10. Election day is July 14, but we highly recommend you early vote in order to avoid crowds and lines. FEDERAL UPDATE: On Wednesday, July 1, the U.S. Department of Education officially published a final interim rule that states how public school districts must spend their CARES Act federal emergency funds for equitable services offered to private schools. The rule became effective immediately upon being published, but it is open for public comment through July 31, 2020. TEA held an update training session on Thursday in light of the changes; expect to find the training recording on TEA’s Grant Compliance and Administration YouTube playlist here. The new rule gives districts two options – spend CARES Act funds only on Title I schools and follow the longstanding interpretation of equitable services under federal law, or spend CARES Act funds on all schools and be held to the questionable interpretation of the equitable services law advanced by U.S. Department of Education Secretary Betsy DeVos. DeVos also announced final rules that impact the Teacher Education Assistance for College and Higher Education (TEACH) Grant program, which provides up to $4,000 a year to college students who are taking certain courses in preparation to teach, so long as they continually certify that they meet certain requirements when they become teachers, such as teaching in a low-income school. If recipients do not continue to meet the requirements, the grant is converted to a loan. As reported by the Government Accountability Office (GAO) in 2015, many TEACH Grant recipients had their grants converted to loans due to confusion over the requirements. The new rules change the department’s practices to expand how recipients can fulfill their service obligation, simplify the employment certification requirements, and allow recipients whose grants have been converted to loans to request a reconversion, among other provisions. This week, ATPE Senior Lobbyist Monty Exter set the record straight on erroneous claims that teachers can temporarily retire due to the pandemic. The “temporary retirement” myth was mentioned in a news story following a conference call national teacher union affiliates held with Texas reporters last week. The Teacher Retirement System (TRS) has made it clear that there is no such option for “temporary” retirement, explaining that any teacher who retires and then returns to employment will be held to a fixed annuity amount as of their retirement date. There are a number of restrictions on early retirement that educators should consider. Read retirement facts in this blog post by Exter.


New data show student engagement declined when the pandemic forced schools to close this spring. The Texas Education Agency (TEA) released crisis code reporting data this week, which includes crisis code reporting on student “engagement” and indicates that more than 600,000 students (about 11% of the student population) had inconsistent or no contact with their teachers or administrators. ATPE’s 2020 Membership Survey provided even more concerning data related to engagement, as just over 65% of our survey respondents reported that their students were less engaged during virtual learning. Moving forward, TEA and school districts will need to prioritize data collection and planning that works towards eliminating barriers students faced when attempting remote learning this spring, which goes far beyond access to Internet and devices. The State Board of Education (SBOE) met this week to address several agenda items, including revision of physical education and health TEKS, which garnered over 12 hours of virtual testimony on Monday. Votes on proposed revisions to the curriculum standards will not occur until a future meeting of the board.

On Tuesday morning, Commissioner of Education Mike Morath appeared before the board during its virtual meeting and fielded questions from SBOE members on topics such as testing and how teachers would be protected against COVID-19 risks when schools reopen. The commissioner said no decision has been made yet as to whether Texas will seek a federal waiver of testing and accountability requirements like it did during the spring when schools were forced to close. The SBOE committees’ work on Wednesday was largely uneventful, although the Committee on Instruction did amend an agenda item to keep computer science as a required high school course. On Thursday, the full board had a lengthy discussion about increasing the capacity of the charter school bond guarantee program by 20%. Upon a motion by Member Ruben Cortez (D-Brownsville), the board voted 5-9 in favor of maintaining the increase. The board moved forward with ease on their other agenda items.


An accurate count for Texas in the 2020 U.S. Census is essential for adequate funding of public schools and other services that will be sorely needed in the aftermath of the coronavirus pandemic. The Census Bureau has launched a self-response rates map, showing Texas currently ranks 40th and is tied with Arkansas. Rankings by county and city are also available, creating the perfect opportunity for some friendly competition!
