Teach the Vote’s Week in Review: Jan. 25, 2019

Here’s your weekly wrap-up of education news from ATPE Governmental Relations:


On Wednesday, Texas House Speaker Dennis Bonnen released his chamber’s committee assignments for the 86th legislature. Speaker Bonnen assigned chairmanships to Republicans and Democrats alike with each party having a number of chairmanships roughly proportionate to its representation in the House, which is contrast to the Senate where Lt. Gov. Dan Patrick appointed only a single Democrat to chair a committee. Rep. Dan Huberty (R-Kingwood) will continue to chair the House Committee on Public Education with Rep. Diego Bernal (D-San Antonio) again serving as Vice-Chair. A full list of House committee assignments can be found here. Meanwhile, there remain three vacancies in the House pending upcoming special elections. Voters in House Districts 79 and 145 will elect a new state representative (unless there is a need for a runoff) during a special election on Tuesday, Jan. 29. ATPE encourages educators in El Paso and Houston to visit the Candidates page on Teach the Vote to view the candidates who are vying for election in those two districts. A special election will take place to fill the third vacancy in San Antonio’s House District 125 on Feb. 12, 2019.

 


Earlier this week the Texas Education Agency (TEA) announced the recipients of Cycle 2 of the agency’s Grow Your Own grant period. An initiative created as a result of Commissioner of Education Mike Morath’s 2016 Texas Rural Schools Task Force, the Grow Your Own grant program was designed to help school districts inspire high school students to pursue careers as classroom teachers, certified paraprofessionals, or teacher aides.

Research shows that 60 percent of educators in the United States teach within 20 miles of where they went to high school,” said Commissioner Morath. “Because we know our future teachers are currently in our high schools, the goal of Grow Your Own is to help increase the quality and diversity of our teaching force and to better support our paraprofessionals, teacher’s aides and educators, especially in small and rural districts.”

Thirty-six school districts and educator preparation programs were selected for Cycle 2 of the program: Bob Hope School (Port Arthur), Bridge City ISD, Brooks County ISD, Castleberry ISD, Del Valle ISD, Elgin ISD, Fort Bend ISD, Fort Hancock ISD, Grand Prairie ISD, Hillsboro ISD, La Vega ISD, Lancaster ISD, Laredo ISD, Longview ISD, Marble Falls ISD, Mineola ISD, Muleshoe ISD, New Caney ISD, Palestine ISD, Presidio ISD, Region 20 Education Service Center, Relay Graduate School of Education, Rosebud-Lott ISD, Sabinal ISD, Somerset ISD, Stephen F. Two congressmen from Texas will be serving on the U.S. House Education and Labor Committee for the 116th Congress.

Both Rep. Joaquin Castro (D-TX 20) and Rep. Van Taylor (R-TX 03) will be serving on the committee, which has gone several years without a Texas member among its ranks. In press releases published earlier this week, both Castro and Taylor spoke of their commitment to finding bipartisan solutions to challenges faced by America’s education system and workforce. ATPE congratulates Congressmen Castro and Taylor on their appointments and looks forward to working with them in Washington on federal education issues.

 


With the legislative session underway and committees in place, we’re beginning to see a busy calendar of upcoming hearings, which ATPE’s lobby team will be participating in and reporting on throughout the session for Teach the Vote. State agencies and boards also have upcoming meetings of interest to education stakeholders, and we’re your go-to source for updates on any developments.

Next week, the State Board of Education (SBOE) will hold its first meeting of the new year starting Monday in Austin, where new members will be officially sworn in. Matt Robinson (R-Friendswood), Pam Little (R-Fairview), and Aicha Davis (D-Dallas) are joining the board following the 2018 election cycle. The board will also elect a vice-chair and secretary and announce the chairs of its three standing committees: School Initiatives, Instruction, and School Finance/Permanent School Fund.

SBOE members will host a learning roundtable Wednesday at the Austin Convention Center that will focus on the Long-Range Plan for Public Education, which the board released at the end of 2018.

Also on Wednesday, the House Public Education Committee will hold its first meeting of the 86th legislative session. The committee, under the chairmanship of Rep. Dan Huberty (R-Kingwood), is expected to consider major bills related to school finance and teacher pay this session. Wednesday’s meeting will feature invited testimony from Texas Education Agency (TEA) Commissioner Mike Morath.

 


The Senate Finance Committee began its work on the state budget this week with its chairwoman Sen. Jane Nelson (R-Flower Mound) introducing Senate Bill (SB) 1, the Senate’s version of the budget. The budget is broken down into several different articles that represent different policy areas. Article III, which includes TEA, the Foundation School Program, and TRS, as well as higher education funding, is set to be discussed the week of Feb. 11.

In addition to SB 1, the Senate Finance committee also laid out SB 500, the Senate’s supplemental appropriations bill. SB 500 includes approximately $2.5 billion in proposed funding from the Economic Stabilization Fund (ESF), or Rainy Day fund. With about $1 billion of that money going to Hurricane Harvey relief, the bill includes a substantial amount for affected school districts. Another $300 million has been slated toward the TRS pension fund.

The House Committee on Appropriations was also named this week and will begin its work right away, including naming the members of the subcommittee that will oversee the portion of the budget dedicated to education for the House. Initial hearings are slated for next Monday, Tuesday, and Wednesday. Texas school finance panel approves final report to lawmakers” was first published by The Texas Tribune, a nonprofit, nonpartisan media organization that informs Texans — and engages with them — about public policy, politics, government and statewide issues.

After hours of discussion Wednesday, a state panel studying school finance stripped its final report of language that blamed the state for inadequate education spending — and that added urgency to a need for more money to improve student performance.

The original version of the report, unveiled last Tuesday, included stronger language that held the state accountable for the lack of education funding and urged lawmakers to immediately inject more than a billion dollars of new funding into public schools. Scott Brister, the panel’s chairman and a former Texas Supreme Court justice, led the charge to make those changes, which he said would be more palatable to lawmakers and keep Texas from being sued in the future.

“I do have a problem several places where it says our school system has failed. I do think that’s asking for trouble,” he said.

Some lawmakers and educators on the panel pushed back before agreeing to compromise.

“I think we have failed our schools and we haven’t funded them, in my view, adequately or equitably,” responded state Rep. Dan Huberty, R-Houston, who chairs the House Public Education Committee.

Despite the conflict, the 13-member commission unanimously approved more than 30 recommendations on Wednesday aimed at boosting public education funding, improving student performance, cleaning up a messy funding distribution system — and providing property tax relief for Texans.

A final report will be sent to lawmakers, who are convening next month amid calls from state leadership to overhaul a long-embattled school finance system. Gov. Greg Abbott supported the panel’s vote in a statement Wednesday afternoon: “Today’s school finance commission report made clear that the state must reform the broken Robin Hood system and allocate more state funding to education. This session, we will do just that.”

The vote was the culmination of nearly a year of meetings and hours of testimony from school superintendents, education advocates and policy experts.

Panel members have bickered for months about basic foundational concepts, including whether the state had been underfunding public schools and whether they actually need more money in order to improve. The report takes a middle ground approach, promising more money to school districts that meet certain criteria or agree to offer specific programs such as dual language or merit pay for teachers.

Many of the debates among panel members Wednesday reflected their political divisions, with Brister — a conservative and Abbott appointee — arguing against citing a specific amount lawmakers should infuse into the public school funding system and school officials saying the panel should take an explicit stand based on its research.

An earlier version of the report said lawmakers should take the “important first step” of approving more than $1.73 billion in “new funding” for “the vast majority (if not all)” of the proposed programs.

The recommendation the commission approved Wednesday dropped that dollar figure.

Brister said he was uncomfortable sending a report to lawmakers that pressured them into making specific financial decisions.

“I am willing to say we will have to add new money to do these things. I am not willing to say, ‘And the first step is, every dime has to come from new money,” he said.

Nicole Conley-Johnson, chief financial officer of the Austin Independent School District, unsuccessfully argued to keep the paragraph in its original form.

“The spirit by which we were convened is to establish the changes and make recommendations,” she said. “I feel like we need to have the foresight to put in the estimated cost.”

Education advocacy groups criticized Brister’s decision. “There can be no real school finance reform that fails to address adequacy,” said Shannon Holmes, executive director of the Association of Texas Public Educators, in a statement after Wednesday’s vote. “ATPE is disheartened that some members on the commission were unwilling to acknowledge the reality of the limitation of our state’s current funding levels out of fears of sparking litigation.”

The report still includes cost estimates for recommended programs and changes to how funding is divvied up among schools. But it no longer implores state lawmakers to pay for them.

Among the recommendations the commission plans to send to lawmakers are:

  • $100 million a year to school districts that want to develop their own teacher evaluation metrics and tie pay to performance. The total amount available should increase $100 million each year until it reaches $1 billion.
  • Up to $150 million to incentivize school districts to offer dual language programs, which instruct students in both English and Spanish, and to improve their dyslexia programs.
  • $800 million to incentivize school districts to improve students’ reading level in early grades and to succeed in college or a career after graduating high school.
  • $1.1 billion to improve education for low-income students, with school districts that have a higher share of needy students getting more money.
  • Create a new goal of having 60 percent of third-grade students reading on or above grade level and 60 percent of high school seniors graduating with a technical certificate, military inscription, or college enrollment without the need for remedial classes.
  • Cap local school district tax rates in order to offer property tax relief and a small amount of funding for schools —a proposal from Abbott.
  • No extra funding for special education programs until the state has completed overhauling those programs in line with a federal mandate.

Federal officials said Texas should be doing even more to improve special education — and they’re planning a visit early next year to check.

In a letter Friday, officials from the U.S. Department of Education dissected Texas’ proposed plan for overhauling special education for kids with disabilities — in many cases urging state officials to do even more than they had originally planned. Earlier this year, a thorough investigation found Texas had failed to provide students with disabilities with a proper education, violating federal special education law, and demanded it undertake a long list of corrective actions to shape up.

After finalizing a plan in April, the Texas Education Agency has to date dramatically changed the structure of its departments overseeing special education, hired about 40 people to staff them (including a new special education director), and posted a long list of grants totaling more than $20 million to help school districts overhaul their policies. It anticipates spending an additional $3 billion over the next few years as more students enroll in special education.

“TEA has already completed more than half of the required activities in that Corrective Action Response,” Commissioner Mike Morath said in a statement Friday. “We continue to adhere to a commitment to transparency and engagement throughout the plan’s implementation.”

In Friday’s letter, federal officials okayed some parts of Texas’ improvement plan, which they noted outlines many “necessary steps” the state is taking to address their findings.

But they also said Texas should do more to make sure school districts understand how to comply with federal special education law. The investigation uncovered many educators who misunderstood what the law said about identifying students with disabilities and providing them with the right educational services.

The letter said TEA should take a “representative sample” of school districts and thoroughly review their policies and procedures for identifying students who may need special education. It also should specify how it will identify and hold accountable school districts that do not comply with federal law.

Parent advocates have argued school districts don’t make information available to them about how to make sure their children can access the appropriate special education services.

The Department of Education told the TEA to ensure state officials provide information to parents on their rights and responsibilities under federal special education law in their native languages, unless it’s “clearly not feasible to do so.” The TEA should also come up with a specific process for how it will make sure school districts communicate with families of students who may have been denied special education services in the past, “through means other than postings on websites.”

Federal officials plan to review the progress Texas has made and will work with the TEA to schedule an in-person monitoring visit in early 2019.

TEA announces “Grow Your Own” grant recipients for 2018-19

On Wednesday, Texas Commissioner of Education Mike Morath announced the recipients of the  2018-19 “Grow Your Own” grant. A brainchild of the Texas Rural Schools Task Force that was commissioned in 2016 to address challenges faced by rural school districts, the Grow Your Own award is designed to help districts cultivate interest in the teaching profession.

According to information provided by recipients, this year’s awards will be used to help districts prepare for the 2020-21 school year by assisting educators currently pursuing their Masters in Education, allowing districts to expand their dual credit courses, and facilitating current paraprofessionals in pursing their teacher certification, adding 59 full-time teachers and 136 full time teachers to the workforce in the 2019-20 and 2020-21 school-years respectively. The Grow Your Own grant funds will also be used to assist student teachers during their clinical teaching assignments and high schools to expand education training programs.

Teach the Vote’s Week in Review: April 20, 2018

Here’s your weekly wrap-up of education news from the ATPE Governmental Relations team:

 


The Teacher Retirement System (TRS) of Texas board of trustees held multiple meetings this week in Austin.

Highlights of the quarterly meetings included discussions of new rates and policy designs for TRS-ActiveCare for the 2019/2020 school year; the need for increased authorization to hire additional full time employees (FTEs) at the agency; the introduction of the new TRS Communications Director; and a discussion of and failed vote on lowering the TRS pension fund’s expected rate of return.

The House Public Education Committee held an interim hearing on Wednesday. Topics discussed included the continuing impact of Hurricane Harvey on the state’s public schools, plus implementation of recent education-related bills dealing with school finance, the accountability, system, and student bullying.

Commissioner of Education Mike Morath updated the committee on the state and federal governments’ response to Hurricane Harvey and the 1.5 million students in its affected school districts. Morath indicated that he will propose a new commissioner’s rule in June to provide a plan for accountability waivers for school districts that were forced to close facilities and suffered the displacement of students and staff.

The committee also heard testimony about the controversial “A through F” accountability system that is being implemented in Texas. School districts will be assigned A-F ratings in August, while campus A-F ratings will be released the following year. A number of witnesses during Wednesday’s hearing expressed concerns about the new rating system and its heavy emphasis on student test scores.

With interim committee hearings in full swing this month, paying for Texas public schools and teachers remains a hot topic.

On Wednesday, the House Appropriations Committee heard from Texas Comptroller Glenn Hegar and others about the status of the state’s Economic Stabilization Fund, often referred to as the “Rainy Day Fund.” Read more about recommendations being made for use of the fund to support the state’s funding needs in this blog post from ATPE Lobbyist Monty Exter.

The Texas Commission on Public School Finance also convened again this week, with a Thursday meeting focused on tax policy issues and sources of funding for the state’s school finance system. ATPE Lobbyist Kate Kuhlmann has a rundown of that meeting here. She also shared the below update from today’s Expenditures Working Group meeting which covered the cost of education index, compensatory education, and the transportation allotment.

One unsurprising word could be used to summarize testimony from invited panelists at this morning’s Expenditures Working Group meeting: update. On all three topics discussed, expert witnesses pointed to updating both the methodology behind the funding tied to each topic and what each topic intends to address. For the cost of education index, Texas A&M University Bush School Professor Lori Taylor noted that the index is based on teacher salaries and employment patterns from 1990. Taylor is the same expert behind a recent Kansas study on school finance, which determined that state should invest an additional $2 billion in school funding. During this morning’s meeting in Austin, Taylor and the other panelist agreed the cost of living index has value, but needs significant updating; it was suggested that to better account for evolving costs of education, the commissioners should consider recommending a requirement that the state update the index (or even the entire finance system) every 10 years.

Similarly, school districts and other school finance stakeholders pointed to the need for better targeted funding for students supported by a broader category of compensatory education services, and the legislative budget board shared different way to approach funding transportation costs. Teach the Vote’s Week in Review: April 6, 2018

Here’s a wrap-up of your education news from ATPE:


The Texas Education Agency (TEA) made several announcements this week regarding the draft plan to address special education in Texas. In addition to accepting public comments on the latest version of the draft plan, TEA has scheduled two hearings where members of the public are invited to express their input. Information on the two meetings is as follows:

  • Thursday, April 12, at ESC Region 1 – 1900 West Schunior, Edinburg, Tx.
  • Monday, April 16, at ESC Region 10 – 400 East Spring Valley Road, Richardson, TX.

Both meetings will begin at 1 pm, and those wishing to share feedback are asked to register onsite beginning at 12:30 pm (registration will end when the meeting begins). Registered participants will be called in the order they are registered and will be limited to three minutes. The hearing will end when all have testified or at 3 pm, whichever comes first. Those unable to attend either hearing can submit their written comments by email at TexasSPED@TEA.texas.gov by April 18 at noon.

Texas Commissioner of Education Mike Morath sent a letter to school administrators today regarding three recent changes to how the spring 2018 State of Texas Assessments of Academic Readiness (STAAR) exams will be administered. The three changes involve offering medical exemptions for qualifying students, allowing for the transcribing of student responses that are recorded in the test booklet onto a blank answer document, and relaxing the rules around classroom displays. His letter indicates these moves are being made in response to district feedback and in an effort to “do all I can to help make this a positive experience and reduce stress for students and school district and charter school personnel.” Read Commissioner Morath’s full letter to learn more.

 


It was a busy Wednesday at the Capitol this week, and your ATPE Governmental Relations team was there to cover all the action. ATPE Lobbyist Monty Exter covered the Senate State Affairs Committee meeting, where pension and healthcare issues were the topic of discussion. That meeting included conversations about the factors affecting the Teacher Retirement System (TRS) of Texas pension fund and the TRS-Care retiree health insurance program. The Texas Commission on Public School Finance met this week in Austin for a discussion on property taxes and their role in the school finance system. A smaller working group of commission members met Wednesday to discuss outcomes. The highlight of Wednesday’s meeting was former Assistant U.S. Secretary of Education Tom Luce, who suggested it’s time to do “more with more, not more with less” when it comes to funding public schools in Texas. This was particularly compelling advice from Luce, considering he was a key player in the state’s last major school finance reform – all the way back in 1984.

All 13 members of the commission met Thursday to hear several panels discuss property taxes. While there was general agreement on the burden imposed by property taxes, the debate between some members over how to calculate the state’s share of public education spending continued anew. Importantly, state Rep. Diego Bernal (D-San Antonio) requested the state prepare a list of school revenue sources that have been cut over the last 10 years. The Senate Education Committee rounded out a busy Wednesday in Austin with a hearing to discuss interim charges related to virtual schools, “high quality education opportunities,” and the federal E-rate program. ATPE offered written testimony to the committee concerning the virtual education charge, cautioning against moves to further expand the Texas Virtual School Network without carefully considering the status of virtual schools’ performance. Recent research highlights concerns regarding these schools nationwide and a look at Texas accountability measures fail to paint a drastically different picture in Texas. ATPE Lobbyist Kate Kuhlmann was at the hearing and offers more on the discussion here.

 


 

ATPE weighs in on proposed rules addressing out-of-state educators

ATPE submitted comments this week on new proposed commissioner’s rules regarding exempting certain out-of-state educators looking to teach in Texas from state certification assessments. Our comments acknowledge that “certain exceptions to certification testing may have a place in helping to get high-quality, experienced teachers in Texas classrooms,” but stress that “the focus must remain on high standards that help ensure we are limiting exceptions to only those educators with a proven track record of success in educating students.”

The new proposed rules stem from legislation passed during the 85th Legislative Session that gave the commissioner of education the ability to create this specific certification flexibility. In lieu of the current process overseen by the State Board for Educator Certification (SBEC), which currently compares other state certification requirements to Texas’s standards before exempting out-of-state educators from certification assessments, the new proposed commissioner’s rules would instead outline a number of requirements an out-of-state educator must prove in order to receive the exemption. The requirements primarily entail obtaining certification in another state or country, but also include a one year experience requirement for all classroom teacher candidates.

ATPE argued in its comments that the experience requirement should be raised to at least two years of teaching experience. This is because the proposed rules don’t only exempt these out-of-state educators from certification assessments, they also exempt them from preparation and certification standards Texas policymakers and stakeholders have deemed necessary. For instance, some preparation standards these educators would be exempted from include the minimum GPA requirement placed on candidates entering a certification program; the number of curriculum hours educators in training must complete; the amount of clinical training a candidate must possess before obtaining full certification; the amount of time new teachers must spend working with mentors and coaches to develop their craft; and training specific to the Texas Essential Knowledge and Skills (TEKS), the Texas educator standards, and the Texas Educator Code of Ethics.

“If we are going to exempt certain educators prepared out of state from these standards of preparation and certification, we should at a minimum be ensuring they bring valuable experience to Texas classrooms,” ATPE argued in its comments.

ATPE testifies before school finance commission

The Texas Commission on Public School Finance met this morning, Feb. 22, in Austin to consider another round of testimony, this time largely focused on teacher quality. Chairman Justice Scott Brister began the meeting by announcing subcommittee assignments.

The Revenue Committee will be led by state Sen. Paul Bettencourt (R-Houston) and include state Rep. Ken King (R-Canadian), Nicole Conley Johnson, Elvira Reyna, and Justice Brister. The Expenditures Committee will be led by state Rep. Dan Huberty (R-Houston) and include state Sen. Royce West (D-Dallas), state Sen. Larry Taylor, State Board of Education (SBOE) Member Keven Ellis (R-Lufkin), and Justice Brister. The Outcomes Committee will be led by Todd Williams and include state Rep. Diego Bernal (D-San Antonio), Dr. Doug Killian, Melissa Martin, and Sen. Taylor.

The first to testify was Texas Education Agency (TEA) Chief School Finance Officer Leo Lopez, who presented information that $28.8 billion of combined state, local, and federal funding was spent on instruction in 2016, which comprised 47.7 percent of total education spending. Rep. Huberty, who chairs the House Public Education Committee, pointed out that when factoring in instructional materials and other classroom supports, the 47.7 percent figure does not accurately capture the percentage of funding spent directly on students in the classroom.

Rep. Bernal, who is vice-chair of the House Public Education Committee, asked about the cost to the state that can be attributed to teacher turnover. Austin ISD Chief Financial Officer Nicole Conley Johnson answered that each teacher who leaves her district costs between $7,000 and $12,000, which doesn’t even address the negative impact on students. Teacher turnover has been estimated to cost the nation $2.2 billion per year.

The commission heard next from Dr. Eric Hanushek, a professional paid witness who has made a living for decades testifying in court against efforts to increase and equalize school funding, as well as advocating for private school vouchers. Hanushek laid most of the blame for poor student performance at the feet of teachers, but argued against increasing teacher pay. Member Ellis contended that there is a strong statistical relationship between total school spending and results, and that how much is being spent is at least of equal importance as the manner in which the money is spent. Several other commission members, including Conley Johnson and Rep. Bernal, pushed back on Hanushek’s attempts to minimize the importance of adequate school funding.

Dallas ISD Superintendent Michael Hinojisa testified regarding his district’s efforts to implement a robust performance-based pay system. The Dallas system provides teachers significant tiered pay increases based on performance. Rep. Huberty lauded the concept, but raised questions about cost and affordability. Hinojosa conceded that the program is unsustainable going forward, and as such is being “recalibrated” in order to bring costs under control. Hinojosa also pointed out that public school districts offer many “school choice” options, which include magnet schools and district transfers. According to data presented by Todd Williams, who advises Dallas Mayor Mike Rawlings on education policy, implementing Dallas ISD’s ACE program costs $1,295 per student, or roughly $800,000 per campus. The commission heard from several more witnesses describing various performance pay programs.

ATPE executive director Gary Godsey testified before the commission, and began by stating the obvious: Texas schools need more money. Godsey informed the commission that teachers often experience low morale, difficult working conditions, and the feeling they are underappreciated. Teacher turnover costs Texas an estimated $500 million per year. Some initiatives, such as mentorship programs, could reduce turnover with a minimal impact on school budgets. Regarding pay, Godsey testified that teachers are very concerned about efforts to repeal the minimum salary schedule (MSS), which guarantees a minimum level of pay for educators that increases over time. In addition to other low-cost initiatives to reduce turnover, Godsey suggested modifying funding weights and tracking the distribution of teacher quality. Regarding performance pay programs, ATPE Lobbyist Monty Exter testified that incentive pay must be complemented by adequate base pay and should not be tied solely to student test scores. Exter added that any incentive pay program must be financially viable in the long term in order to achieve buy-in from educators and administrators.

The final panel addressed prekindergarten programs, and witnesses emphasized the importance of pre-K in getting children prepared to learn and excel in elementary school. Witnesses testified that dollars invested in early education are dollars saved in remediation later on in a student’s educational career.

The commission is scheduled to meet next on March 7, followed by a March 19 meeting that will be open to comments from members of the public. Another meeting is scheduled for April 5.

Early voting for the March primaries begins Feb. 20. Texas Secretary of State Rolando Pablos has issued a new proclamation naming the first Friday of early voting period (Feb. 23, 2018) to be “Student Voting Day.”  Secretary Pablos is calling on communities “to urge and encourage all eligible students in Texas to make their voices heard by casting their ballots at ANY polling location in
their county of registration.” The Secretary of State’s office has been an important partner in efforts to promote voter awareness within our public schools, and we appreciate his support.

Since we last reported on Attorney General Ken Paxton’s opinion about Get Out The Vote (GOTV) activities spearheaded by ATPE and other members of the Texas Educators Vote coalition, more Texans are speaking out in support of our coalition and expressing displeasure with the not-so-subtle efforts of some elected officials to try to rein in politically active educators. The Houston Chronicle‘s Lisa Falkenberg wrote an opinion piece on Saturday, Jan. 20, in support of ATPE’s and the coalitions efforts to increase voter turnout and awareness. Falkenberg wrote that voter apathy “doesn’t stop if we do nothing. Some folks in this state are trying to do something. We should let them.” Falkenberg concluded, “No opinion from the Texas AG, or from Bettencourt, has dissuaded me from believing their efforts are vital for the young voters, to the public in general, and to the future of this state we love.” Retired Superintendent Joe Smith also expressed support for Texas Educators Vote on his TexasISD.com website, and educator Danny Noyola, Sr., an ATPE member, similarly wrote an opinion piece for the Corpus Christie Caller-Times defending the coalition’s work. Noyola called AG Paxton’s opinion “an intimidating assault on teachers, administrators, and educational groups to stifle citizenship and voting learning opportunities for all students in a non-partisan, pro-education, creative hands-on way.”

ATPE is pleased that school districts are continuing to support our nonpartisan coalition efforts with additional school boards adopting the coalition’s model resolution on creating a culture of voting, even after the issuance of General Paxton’s opinion. We appreciate the support of school leaders to continue to encourage public school employees and eligible students to be informed and vote in the upcoming primaries.

 


Texas Commission on Public School Finance meeting, January 23, 2018.

The Texas Commission on Public School Finance held its first meeting Tuesday in Austin following its creation as part of House Bill (HB) 21, which was passed during the 85th Texas Legislature’s first special session. The first meeting quickly established the divide between members of the commission focused on improving public school performance and those solely focused on finding ways to cut taxes. House Public Education Chair Dan Huberty (R-Houston) correctly noted that school finance reform and property tax relief go hand-in-hand, and the Texas Senate abandoned a proposal that could have made progress on both fronts in order to pursue voucher legislation.

The meeting was restricted to invited testimony, which included a supporter of school privatization and the heads of a number of state departments, including Texas Education Agency (TEA) Commissioner Mike Morath. Read more about the meeting in this blog post from ATPE Lobbyist Mark Wiggins.

 


The Texas Education Agency (TEA) held a formal hearing today, Jan. 26, to take public testimony on rules pertaining to school district and charter school partnerships. The regulation being considered is Proposed New Commissioners rule 19 TAC Chapter 97, Planning and Accountability, Subchapter EE, Accreditation Status, Standards, and Sanctions, Division 2, Contracting to Partner to Operate a District Campus, §97.1075, Contracting to Partner to Operate a Campus under Texas Education Code, §11.174, and §97.1079, Determining Processes and Criteria for Entity Approval under Texas Education Code, §11.174.

The bulk of the testimony was provided by educators, administrators, and parents. While there were charter advocates in attendance, none offered testimony. All testifiers opposed the rules as currently proposed. Common themes among those who testified included: agency overreach in defining “enhanced authority” that a district must give to a charter in order to enter into a partnership, despite no statutory authority or even implication in the law to do so; a lack of acknowledgment of teacher protections and pre-agreement consultation, which is required under the law; and a general lack of specificity about the approval process, including what factors TEA will consider and the timeline TEA will work under in approving the partnerships.

The Texas Education Agency (TEA) opened its online survey this week to solicit feedback regarding the agency’s initial draft plan to correct inadequacies in special education services. This comes in response to a directive from the U.S. Department of Education that Texas correct systemic denial of special education services due to a de facto “cap” uncovered by a Houston Chronicle investigation. The initial draft plan includes four main actions, with explanations for each.

The agency has been ordered to seek input from stakeholders, including parents and educators, which will be collected through an online survey available on the TEA website since Jan. 23. The agency will accept public comment on this draft plan through Feb. 18, 2018, after which a new Proposed Plan will be released on or around March 1. Public comments on this new plan will be accepted through March 31. The agency expects to submit a Final State Corrective Action Plan to the U.S. Department of Education on or around April 18, 2018. TEA submits revised federal ESSA plan

Commissioner of Education Mike Morath wrote school administrators yesterday to inform them that the Texas Education Agency (TEA) submitted its revised plan to implement the Every Student Succeeds Act (ESSA). The U.S. Department of Education (ED) issued feedback in December to Texas’s original state ESSA plan, which required some revisions and asked for additional clarity.

Morath’s letter to administrators largely focused on how the revised plan would impact the implementation of House Bill (HB) 22, a piece of accountability-related legislation passed by the 85th Texas Legislature, as the major areas addressed by ED involve the new academic accountability system.

“Due to federal timeline requirements, the Agency was forced to make preliminary decisions on the new House Bill 22 (HB 22) accountability system ahead of the timeline for our state rulemaking,” Morath wrote. “I want to emphasize the decisions laid out in our revised ESSA plan do not reflect final stakeholder input and are an effort to comply with federal timelines and requirements.”

Among the changes made to address issues outlined by ED, TEA’s revised plan:

  • alters the long-term goal for ESSA to entail 30 percent growth based on baseline scores from the 2016-17 school year (the original long-term goal didn’t cut it for ED because, for example, it failed to anticipate graduation rate growth for certain student subgroups, in this case white males; proficiency goals are also now based on a meeting grade level expectation rather than the originally proposed approaching grade level expectation);
  • removes writing, science, and social studies test results from the academic achievement considerations (ED interprets the law to say only math and reading/language arts results can be used to calculate this indicator; the other test results will still be used for calculating student success and school quality);
  • aligns the accountability impact for failing to meet the required 95 percent testing participation rate with federal stipulations, which will impact schools where parents opt their students out of state standardized testing;
  • adjusts the federally required summative rating calculation so that either student achievement or progress (the better score of the two) makes up 70% of the rating, while 30% consists of progress towards closing the gaps (the original calculation would have averaged the two percentiles); and
  • changes accountability for recently arrived English language learners so that it begins in their second year in U.S. schools (the original plan would not have included some recently arrived ELL students in some accountability results for the first two years and would have omitted some asylum/refugee students for up to five years).

The revised state plan also adds language to clarify various aspects of the proposal. For example, ED asked for more information on how Texas plans to satisfy a federal requirement to track and publicly report the disproportionate rates at which poor and minority children have access to experienced, qualified educators, an issue on which ATPE has long advocated for change driven by research-based solutions. The revised plan dives deeper into Texas’s landscape and the way TEA intends to calculate and report the data.

The letter goes on to inform administrators that TEA will submit amendments to the plan if additional feedback leads to “decisions different from what is proposed and already submitted in our ESSA plan.” Similar language in the original plan submitted to ED was omitted in the revised plan.
