Teach the Vote’s Week in Review: Nov. 9, 2018

Here’s your weekly wrap-up of education news from ATPE Governmental Relations:


This past Tuesday was Election Day. All across the country registered voters lined up at polling places (some with hours-long waits) to cast their ballots and make their voices heard. There were a number of impressive wins and historical elections across the country and Texas was no exception. Turnout for this midterm election was nearly double what it was in 2014.

While Texas’s Governor, Lieutenant Governor, and U.S. Senator Ted Cruz were all able to secure reelection, the margins by which they won were closer than usual. Democrats in the Texas House were able to flip 12 seats, a gain that has implications for the impending race for a new House Speaker, while the minority party in the Senate also gained two seats. Senate Democrats will most likely still face a vacancy for at least the first part of the 2019 legislative session; Sen. Sylvia Garcia (D-Houston) announced her resignation today following her election to a U.S. Congressional seat on Tuesday. Gov. Greg Abbott must now call a special election to fill the state senate seat within the next couple of months. Additionally, the seat flipping in the state legislature might not be complete at this point as a number of candidates who seemingly lost their elections Tuesday by narrow margins are waiting for provisional and mail-in absentee ballots to be counted. Margins that remain slim following the completion of the vote counting could trigger recounts in a few races.

What we know for sure at this point is that Texans made a statement with this election by electing a myriad of pro-public education candidates to office. ATPE Lobbyist Mark Wiggins breaks down the math of this week’s election results in this blog post.

 


A 2012 decision by the state of Texas to spend less money on students with disabilities is coming back to haunt it. The U.S. Court of Appeals for the Fifth Circuit has ruled to uphold a penalty levied by the U.S. Department of Education that withholds $33.3 million dollars in federal funding from Texas’s special education grants. The penalty was imposed after Texas was found to have withheld the same amount of money in funding for special education programs. While the state argued that its special education programs had helped students overcome their disabilities and hence fewer special education services were needed following the 2012 funding decrease, the federal education ageny contended that states can not reduce funding levels from year to year.

Guest Post: Dan Patrick is lying about teacher raises

As an educator, I find Lt. Gov. Dan Patrick’s bogus $10,000 raise claim offensive

There seems to be no end to what the lieutenant governor will say in his attempt to convince Texans that he is pro-public education.

Among the daily barrage of television ads to which Texans have been subjected recently, one lie stands out for its particular audacity.

In his most recent ad, Lt. Gov. Dan Patrick (R-Texas) doubles down on an already debunked claim that he proposed giving teachers a $10,000 raise during the last legislative session.

As an educator, I am startled by this claim for a number of reasons.

At no point during the regular session did Lt. Gov. Patrick show any concern for increasing educator pay. Only after the close of the regular session, when it became clear that his anti-education agenda might finally push educators into action at the polls, did Patrick entertain talk of a raise. The Senate briefly considered a far more modest $1,000 raise but refused to fund it – suggesting cash-strapped districts simply “find the money” to make it happen.

Had that proposal passed, many districts would have had to fire good educators to be able to fund the raises of their former colleagues. Once educators realized Lt. Gov. Patrick and his Senate weren’t serious about truly helping us, we walked away frustrated, if unsurprised.

As far as Lt. Gov. Patrick’s respect for teachers goes, it was nowhere more evident than in his push last session to effectively kick them out of the Capitol through legislation hindering their ability to voluntarily participate in professional associations that advocate for higher standards and more student resources.

Politicians lie. I get it.

But I confess this lie cuts me in a way that is deeply personal.

As an educator, I know what it’s like to spend $400 out of my own pocket every year on classroom supplies for my students. I know the suffocating feeling of watching my healthcare costs go up as my salary stays the same. I know what it’s like to work 12-hour days only to flip on the radio and hear people like Dan Patrick accuse us of failing our kids.

Under Lt. Gov. Patrick, the Texas Senate has steadily decreased the state’s share of public school funding to just 36 percent, forcing local school districts to make up the difference by hiking up local property taxes. Now we’re to believe this same lieutenant governor secretly proposed a $10,000 raise for 350,000 teachers – which would cost more than $4 billion a year – and somehow we missed it?

In fact, the lieutenant governor was so loath to invest another dime in public education last session that he killed a bill that would have contributed as much as 1.9 billion additional dollars to our state’s 5.4 million schoolchildren. Why? He wanted a taxpayer-funded voucher for his private school friends.

Who exactly is failing our kids, Mr. Patrick?

The $10,000 raise claim is so ludicrous that the non-biased fact-checkers at PolitiFact Texas found it false back in February, but Mr. Patrick keeps repeating it. In doing so, he cheapens the genuine personal struggles I and other educators face as a result of his politics.

Perhaps if he’d gone to school in Texas, he’d have been taught that it’s wrong to lie. Perhaps he’d help Texas teachers instead of attack us. Despite his attempts to rewrite history, educators know who Lt. Gov. Dan Patrick is.

Perhaps that’s his problem.

The Board of Trustees of the Teacher Retirement System (TRS) met this week to discuss such topics as premiums for the state’s healthcare plan for retired educators. After receiving a more favorable update on the estimated shortfall for TRS-Care and hearing lawmakers indicate that the legislature will provide needed funding, the board intends to try to keep premiums and benefits stable. Senator-elect Pete Flores (R-San Antonio)

Voters in Senate District 19 turned out for a special election runoff on Tuesday to decide who will represent them in the Texas Senate until the 2020 elections. Gathering 53% of the vote, Republican Pete Flores was the race’s clear winner and will be filling the seat left vacant by former Sen. Carlos Uresti who resigned this year.

Flores’s win flips the seat long held by Democrats into the Republican column heading into the 2019 legislative session. The change makes it that much easier for the upper chamber’s Republican super-majority to pass Lt. Gov. Dan Patrick’s agenda, especially with another Democratic vacancy generated by the anticipated race to replace Senate District 6’s Sen. Sylvia Garcia, who is running for Congress. Garcia’s seat would not be filled until a special election occurs well after next year’s legislative session begins.

Tuesday, September 25 is National Voter Registration Day, and thousands of volunteers across the U.S. will be mobilized to help others register to vote and get informed about elections. Perhaps if you’re already to vote you can go the extra mile by asking friends and family if they’ve registered and reminding them of these important dates:

  • The deadline to register to vote in November is Oct. 9, 2018.
  • Early voting runs Oct. 22-Nov. 2, 2018.
  • Election Day is Nov. 6, 2018.

Secretary of State reminds Texans to register to vote by Oct. 9

The following is a press release issued on Sept. 7, 2018, by the Texas Secretary of State’s office, reminding Texans about the Oct. 9 deadline to register to vote in the November 2018 general election.


Secretary Pablos Reminds Texans To Register To Vote By October 9th, Plan Their Trip To The Polls

“Prepare yourself, inform yourself, and empower yourself”

AUSTIN – Texas Secretary of State Rolando Pablos today reminded all eligible Texans to register to vote by October 9th and to make all necessary preparations to be able to cast a ballot in the upcoming November 6 General Election.

Secretary Pablos encouraged all eligible Texas voters to ensure that they:

(1) are registered to vote in their county of residence
(2) are aware of what they need to bring to the polls in order to cast a ballot.

Additionally, Secretary Pablos urged voters to contact their respective county elections offices to become familiar with their ballot, locate their appropriate polling location, and plan their trip to the polls.

With the October 9th voter registration deadline just over a month away, Secretary Pablos issued one last call-to-action by urging Texans to register and take the necessary steps to be prepared to vote.

“Don’t wait until the last minute, make sure you are registered well in advance of the October 9th voter registration deadline so that you cast a ballot in the November General Election,” Secretary Pablos said. “The Texas Secretary of State’s office wants to ensure that all eligible Texans can cast their ballots with confidence this November, and the first step in doing so is to make sure you are registered and ready to make your trip to the polls.”

Eligible Texans who are not already registered to vote may complete and print a voter registration application here, or request an application from their county elections administrator. Once completed,  eligible Texas voters may submit the application to the county voter registrar in their county of residence. Completed voter registration applications must be postmarked by October 9th, 2018 in order to be accepted. Texans may check to see if they are already registered to vote through the Texas Secretary of State’s web site or by visiting www.votetexas.gov.

“Prepare yourself, inform yourself, and empower yourself,” Secretary Pablos said. “As a Texas voter, you can set an example for your fellow Texans by showing your commitment to civic engagement. We will continue working with election officials across the Lone Star State to make sure all eligible Texans have the information and resources they need to register to vote and make their voices heard.”

To avoid longer waiting times on Election Day, the Texas Secretary of State encourages eligible registered voters to vote during the early voting period from Monday, October 22nd to Friday, November 2nd, 2018. During the early voting period, Texas voters can cast a ballot at any location in their county of registration.

Additionally, Secretary Pablos has proclaimed the first Friday of the early voting period (October 26th) to be Student Voting Day in the State of Texas, when all eligible Texas students are encouraged to cast their ballot in their county’s nearest polling location during times that do not conflict with their scholastic obligations.

Secretary Pablos also reminds Texas voters who possess one of the seven approved forms of photo ID that they must present that ID at the polls. Voters who do not possess and cannot reasonably obtain one of the seven forms of approved photo ID may execute a Reasonable Impediment Declaration form (PDF), available to them at each polling location, and provide a supporting form of identification. Additionally, certain voters may qualify for certain exemptions to presenting an acceptable form of photo identification or following the Reasonable Impediment Declaration (PDF)procedure.

The seven forms of approved photo ID are:

With the exception of the U.S. Citizenship Certificate, which does not expire, the acceptable photo ID must be current or, for voters aged 18-69, have expired no more than four years before being presented for voter qualification at the polling place. A voter 70 years of age or older may use a form of acceptable photo ID listed above that has expired for any length of time if the identification is otherwise valid.

If a voter does not possess one of the forms of acceptable photo identification listed above, and the voter cannot reasonably obtain such identification, the voter may fill out a Reasonable Impediment Declaration form (PDF), which will be available at each polling location, and present a copy or original of one of the following supporting forms of identification:

  • a government document that shows the voter’s name and an address, including the voter’s voter registration certificate;
  • a current utility bill;
  • a bank statement;
  • a government check;
  • a paycheck;
  • a certified domestic (from a U.S. state or territory) birth certificate; or
  • a document confirming birth admissible in a court of law which establishes the voter’s identity (which may include a foreign birth document)

The address on an acceptable form of photo identification or a supporting form of identification, if applicable, does not have to match the voter’s address on the list of registered voters.

If a voter meets these requirements and is otherwise eligible to vote, the voter will be able to cast a regular ballot in the election.

Voters with a disability may apply with the county voter registrar for a permanent exemption to presenting an acceptable form of photo identification or following the Reasonable Impediment Declaration procedure at the polls. Voters with a religious objection to being photographed or voters who do not present an acceptable form of photo identification or follow the Reasonable Impediment Declaration procedure at the polls because of certain natural disasters may apply for a temporary exemption to presenting an acceptable form of photo identification or following the Reasonable Impediment Declaration procedure. Does Gov. Abbott want to spend more on schools?

Election season is truly magical.

There’s just something about the seething mercury, the colorful proliferation of yard signs, and the specter of an existential showdown that awakens a – dare we call it – miraculous clarity in political combatants seeking votes.

When else can one witness folks who’ve spent the past 20 months fighting in bitter opposition to a particular set of constituents suddenly discover a deep love for the values they hold? The Lord works in mysterious ways.

It’s no surprise that we’re now hearing support for improving the school finance system from unexpected corners. To a certain degree, it’s positive evidence that educators are being heard, and that the powers-that-be realize that there is more to gain by working with the education community than working to dismantle it.

That doesn’t mean that efforts to dismantle it behind the scenes will stop. In politics as in statistics, things tend to revert toward the mean. The governing happens long after the polls close. Nonetheless, election season opens a brief window of opportunity to use our seat at the table to advance the conversation.

Let’s apply this lens to the latest Dallas Morning News opinion column by Gov. Greg Abbott (R-Texas), with the promising headline, “Texas must boost school funding.” The key passage summarizing Gov. Abbott’s message is as follows:

“We need to pay our best teachers more, reward teachers and districts for student growth, prioritize spending in the classroom and reduce the burden of skyrocketing property taxes. I’ll add up front that I believe the state will have to provide more funding.”

That last line seems to offer an acknowledgment of what we in the education committee have known for some time, but which many in the Capitol have resisted mightily.

The problem, of course, is that many of the people who have opposed investing more state dollars in public education have falsely argued that the state is already increasing education spending year over year. They point to raw dollars going back to a low-water point in 2006 in order to obscure the reality of the deliberate and steady erosion of state support for local schools. Troublingly, Gov. Abbott takes this very tack in writing that “overall education spending in Texas has increased by more than 50 percent since 2006, and the state is contributing 29 percent more education funding per student in that time period.”

Let’s look at that claim.

The numbers in the latter half of that statement come from a Texas Education Agency (TEA) presentation before the Texas Commission on Public School Finance. The headline of the slide below seems to confirm the governor’s assertion, but look at the orange line indicating funding adjusted for inflation. It clearly shows that in terms of purchasing power, total per-student funding has risen only slightly since 2006, and is roughly equal to per-student funding in 2008. What’s perhaps more telling is the blue bar indicating how much funding the state has contributed. I’ve added the red brackets and red horizontal line to make the minute changes easier to see. You can tell that the raw dollar amount the state has contributed has actually decreased slightly since 2008 – and that’s not even adjusted for inflation.

To get to the inflation-adjusted number, we look at the Legislative Budget Board’s (LBB) Fiscal Size-up for the 2016-2017 biennium. In the chart below, we can see how spending from local property tax revenue (circled in green) has increased, while state aid (circled in blue) has changed little from 2008 levels. In total constant dollars adjusted for inflation (near the red arrow), we see that total funding has in fact decreased.

The governor also wrongly suggests that funding is not making it into classrooms. According to the TEA’s 2016-17 Pocket Edition statistics, districts only spend an average of 3.1 percent on administrative costs.

To his credit, the governor advocates that increases in funding should go to teachers. No disagreement there. His idea is to implement a system in which top-performing teachers can earn significantly higher pay by teaching in areas facing the most need – similar to the “ACE” system tested in Dallas ISD. It’s a conversation that’s worth having, provided that educators are involved in the process and that the system doesn’t rely primarily on student test results to identify those “top-performing” teachers.

Governor Abbott also suggests moving away from a per-pupil funding model and, implicitly, toward a more outcomes-based approach. This is problematic for a variety of reasons, not the least of which is identifying which metrics with which to measure student performance and the threat of schools faced with the most significant socioeconomic challenges receiving even less support.

Finally, the governor writes that school finance reform must be accompanied by reforms in property taxes. It’s true the two are inextricably intertwined.

Increasing the state’s share of public education funding is the surest way to provide relief in property taxes. The governor proposes forcing taxing entities to lower their rates as appraisals go up, with the state presumably stepping in to make school districts whole. That’s a lot to presume, especially to do so in perpetuity.

Districts could hardly be blamed for wanting to see the legislature commit money up front before committing to voluntarily lower their tax rates – and it will take a sizable appropriation to shift the burden back toward the state in a way that will be meaningful to local property owners. School board members are politicians too, and they don’t want to be blamed for high taxes any more than their counterparts in Austin.

So what does it all mean? Does the governor’s column signify a dramatic reversal of his stance on public education, and school finance in particular? Does it mean he’s ready to stop attacking educators through anti-teacher payroll deduction bills and focus on improving teacher pay instead?

At a minimum, the governor is now talking about public education as an important priority, and that’s a good thing. The onus is on us to engage respectfully yet forcefully, and to shape the conversation, to the extent we can, by correcting inaccuracies and providing meaningful input. At best, we hope the governor will listen to educators and incorporate our feedback, even after the elections are over.

Of course, just as election season begins in the frantic furnace of summer, it ends in darkness on a winter night. When the legislature returns in January, we’ll all be faced with cold reality.

It’s time to start grading the papers of the people elected to run the state of Texas, to translate voters’ thoughts and feelings about the way things are going into the job reviews that will be delivered in this year’s general election.

It’s the seasonal cycle of this electoral democracy. We elect them. They do stuff. We decide whether to keep or replace them.

Elected officials adore this sort of judgement when it’s directed at others.

Later today, for instance, the state will issue its inaugural set of A-F grades for more than 1,000 public school districts. That has agitated a lot of Texas educators; when the grades are out, odds are good that it will agitate — in ways both negative and positive — parents, business people and taxpayers. If the politicos are lucky, it will divert angst over public education in Texas away from the folks who’ll be on the November ballot.

Accountability is an admirable thing in politics. It can show citizens where responsibility lies, the better to direct their blame and, more to the point, where to repair or replace policies that don’t work.

It can also diffuse responsibility. When today’s school grades come out, keep an eye on who’s taking the heat and who’s getting the credit. Ask yourself, as it unrolls, whether the right people are getting the right kind of attention.

This is supposed to be a way for the government ministers in Austin and the public across the state to see what results they’re getting for their money. It’s controversial, to say the least. Educators contend the grading system is both too general — not taking the complexity of any given school district into account — and too reliant on standardized tests and other inappropriate yardsticks that don’t give accurate readings of educational progress. Many are not crazy about grades of any kind, but they’re irked that these grades, in their view, will give voters and policymakers false readings about school districts’ performance.

But for a Legislature that can’t muster a consensus for what public schools should do and what they should cost, it’s a way to outsource the blame from the pink building to local “educrats.”

It’s a pre-election test of whether voters trust politicians more than teachers.

Education isn’t the only forum for this sort of deflection. The telling sign is when the people at the top try to separate themselves from the people who work for them, a strategy that allows them to make policy and take credit for passing laws while also blaming someone else when the execution of those instructions falls short.

Maybe the blame should crawl up the management ladder; they’d rather you didn’t make the connection.

Rats, mold and other filth in state buildings? The budgeteers at the Capitol have been skimping on building maintenance and upkeep for years. Multi-billion-dollar contracting troubles at the Health and Human Services Commission? That sort of thing happens if you put all those disparate agencies into one pot and then wander off, forgetting the second part of the business maxim: “Put all your eggs in one basket — and then watch that basket very carefully.”

A federal “zero tolerance” immigration policy that splits adults and children at the border and then cannot reconnect them — whether they’re staying here or being sent home? That is, in fact, a bureaucratic nightmare. But it’s a product of bad design, of putting a policy in place before figuring out how it’s going to work. The blame for that kind of empty-headed governance belongs at or near the top of the organization chart. Roughly 500 of those kids are still unattached to the adults with whom they entered the country. That terrible foul-up took place at the border, but the credit and blame really belong to the high officials who got things rolling.

This is going to be a hard day for some school superintendents and school boards and a great day for others. In both situations, some of them deserve it. Some of them don’t. Examine the results. Make your own judgements. And when you pass out cheers and jeers, think of the people who are responsible for education policy who aren’t on today’s report cards.

They’ll be on your election ballot a few weeks from now.

What’s happening at TRS this week?


This week, the TRS board of directors will discuss and likely take action on a recommendation to lower the assumed rate of return (RoR), based on investment forecasts provided by independent financial experts hired to assess all of the assumptions TRS staff uses for planning purposes. Should the board lower the assumed RoR it would be in line with broader trends in the public pension sector, including TRS’s peers. The vast majority of experts expect less robust investment returns in the near and mid-term future.

In order to maintain the long term health of the fund without decreasing pension benefits, contribution rates will need to be increased to offset an anticipated decrease in investment revenue. Unlike many local pension systems (e.g., municipal, police, and fire), the TRS board does not set contribution rates for either employees or employers; nor does the board set the benefits paid out to retirees. Both TRS contributions and benefits are completely determined by the Texas legislature. Should the legislature fail to pass a plan to provide adequate contributions over time, the only remaining options would be to reduce benefits, further weakening current and future retirees’ retirement security, or put the fund into a situation where benefits being paid out exceed revenues coming in, which would place the fund on a path to eventual insolvency.

The bottom line is that the burden is on the Texas legislature to step up and provide the necessary funding to ensure actuarial soundness of the TRS pension fund and give educators peace of mind that they will not face cuts in their pensions or other dramatic pension plan changes. Historically, the legislature has not been proactive in this area and has not prioritized funding for retired educators’ needs, opting to delay action until the pension fund reaches a crisis level.

Some educator groups have urged their members to flood TRS board members with calls and emails this week. We believe their calls to action, while well-intentioned, are misdirected, as the TRS board has virtually no authority over contributions or benefits and, with regard to investments, has a fiduciary duty to act in what it believes to be the best interest of the fund based on the prudent advice of its financial experts. In other words, TRS has few options at this time, given the legislature’s disregard over the course of decades for the growing financial needs of the pension fund.

The only way to avoid a major TRS funding shortfall that will hurt the educators who depend on the fund is legislative action, not action from TRS. With that in mind, educators who care about the short- and long-term health of TRS should be focused on the legislature, not the TRS board members. Current legislators who have not prioritized TRS funding have caused the current problem. Is it reasonable to expect those same legislators to now fix it, or does it make more since go to the polls in November and elect legislators who will prioritize TRS funding as part of a general dedication toward public education?

You did it! Tuesday, May 22nd turned out to be a great night for pro-public education candidates in our state, and it’s all because of the concerned educators and members of the public that turned out in the primary runoffs. The power of Texas educators was on full display as 80% of runoff candidates backed by ATPE-PAC or ATPE Direct triumphed over their opponents. A more thorough breakdown of all of the races can be found in this post by ATPE Lobbyist Mark Wiggins. While these victories may be sweet, remember that the fight isn’t over just yet. The general election in November is right around the corner, and educators must stay engaged!


Despite the concerted efforts of voucher supporters in Congress, ATPE and its federal lobby team in Washington D.C. were able to quell the passage of a voucher aimed at military-connected families. Along with many other opponents of the legislation, including the Military Coalition, we were able to successfully stop the most recent attempt to advance harmful voucher legislation. This most recent attempt would have amended a voucher onto the National Defense Authorization Act for Fiscal Year 2019 (NDAA). The Texas House Public Education (HPE) Committee met on Thursday to discuss its assigned interim charges on special education and standardized testing.TEA Commissioner Mike Morath offered testimony on the STAAR test, the effectiveness of the writing portion of the test, and how that portion is graded.Morath also spoke on the agency’s response to the tragic shooting in Santa Fe, which include providing attendance waivers and seeking federal funds for emergency response. ATPE lobbyist Monty Exter provided testimony on the specificity of the Texas Essential Knowledge and Skills (TEKS) and other topics. The committee also heard from a panel of superintendents, TEA Deputy Commissioner Penny Schwinn, and special education advocates. Educators: Your runoff vote could be your most impactful!

Early voting is currently underway in the 2018 Runoff Elections, with Election Day set for May 22. Believe it or not, this is your chance to have the biggest impact on any race this year!

Wait, how’s that possible?

First, understand that Texas voter turnout is unfortunately pretty abysmal. Even in big election years like the 2016 Presidential Election, only 59 percent of registered voters in Texas came out to cast their ballot. That’s barely more than half! In effect, the half that voted made the decision for the half who could have voted, but chose to stay home.

When there’s no race for president, the numbers look even worse – especially when it comes to primaries. Just 10 percent of registered voters participated in the 2018 Republican Primary, while seven percent participated in the Democratic Primary. As of Tuesday, turnout for early voting in the 2018 Runoff Elections among the state’s most populous counties was just 1.7 percent of registered voters.

Imagine – that 1.7 percent will end up deciding races that will affect all 28 million people living in Texas. According to the math, each of those voters effectively spoke for 139 people. All that is to say that if you want your single vote to have an impact, now is the time to cast it!

So why is that vote important? There are plenty of reasons.

With Speaker Joe Straus (R-San Antonio) retiring, the first order of business when the next legislature convenes in January 2019 will be to elect a new speaker. Will members choose a leader who, like Straus, works to increase public education funding and defend kids and classrooms against harmful legislation proposed by the lieutenant governor? Or will they choose someone who will lower the gates to vouchers bills and declare open season on educators? The runoffs will certainly make an impact on that vote.

How much so? According to election news website txelects.com, organizations devoted to defunding and privatizing public schools have spent more than a million dollars fighting public education allies in runoff races. These groups accounted for more than a third of the $3.3 million total raised by all candidates in the Republican runoffs. Would you spend a million dollars if you didn’t think you’d get something in return?

Now you see why it’s more important than ever that you vote in the runoff elections underway now. If you voted in the 2018 Primary Elections, then you’re eligible to vote in the runoff for whatever party you voted with back in March. If you didn’t vote in the March primaries, that’s okay! You can vote in whichever party’s runoff election you like!
