SBOE begins November meeting

The State Board of Education (SBOE) met Tuesday to undertake work sessions on school finance and new textbooks. After spending the morning reviewing the history and operation of the Permanent School Fund (PSF), the board began the afternoon with an update from Texas Education Agency (TEA) Commissioner Mike Morath.

“The work related to Hurricane Harvey is ongoing,” Morath told the board. The commissioner drew the board’s attention to rule changes initiated by the State Board for Educator Certification (SBEC) that are tied to the state’s “grow your own” strategy to recruit more highly skilled teachers.

“There is increasing strain on school systems and their ability to hire teachers,” said Morath, who added the strain is most acutely felt in rural settings. The commissioner explained that there are students in schools throughout the state who are thinking of becoming doctors and lawyers. Morath then posed the question: Are we creating incentives and pathways for them to become teachers?

The SBEC rule changes subject to the board’s approval this week are aimed to help schools that offer CTE courses in the field of teaching as part of the “grow your own” strategy. The rule change would allow districts to place any teacher, regardless of their certification area, in charge of “Ready, Set, Teach” courses.

The commissioner also updated the board on improvements to the agency’s STAAR report card at www.TexasAssessment.com. Following the commissioner’s presentation, the board turned its attention to Proclamation 2018. The board voted to extend the deadline by two weeks for Kendall Hunt, a publisher that was unable to meet the published deadline as a result of the flooding caused by Hurricane Harvey.

Board members returned Wednesday to tackle a lengthy agenda. The board declined to add a Mexican-American studies textbook to the list of approved instructional materials. The board adopted changes to correct inconsistencies in the Texas Essential Knowledge and Skills (TEKS) for Career and Technical Education (CTE).

Members next turned their attention to changes to graduation requirements made by legislation passed by the 85th Texas Legislature. The board approved rule changes to align with legislation that eliminates sequencing requirements for advanced mathematics and English courses. The board debated at length how certain computer science courses could satisfy graduation requirements for languages other than English (LOTE) and/or advanced mathematics. Members cast a preliminary vote to allow courses to satisfy both requirements, while counting as a single course credit.

The board also considered rules regarding International Baccalaureate (IB) courses, and received an update following previously-adopted changes to the TEKS review process. After receiving many volunteers to serve in TEKS review work groups, TEA staff indicated more volunteers are needed for elementary-level panels.

SBOE begins June meeting with A-F update

The State Board of Education (SBOE) met Tuesday for its June session, during which the 15 members will continue work on the Texas Essential Knowledge and Skills (TEKS) for English Language Arts and Reading (ELAR) and Spanish Language Arts and Reading (SLAR) and English as a Second Language (ESL). The board is also scheduled to discuss changes to the TEKS review schedule and appoint members to a Long-Range Plan Steering Committee.

Tuesday began with an update from Texas Education Agency (TEA) commissioner Mike Morath, who reported the spring testing cycle was completed with satisfactory results. After encountering issues with scoring and test delivery in 2016, Morath stated, “All the problems with last year were resolved.”

A result of testing this year and a one-year effort to redesign the Confidential Student Report (CSR) is the new STAAR report card. The new report card goes beyond numerical results to include more information, context and terms that are easier to understand. More information on the new STAAR report card can be found on the TEA website.

The commissioner also provided a brief summary of changes to the “A through F” accountability system passed during the regular session of the 85th Texas Legislature as part of House Bill (HB) 22. The legislature compressed the system to three domains: Student achievement, school progress and closing the gaps.

The student achievement domain will primarily rely on test data to calculate student performance. Under the school progress domain, the same test data will be used to determine how much students gain year over year and how schools compare to other schools with similar levels of poverty. The closing the gaps domain will focus on identifying whether certain student groups are struggling, relative to the campus. The student achievement and school progress domains will be combined for a single “best of” score, which will be weighted against the closing the gaps domain to calculate the overall or “summative” score.

The agency will focus on outreach to stakeholders through December, and the first district-level ratings under the new system will be issued in August 2018. At that time, campus-level ratings will still be either “met standard” or “improvement required.” All campuses are scheduled to receive a “what if” report using the A through F system on January 1, 2019. Official campus-level A through F ratings will be issued in August 2019, at which time a local accountability plan framework will also be rolled out.

Districts using a local accountability plan must continue to use the three state domains, but may add as many additional domains as they like and come up with an independent formula for calculating a summative score. Only schools that have not scored a “D” or an “F” will be able to participate, and local accountability plans will be vetted through a “peer-review” process.

Under HB 22, attendance rates have been removed from the accountability system, fixing problem identifying by many elementary and middle schools. A task force has been commissioned to look at incorporating extracurricular activities, which is expected to be a five-year process.

Member Keven Ellis (R-Lufkin) asked about the effects of Senate Bill (SB) 1784, which promotes the use of “open-source instructional materials.” These materials are currently licensed through the state procurement process, which already includes accessibility requirements. Morath said the agency plans to make the process more similar to the proclamation process used by the SBOE for textbook vendors.

The board received an update from TEA staff on other bills passed during the legislative session. The agency is currently tasked with implementing 145 pieces of legislation passed by lawmakers of the 85th Texas Legislature.

The board proposed eight legislative recommendations, of which five were successfully carried out. Lawmakers expanded SBOE authority over approving instructional materials to consider suitability for subject and grade level, with an additional requirement that it be reviewed by academic experts. Member David Bradley (R-Beaumont) noted that the legislature provided no guidance regarding the definition of “suitability” and “expert,” though staff pointed out that a definition of expert already exists in agency rule.

The legislature did not allocate any funds for the long-range plan, nor did it appropriate money to increase TEA staffing in the curriculum division, which oversees and supports TEKS review and implementation. The legislature did approve a $5 million rider for data privacy and other items, as well as a $25 million rider to allow districts to access federal matching funds for the E-Rate Infrastructure Program.

Lawmakers passed SB 160, which prohibits the agency from adopting or implementing a performance indicator in any agency monitoring system that solely measure the number or percentage of students who receive special education services. This legislation was passed as a result of an investigative series by the Houston Chronicle that uncovered a de facto cap on special education enrollment.

Finally, the board recommended lawmakers conserve public free schools and prohibit public dollars from going to private schools or parents/guardians. Despite attempts by the Texas Senate to pass a voucher bill, the Texas House stood strong and prevented the passage of any private school voucher legislation. However, Gov. Greg Abbott has announced he will include vouchers on the call for a July special session. Noting that voucher proponents had focused on special needs vouchers during the regular session, Member Marty Rowley (R-Amarillo) asked what a special needs voucher would look like. Staff indicated the governor specifically mentioned HB 1335 by state Rep. Ron Simmons (R-Carrollton).

The board spent the latter half of Tuesday resuming their work on ELAR/SLAR and ELL high school TEKS. On Wednesday, the board is scheduled to discuss the broader TEKS review schedule.

Graduation committees advance in House hearing

The House Public Education Committee met Tuesday morning to consider a large agenda of Senate bills as the session winds down. The committee also approved the following bills Tuesday evening:

  • CSSB 463, which was heard earlier in the day. The bill would extend individual graduation committees (IGCs) through 2019.
  • SB 436, the Senate companion to HB 4226, which would require meetings of the Special Education Continuing Advisory Committee to be conducted in compliance with open meetings laws.
  • CSSB 529, the Senate companion to HB 2209, which would incorporate “universal design for learning” into the required training for all classroom teachers.
  • SB 585, the Senate companion to HB 545, which would require principals to allow “patriotic societies” such as Boy Scouts to speak to students about membership at the beginning of the school year.
  • SB 748, the Senate companion to HB 4027, which would add additional guidelines to the transition plan for special education students preparing to leave the public school system.
  • CSSB 1481, the Senate companion to HB 4140, which would rename the instructional materials allotment (IMA) the “instructional materials and technology allotment” and require districts to consider “open education resources” before purchasing instructional materials.
  • SB 1942, the Senate companion to HB 1692, which would allow a licensed handgun owner to store a firearm in a vehicle parked in the parking lot of a public school, open-enrollment charter school or private school. State Reps. Alma Allen (D-Houston) and Joe Deshotel (D-Beaumont) voted against the bill.
  • SB 2080, the Senate companion to HB 69, which would require each school district and open-enrollment charter school to include in the Public Education Information Management System (PEIMS) report the number of children with disabilities residing in a residential facility who are required to be tracked by the Residential Facility Monitoring (RFM) System and are receiving educational services from the district or school.

The meeting began with SB 1566 by state Sen. Lois Kolkhorst (R-Brenham), which would hand broad powers to local school boards to compel the testimony of district officials and obtain district documents. It would also require the Texas Education Agency (TEA) develop a website for boards to review campus and district academic achievement data.

SB 2131 by state Sen. Royce West (D-Dallas) would add requirements to counseling regarding postsecondary education, encouraging a focus on dual credit programs. ATPE supports this bill.

SB 1294 by state Sen. Dawn Buckingham (R-Lakeway) would prohibit “exclusive consultation,” ensuring that educators on campus-level advisory committees do not all belong to a single professional association. ATPE supports this bill.

SB 1660 by Sen. Taylor would allow districts to choose between using either minutes or days to calculate operation. According to the fiscal note, SB 1660 could cost the state $1.7 million through the biennium ending August 31, 2019.

SB 195 by state Sen. Sylvia Garcia (D-Houston) would allow additional transportation allotment funding to districts with children living within the two mile zone who are at a high risk of violence if they walk to school. In the fiscal note, the Legislative Budget Board indicated that there is insufficient data regarding the number of students who are at risk of violence to be able to calculate a fiscal impact. ATPE supports this bill.

SB 1854 by state Sen. Carlos Uresti (D-San Antonio) would require district-level committees to review paperwork requirements annually and recommend to the board of trustees instructional tasks that can be transferred to non-instructional staff. ATPE supports this bill.

SB 384 by state Sen. Konni Burton (R-Colleyville) would give the State Board of Education (SBOE) flexibility in scheduling end-of-course exams to avoid conflicts with AP/IB national tests.

SB 1883 by Sen. Campbell would modify the approval process for charter applicants and the review of charter operators. ATPE opposes the bill because the removal of elected officials from the charter school process is irresponsible. Adding unnecessary new appeal and review opportunities for charters only creates administrative bloat.

SB 1005 by state Sen. Donna Campbell (R-New Braunfels) would allow the use of the SAT or the ACT as a secondary exit-level assessment instrument to allow certain public school students to receive a high school diploma. The fiscal note estimates an annual cost of $2 million per year.

SB 1839 by state Sen. Bryan Hughes (R-Mineola) would create a certification for early childhood through grade three, and would grant the commissioner authority to set reciprocity rules regarding the ability of teachers from outside the state to obtain a certificate in Texas. ATPE believes that the State Board for Educator Certification (SBEC), as the official state body charged with the oversight of educator standards, is the more appropriate authority to set these rules.

SB 2270 by Sen. Lucio would create a pilot program in ESC Region 1 to provide additional pre-K funding for low-income students.

SB 1784 by Sen. Taylor would encourage the use of “open-source instructional materials.”

SB 2188 by Sen. Taylor would specify that a student who is 18 or older in an off home campus instructional arrangement is a full-time student if they receive 20 hours of contact a week. Part-time would be defined as between 10 and 20 contact hours per week. According to the fiscal note, SB 2188 would cost roughly $7 million through the next biennium. ATPE supports this bill.

SB 463 by state Sen. Kel Seliger (R-Amarillo) would extend individual graduation committees (IGCs) to 2019 and order the Texas Higher Education Coordinating Board to compile a report tracking the progress of IGC graduates. ATPE supports this bill.

SB 2039 by state Sen. Judith Zaffirini (D-Laredo) would develop instructional modules and training for public schools on the prevention of sexual abuse and sex trafficking. ATPE supports this bill.

SB 1483 by Sen. Taylor would establish a grant program to implement a technology lending program to provide students with electronic instructional materials. The program would be funded through instructional materials fund. The fiscal note anticipates no additional cost, but indicated the commissioner could use up to $25 million of existing funds from the instructional materials fund each biennium.

SB 1398 by Sen. Lucio makes lots of clarifying and limiting changes to the classroom video camera law. Among them, the bill would require requests in writing and only require equipment in classrooms or settings in which the child is in regular attendance or to which the staff member is assigned.

SB 1122 by state Sen. Donald Huffines (R-Dallas) would create a mechanism to abolish Dallas County Schools, one of two remaining county school districts in the state, which primarily provides transportation services to multiple independent school districts in the Dallas area.

SB 1886 by state Sen. Paul Bettencourt (R-Houston) would create an office of the inspector general at TEA appointed by the commissioner to prevent and detect criminal activity in districts, charter schools, and education service centers (ESCs). The bill would allow the new TEA inspector general to issue subpoenas in order to secure evidence.

SB 490 by state Sen. Eddie Lucio, Jr. (D-Brownsville) would require a report on the number of school counselors at each campus. ATPE supports this bill.

SB 1484 by Sen. Taylor would create a web portal and instructional materials repository to assist schools in selecting open education resources. The bill provides for a third party to provide independent analysis regarding TEKS alignment. According to the fiscal note, SB 1484 would not require additional state funding, but would result in an additional cost of $1.85 million in fiscal year 2018 and $450,000 in subsequent years that would be paid from existing instructional materials funding.

SB 1658 by Sen. Taylor would make changes to laws regarding the ownership, sale, lease, and disposition of property and management of assets of an open-enrollment charter school.

SB 2078 by Sen. Taylor would require TEA develop a model multi-hazard emergency operations plan and create a cycle of review. The fiscal note anticipates a fiscal impact of roughly $215,000 per year.

SB 2144 by Sen. Taylor would create a commission to recommend improvements to the public school finance system. ATPE supports this bill.

Teach the Vote’s Week in Review: April 21, 2017

Here’s a look at this week’s education news highlights from the ATPE lobby team:


Falling US MoneyThe Texas House of Representatives this week passed a comprehensive school finance bill, House Bill (HB) 21 by Rep. Dan Huberty (R-Kingwood), who chairs the House Public Education Committee. HB 21 is the House’s opening salvo in what the bill’s author calls a multi-session school finance reform effort. The bill is now on its way to the Senate where it is expected to receive a less than certain reception.

HB 21 picked up 10 floor amendments over the course of more than four hours of debate on Wednesday evening. The bill was approved on second reading by a vote of 134 to 16, and then the House passed HB 21 the following day on third reading by a vote of 132 to 15. Stay tuned later this week for a blog post by ATPE Lobbyist Monty Exter describing the details of the bill as approved by the House.

The next steps will be for HB 21 to be accepted by the Senate and referred to the Senate Education Committee, where we hope that Chairman Larry Taylor (R-Friendswood) will schedule it for a public hearing. Taylor’s committee heard his own school finance bill this week, Senate Bill (SB) 2145. A hearing on HB 21 would likely include a discussion of the differences and merits of the two school finance plans.

 


SBOE logoThe State Board of Education (SBOE) has been meeting this week, also. As ATPE Lobbyist Mark Wiggins wrote for our blog earlier this week, the board’s agenda includes high-profile reviews of some of the state’s curriculum standards, known as the Texas Essential Knowledge and Skills (TEKS).

This morning, the board held a final vote on proposed changes to the TEKS for science. The biology portion in particular has been the focus of debate over the discussion of evolution. Board members began the week seeking compromise language that would satisfy scientists as well as those wishing to allow for some discussion of creationism.

The board voted down an amendment this morning by member SBOE Marisa Perez-Diaz (D-San Antonio) that would have instructed teachers to “compare and contrast prokaryotic and eukaryotic cells, including scientific explanations for their complexity.” The board then adopted an amendment by SBOE member Keven Ellis (R-Lufkin) instructing teachers “to compare and contrast prokaryotic and eukaryotic cells, and compare and contrast scientific explanations for cellular complexity.” SBOE member Barbara Cargill (R-The Woodlands) assured the board that the compromise language still encourages criticism of the theory of evolution.

On revisions to the TEKS for English and Spanish language arts and reading, the board has opted to delay a final vote until May. For more on this week’s SBOE deliberations, check out the latest update from ATPE Lobbyist Mark Wiggins here on our blog.

 


The two legislative committees that oversee education policy for the Texas House and Senate have been busy hearing numerous bills and voting a number of them through for floor consideration.

Yesterday, the Senate Education Committee heard bills that included such topics as charter school authorizations and educator certification. As ATPE Lobbyist Kate Kuhlmann reported on our blog, the committee heard both a bill that could restrict the expansion of charter schools in certain areas and a bill that would make it easier for charters to be approved. The committee also considered an educator certification bill that would make it easier for out-of-state teachers to become certified in Texas without necessarily passing an exam.

As ATPE Lobbyist Kate Kuhlmann reported on Twitter, the Senate Education Committee also voted yesterday to give favorable approval to several Senate bills, many of which have been changed from their original versions that were filed: SB 653, SB 754, SB 1122, SB 1267, SB 1398, SB 1882, SB 2142, SB 2143, SB 2188, and SB 2270.

The House Public Education Committee held a full hearing for several bills on Tuesday and then met again yesterday for the purpose of voting on pending bills. As ATPE Lobbyist Mark Wiggins wrote for our blog, Tuesday’s agenda included hearing HB 306, known as David’s Law, to prevent cyber-bullying and harassment that encourages youths to commit suicide. ATPE testified in support of the bill, as we similarly supported the Senate version, SB 179, during a prior hearing by the Senate State Affairs Committee. Read Mark’s blog post for more on the bills that were heard and voted upon by the committee on Tuesday. During Thursday’s formal meeting of the same committee, members voted to send 11 additional bills to the full House for consideration. Next week, the House Public Education Committee is scheduled to meet again on Tuesday for consideration of several bills. The agenda includes bills pertaining to testing, instructional materials, pre-K, and Districts of Innovation. ThinkstockPhotos-462761867Both the House and Senate have announced which of their members will serve on a conference committee for the state’s budget bill. The two chambers recently passed competing versions of Senate Bill (SB) 1, which necessitates a conference committee of 10 members to try to iron out the differences and forge a compromise to keep the government in operation for two more years and avoid the need for a special session.

Announced first this week were the Senate conferees for SB 1: Senate Finance Committee Chairwoman Jane Nelson (R-Flower Mound), along with Sens. Lois Kolkhorst (R-Brenham), Joan Huffman (R-Houston), Charles Schwertner (R-Georgetown), and Juan “Chuy” Hinojosa (D-McAllen). On the House side, the conference committee appointees are House Appropriations Chairman John Zerwas (R-Fulshear), plus Reps. Trent Ashby (R-Lufkin), Oscar Longoria (D-Mission), Sarah Davis (R-Houston), and Larry Gonzales (R-Round Rock).

 


Football RefereeAlso this week, the Senate approved a measure known as the Tim Tebow bill, which requires the University Interscholastic League (UIL) to allow the participation of home-schooled students. SB 640 by Sen. Van Taylor (R-Plano) received the Senate’s approval on Wednesday by a vote of 23 to 8. The bill still has to be considered in the House.

ATPE has opposed SB 640 and similar legislation in previous sessions based on long-standing positions in the ATPE Legislative Program adopted each year by our members. Specifically, ATPE members object to letting home-schooled students participate in extracurricular activities without being held to the same standards as their public school counterparts, such as no pass/no play laws.

State Board of Education takes up science, language arts TEKS

The State Board of Education is meeting this week while the Texas Legislature is session. Across the street from the Capitol inside the Texas Education Agency (TEA) building, the board began its week-long meeting Tuesday morning with public testimony on proposed changes to the science TEKS.

Some creationism supporters took issue with the changes proposed after first reading earlier this year. Biology teachers on the curriculum writing committee have proposed changes they explained would streamline the TEKS and focus on grade-level appropriate discussion. Creationism supporters argued Tuesday that the changes watered down criticism of evolution, and asked the board to retain proposed language to require students to “evaluate” various subjects related to evolution. Physics and chemistry teachers also recommended more mundane tweaks to their respective TEKS.

Wednesday began with an update from TEA Commissioner Mike Morath. The commissioner informed the board of upcoming changes to the STAAR confidential student report card (CSR), aimed to make the report more parent-friendly and easy to understand. The report will now contain student lexile levels for the current year and over a student’s academic history. The report will include information for parents regarding how to help improve a child’s reading level, as well as guidance regarding how to maximize the impact of parent-teacher conferences. The agency has also changed terminology to replace the terms for Level I through Level III standards with “does not meet grade level,” “approaching grade level,” “meets grade level,” and “masters grade level.” These changes have already been adopted in rule and will be reflected in report cards due out in June.

Commissioner Morath also announced TEA is readying a new website that will allow parents to see every STAAR question their student was asked, along with what they answered and what other students answered, compared to the correct answer. This website is expected to roll out in mid- to late June. The agency is also working on a separate site for teachers and administrators. The separate website would help teachers and administrators unpack and understand the streamlined English Language Arts and Reading (ELAR) TEKS. The site will feature sample assessment questions and is intended to help teachers understand vertical and horizontal alignment of curriculum standards, as well as distinguish the meaning of verbs used in the TEKS insofar as how they affect instruction. The agency plans to activate the site in advance of the school year in which the TEKS are scheduled to go into effect.

The commissioner responded to questions from the board regarding the rollout of the “A through F” accountability standards passed by the Texas Legislature last session. House Bill 22, which would pare down the five domains to three and eliminate the overall grade, has passed out of the House Public Education Committee this session and is expected to be up for debate on the House floor within the next two to three weeks. At this point, Morath indicated he has participated in at least 70 stakeholder meetings regarding rulemaking for the version of A through F currently undergoing implementation. Some changes have been suggested to specific components, such as the calculation of chronic absenteeism at the elementary level and adjustments for children of military families and those who are absent due to illness.

As far as legislative priorities, both the House and Senate budget proposals include $25 million requested by the agency to access matching funds for rural broadband internet. Other priorities for which TEA is seeking funding in either one or both chambers include math innovation zones, high-quality pre-K, additional staff to investigate inappropriate student-teacher relationships, IT support for the Texas Student Data System (TSDS) to facilitate additional automation, cybersecurity enhancements to safeguard student data and funding to allow the STAAR test to be released annually as opposed to every three years.

On Wednesday, the board resumed discussion on second reading of the science TEKS. After hearing testimony the day before, the board unanimously adopted an amendment adding compromise language to a key section of the biology TEKS dealing with evolution. The amendment changed “evaluate” to “examine” scientific explanations for the origin of DNA. The board also adopted an amendment that would delay implementation of the streamlined science TEKS to the beginning of the 2018-19 school year. The board completed discussion of English and Spanish Language Arts and Reading TEKS for elementary and middle school Wednesday evening, approving amendments on second reading before adjourning.

Breaking up into committees Thursday morning, the board’s committee on School Finance and the Permanent School Fund (PSF) heard an update to the bond guarantee program (BGP). As of February 28, roughly $70 billion of the program’s $100 billion capacity had been allocated. After setting aside $5 billion as required, roughly $24 billion remained available to back school bonds with the PSF. Last year, the board voted to increase the multiplier used to calculate the amount available to charter schools, which resulted in increasing that amount from $165 million to $510 million.

Committee chair David Bradley (R-Beaumont) questioned staff regarding HB 3438 by state Rep. Linda Koop (R-Dallas), which would use the PSF to guarantee school lease-purchase agreements through the Texas Public Finance Authority (TPFA). Staff advised that current law likely allows for the PSF to be encumbered to guarantee short-term commercial debt, and debt under this program would likely be cumbersome on the TPFA. The bill was voted out of the House Public Education Committee during a formal hearing Thursday afternoon at the Texas Capitol.

After Thursday’s committee meetings, SBOE’s committee of the full board gathered to take up discussion of the English and Spanish Language Arts and English as a Second Language TEKS for high school on first reading.

On Thursday, April 13, the Texas House Select Committee on State and Federal Power and Responsibility heard testimony about Social Security offsets in federal law that negatively affect many educators. The hearing was on HCR 101 by Rep. Abel Herrero (D-Corpus Christi) urging Congress to repeal the Government Pension Offset (GPO) and the Windfall Elimination Provision (WEP) of the Social Security Act. Learn more about the offsets in current law and how they affect educators here. Although the Texas Legislature does not have the authority to change federal laws, such as those governing Social Security, the measure would be a statement of support from Texas lawmakers for changing the GPO and WEP, which both have the effect of reducing many educators’ benefits. ATPE Lobbyist Monty Exter was among the witnesses who testified for the bill, which was left pending.

 


Last legislative session, ATPE supported a bill by Sen. Kel Seliger (R-Amarillo) to create alternative pathways for eligible students to graduate without necessarily having passed all required STAAR tests. The law allowing for individual graduation committees to evaluate students’ post-secondary readiness is set to expire on Sept. 1 of this year unless extended. A number of bills have been filed this session to remove the expiration date on the law, including Sen. Seliger’s Senate Bill (SB) 463, which the Senate Education Committee heard this week. Girl showing bank notesNext week in the Texas Legislature, the House of Representatives has scheduled a floor debate for Wednesday, April 19, on House Bill (HB) 21. That’s the high-profile school finance reform bill by Rep. Dan Huberty (R-Kingwood) that we’ve written about here on our blog. The Senate Education Committee is also hearing a number of bills dealing with school finance during its next hearing on Tuesday, April 18.

Over in the House Public Education Committee, next Tuesday’s meeting will cover proposed legislation on broad topics ranging from curriculum standards to UIL. The House committee will also consider HB 306 by Rep. Ina Minjarez (D-San Antonio), a companion bill to SB 179 that would create “David’s Law” aimed at curbing cyberbullying and harassment that leads to suicide. ATPE offered support for the Senate version of the bill during a Senate State Affairs Committee hearing last week.

The State Board of Education (SBOE) is also meeting next week. Its four-day meeting begins Tuesday and will feature testimony and discussions of proposed changes to the Texas Essential Knowledge and Skills for science and English language arts and reading. House Public Education reviews grab bag of school bills

The House Public Education Committee met Tuesday to consider a score of bills touching a variety of subjects. Chairman Dan Huberty (R-Houston) began the hearing by referring the following bills to the Subcommittee on Educator Quality, chaired by Rep. Ken King (R-Canadian): HB 49, HB 218, HB 331, HB 333, HB 460, HB 816, HB 972, HB 1255, HB 1403, HB 1469 and HB 1485.

The day’s testimony began with HB 1291 by state Rep. Charlie Geren (R-Fort Worth), which would add “American principles” to the Texas Essential Knowledge and Skills (TEKS). The TEKS would include the study of the Founding Fathers of the United States, the Declaration of Independence, the United States Constitution, the Bill of Rights, and the Federalist Papers. ATPE supports this bill.

HB 639 by state Rep. Charles “Doc” Anderson (R-Waco) would authorize districts to obtain health benefit plan, liability or auto insurance for partner businesses and students participating in CTE programs. Anderson suggested insurance is important in the event of accidents related to CTE instruction.

HB 1645 by state Rep. J.M. Lozano (R-Kingsville) would require school districts that offer varsity letters to adopt a policy that allows students to earn a letter for participating in a Special Olympics event. ATPE supports this bill.

HB 69 by state Rep. Ryan Guillen (D-Rio Grande City) would require each school district and open-enrollment charter school to include in the Public Education Information Management System (PEIMS) report the number of children with disabilities residing in a residential facility who are required to be tracked by the Residential Facility Monitoring (RFM) System and are receiving educational services from the district or school.

HB 264 by state Rep. Ana Hernandez (D-Houston) would require TEA to continue until 2020 providing outreach materials to districts required under Section 28.015, Education Code, regarding public school curriculum changes under House Bill 5, which passed in 2013. The section includes explanations of the basic career and college readiness components of each endorsement, requirements to gain automatic college admission, and financial aid requirements for the TEXAS grant and the Texas Educational Opportunity Grant Program. The section is currently set to expire September 1, 2018.

HB 452 by state Rep. Joe Moody (D-El Paso) would require report cards to include the number of students in each class. ATPE supports this bill.

HB 728 by state Rep. Bobby Guerra (D-Mission) would create an advanced computer science program that would satisfy the curriculum requirements for a third math or science credit.

HB 1270 by state Rep. John Smithee (R-Amarillo) would allow schools to excuse student absences for the purpose of visiting a military recruitment center. A similar provision currently allows for excused absences to visit a college or university campus.

HB 136 by state Rep. Cecil Bell (R-Magnolia) would include a CTE objective under the public education objectives enumerated in Section 4.001(b), Education Code. The text would read, “Objective 11: The State Board of Education, the agency, and the commissioner shall assist school districts and charter schools in providing career and technology education and effective workforce training opportunities to students.”

HB 1389 by state Rep. Helen Giddings (D-Dallas) would include prekindergarten in the 22-student class size limit currently in effect for kindergarten through grade four. The bill would result in smaller class sizes for schools that are currently over the limit, but would not carry a significant fiscal impact to the state budget. ATPE supports this bill.

HB 710 by state Rep. Gene Wu (D-Houston) would extend free half-day prekindergarten to full-day for the same set of eligible students. Research has shown early childhood education improves student learning through the elementary grades, leading to improved educational outcomes overall. According to the fiscal note, the change would cost $1.6 billion over the 2018-2019 biennium. ATPE supports this bill.

HB 620 by state Rep. Jeff Leach (R-Plano) would allow districts the option of moving the school start date to the second Monday in August, up from the fourth, and require instruction time measured in minutes, as opposed to days. This would allow districts more flexibility in scheduling, provide additional time to prepare for first semester assessments, and allow for earlier summer release. No fiscal impact to the state is anticipated. ATPE lobbyist Monty Exter testified in support of the bill, pointing out that current restrictions can be burdensome when it comes to predictably and adequately allocating instruction time.

HB 729 by state Rep. Dwayne Bohac (R-Houston) would integrate character traits instruction into the TEKS, and require a center for education research to study the effects of character traits instruction on student attendance and disciplinary problems. Bohac suggested emphasizing positive character traits would improve school performance overall. ATPE lobbyist Monty Exter testified in favor of the bill, noting that statewide standards would eliminate the patchwork implementation of character traits instruction.

HB 404 by state Rep. Rafael Anchia (D-Dallas) would create higher education curriculum review teams charged with reviewing changes to the TEKS. Currently, the State Board of Education (SBOE) appoints TEKS review committees composed largely of K-12 teachers, as well as up to seven “experts” as defined by board rules. This bill would define a process and expert panel with at least five years of higher education teaching experience in the relevant subject or a doctorate in education. The panel would be selected the Higher Education Coordinating Board and higher education commissioner, which would insulate the experts from the appearance of political influence. The bill would also protect the panel’s recommendations by setting a two-thirds vote threshold for SBOE.

Rep. Anchia described the bill as “a work in progress.” ATPE lobbyist Mark Wiggins testified in favor of the bill, and advocated for ensuring that K-12 educators have a meaningful impact on the process as well. Recently, SBOE has taken steps to improve its TEKS review process, and ATPE supports a collaborative effort to codify improvements in statute in order to ensure the success of future reviews.

HB 539 by state Rep. Gary VanDeaver (R-New Boston) would allow the children of military service members to enroll full-time in the state virtual school network. According to TEA, roughly 12,000 students, about 0.3 percent of the state’s total enrollment, are currently enrolled in the virtual school network. Approximately 63,500 military dependents are enrolled in grades three through twelve. The Legislative Budget Board assumes 0.5 percent, or 318 students, would enroll in the virtual school network. Based on that, the fiscal note assumes the change would cost an additional $5.3 million – which Chairman Huberty and Rep. Morgan Meyer (R-Highland Park) disputed, suggesting the expense was overstated.

HB 367 by Vice-Chairman Diego Bernal (D-San Antonio) would expressly allow schools to donate surplus unserved cafeteria food to hungry children on campus through a third-party non-profit. Some schools already do this, but this bill would guarantee that right in statute and give rulemaking authority to the commissioner of education. No significant fiscal implication to the state is anticipated.

HB 357 by Chairman Huberty would extend free prekindergarten eligibility to the children of anyone eligible for the Star of Texas Award for police, firefighters and emergency medical first responders killed or seriously injured in the line of duty. According to the fiscal note, no significant impact on the budget is expected. ATPE supports this bill.

All those bills were left pending.

The board unanimously approved HB 223 by state Rep. Donna Howard (D-Austin), which would provide districts the option of providing childcare services or assistance with childcare expenses to students at risk of dropping out through the existing compensatory education allotment. Since the allotment provides a set amount of funding, the change would not fiscally impact the state. The bill will head to the House floor next.

The committee also resumed consideration of HB 21, House leadership’s priority school finance bill that would add $1.6 billion to public education. Huberty warned that without HB 21, the budget would effectively fund $140 less per pupil and there would be no plan for dealing with the expiration of ASATR.

Noting he has had numerous meetings with stakeholders, Huberty suggested hardship grants for districts losing ASATR could be stair-stepped. Additional transportation funding could be capped at five percent of the total spend, Chapter 41 districts at 15 percent and ASATR at 80 percent, or $100 million in 2018 and $60 million in 2019. Discussing whether lawmakers should offer more or less flexibility regarding grant fund allocation, TEA recommended erring on the side of being more prescriptive in order to provide clear direction.

For the 327 school districts whose property taxes are maxed out at $1.17, the committee entertained testimony suggesting raising the yield on “copper pennies.” It’s important to note that the more the state spends on public education in general, the less school districts will be forced to rely on local homeowners for funding. In other words, real property tax relief – not the bumper sticker kind, but meaningful relief – begins with putting more state money into public education.

Concluding the hearing, Chairman Huberty signaled his intent to vote on a committee substitute at next Tuesday’s hearing. That meeting will focus on bills dealing with public school accountability, including “A though F.”

House Public Education Committee convenes first meeting

The House Public Education Committee met at the Texas State Capitol on Feb. 21, 2017. The committee heard invited testimony only.

The House Public Education Committee held its first meeting of the 2017 legislative session today, Feb. 21. Newly-appointed chair Rep. Dan Huberty (R-Kingwood) began the hearing by appointing state Rep. Ken King (R-Canadian) chair of the Subcommittee on Educator Quality, where he is joined by Rep. Alma Allen (D-Houston) as vice-chair and Reps. Harold Dutton (D-Houston), Morgan Meyer (R-Dallas), and Gary VanDeaver (R-New Boston).

Chairman Huberty kicked off the hearing by noting the committee’s efforts to address school finance during the interim. After the Texas Supreme Court ruled the current system “lawful but awful,” according to Huberty, the committee spent much of 2016 working on fixes under the leadership of then-outgoing Public Education Committee chair Jimmie Don Aycock (R-Killeen) and Appropriations chair John Otto (R-Dayton).

Notably, Huberty vowed the committee would get to work on school finance early, and suggested the topic would be the focus of hearings during the next two to three weeks.

Texas Education Agency (TEA) Commissioner Mike Morath briefed the committee on agency operations and priorities. The agency currently serves roughly 5.3 million students and oversees $56 billion in funds. About 348,000 teachers are employed across 8,685 campuses. Texas boasts an 88 percent high school graduation rate, despite serving a student body that is almost 60 percent economically disadvantaged.

Morath highlighted a brief list of priority initiatives, including an agency “lesson study” initiative – a professional development tool used to develop best approaches to individual Texas Essential Knowledge and Skills (TEKS) components – as well as high-quality pre-kindergarten, math innovation zones, and rolling out the “A through F” accountability system.

Chairman Huberty pressed the commissioner on several areas of recent interest, beginning with informal “caps” on special education enrollment unveiled by a Houston Chronicle investigation. Morath told the chairman the special education performance indicator at issue had “outlived its usefulness.” House Bill 363 filed this session by Huberty would require TEA to cease using the indicator. Morath assured the chair, “If for some reason it doesn’t pass, we’re going to do it anyway.”

Chairman Huberty also asked the commissioner about TEA’s interaction with testing vendor Educational Testing Service (ETS) over faulty STAAR tests. Morath said the agency has imposed financial penalties on ETS. Continuing on the testing subject, Huberty prodded Morath on efforts to shorten the STAAR test as required by Huberty’s House Bill 743 from the 2015 legislative session. Morath indicated the process of creating a shorter test has cost the agency more than anticipated, and teachers may not have been provided adequate practice time with testing changes.

In response to Huberty’s inquiry regarding Districts of Innovation (DOI), Commissioner Morath testified that 105 districts have applied for DOI status thus far. According to the commissioner, the most popular exemptions are from teacher certification requirements, the first day of instruction, and class-size limits.

With regard to charter schools, Morath told the committee the state currently hosts 178 public charter entities, which operate a total of 603 campuses and serve roughly 245,000 students – about five percent of the total student population. A total of 22 entities have had their charters revoked, and seven have been non-renewed.

Chairman Huberty pointed out the state has not reached the charter cap and is not in danger of doing so. Rep. VanDeaver, a former superintendent, noted that in districts forced to pay recapture such as Houston ISD, the state pays more to educate a student in a charter school than in a public school.

Finally, the committee received a briefing from Comal ISD Superintendent Andrew Kim, who chaired the Texas Commission on Next Generation Assessments and Accountability. The 15-member commission was convened as a result of House Bill 2804 in 2015, and delivered a report to the legislature in August 2016, which included nine final recommendations for new systems of student assessment and public school accountability. Chairman Huberty concluded today’s hearing by announcing that the committee will begin school finance discussions at the next meeting. The committee will hear from school districts when it meets again next Tuesday, and school finance bills will be posted for hearing the following week. Once those bills are voted out, Huberty said the committee will take up accountability issues, including A through F.

SBOE Wrap-Up: November 2016

SBOE logoFriday, Nov. 18, wrapped up a busy November meeting of the State Board of Education (SBOE), which returned to Austin to tackle a wide range of subjects before the holiday break. Here’s a brief rundown of the week’s action.

Mexican-American Studies

The board said “no thanks” to a controversial Mexican-American studies textbook that sparked protests over factual errors and complaints regarding the way Mexican-Americans are characterized in the text. After a morning dominated by demonstrations and a press conference held by opponents of the textbook, the board denied approval and asked for more submissions of ethnic studies materials. TEKS in the Crosshairs

Wednesday’s agenda focused primarily on updates to the Texas Essential Knowledge and Skills (curriculum standards) for mathematics, science, English language arts, and reading. On the subject of math, board members heard exhaustive testimony regarding process standards, and whether less emphasis should be given to word problems and process questions both in the curriculum and on standardized tests. Members seemed to generally agree in a reduction in emphasis, but were concerned what the mathematics TEKS would be left with if process standards were done away with altogether.

The committee also heard reports from educator committees assigned to review the science TEKS in several areas, but most of the attention focused on biology. Reviewers recommended edits to the biology TEKS that included sections seen by some on the board as challenging the theory of evolution. In testimony, one biology teacher who sat on the review committee countered that the changes were made for streamlining purposes and preserved encouragement for instructors to engage in healthy debate of scientific theories. Bond Guarantees

On Thursday, the Committee on School Finance/Permanent School Fund delved into a question regarding the use of the fund to guarantee loans for new school buildings. When growing school districts want to build, for example, a new campus, they may not necessarily have the cash on hand to pay for it right away. To get things going, they can issue a bond – basically, a loan – which they can pay off, with interest, over time. Just like you, if a school district has better credit, it can get better financing and pay less interest, which can add up to millions of dollars for a big construction project. In order to get the best financing possible, public school districts with less-than-perfect credit can get the bond “guaranteed” by the $30 billion Texas Permanent School Fund (PSF). It’s a bit like your parents co-signing a loan: You get a better interest rate because they promise to pay the bank if you can’t keep up with your payments.

Dollar fanCharter schools can also take advantage of the Bond Guarantee Program, but on a limited basis. For qualifying charter holders, the amount available under the program is set by a capacity multiplier currently set at 3.25 percent. Charter holders complain the regime creates an annual rush to snap up limited resources. At Thursday’s hearing, they asked the committee to expand the multiplier to 3.5 percent, which would create several hundred million dollars in additional bond guarantees available to charters. Some on the board expressed concern over expanding the debt for which the PSF is liable to charters over which the state has less control. The board gave preliminary approval to raising the multiplier, while halting a related proposal by TEA staff to create additional academic criteria for charter holders to qualify for the program. “The board’s first priority should always be to protect the fund so that it continues to be available to guarantee new bonding for facilities for all Texas students,” Exter said. “We agree with the commissioner on enhancing academic requirements to access the bond guarantee program. Some board members have expressed concerns about expansion by charter holders who have not utilized their current capacity. ATPE encourages those members to continue to ask those sorts of questions.”

SBEC Rules

Friday wrapped with the board taking up several rule proposals sent to them from the State Board for Educator Certification (SBEC). All SBEC rules must undergo final review by the SBOE board, which can vote to reject and send back proposals or take no action — which has the effect of approving the proposals. Legislative Recommendations

The board also approved its 2017 legislative recommendations, which include a prohibition on vouchers, increased appropriations for TEA staff to adequately oversee and support the TEKS process, support for federal E-Rate support funding, an elimination of TEA’s arbitrary limit on students receiving special education services, and improved student data privacy, among others.

Farewells

This week’s SBOE meeting was the final one for two outgoing board members, Martha Dominguez (D) from SBOE District 1 and Thomas Ratliff (R) from SBOE District 9. Dominguez is an educator and current ATPE member; many of the board members referred to her as the heart or conscience of the board.

Ratliff, son of former Lt. Gov. Bill Ratliff, came onto the board eight years ago, after winning a primary election to replace the former board chair and a divisive figure in curriculum battles, Don McLeroy (R). During his tenure, Ratliff helped usher in one of the most productive and cooperative periods in the history of the SBOE.

Both of these members will be greatly missed, and ATPE thanks them for their service. After Dominguez and Ratliff decided not to run for re-election this year, their respective replacements were determined through this year’s elections to be Georgina Perez (D) and Keven Ellis (R). Perez and Ellis will begin their four-year terms in January

Teach the Vote’s Week in Review: Sept. 9, 2016

Happy Friday! Here are stories making education news in Texas this week:


Texas Commissioner of Education Mike Morath has adopted final rules to implement a 2015 law allowing for Districts of Innovation (DOIs), which are acceptably-rated school districts that opt to exempt themselves from some education-related laws in the Texas statutes. ATPE opposed the legislation last year granting school districts the right to those regulatory exemptions and allowing them to operate in a similar manner as charter schools. We submitted formal input to the commissioner on his proposed rules, urging for more safeguards to protect students, parents, and district staff from unforeseen and harmful consequences of broad exemptions.

One of ATPE’s foremost concerns about the DOI law was the potential for educators to lose their immunity protections in state law, particularly if a district opts to exempt itself from all available statutes under the new law as one large school district has already attempted to do. We are grateful that the commissioner and his staff listened to our concerns and added language to the final rules to prohibit districts from waiving educators’ immunity rights. While the DOI law remains highly problematic in many respects, the commissioner’s final rules will at least curtail the likelihood of costly litigation to determine what types of liability might attach to certain DOIs that have adopted blanket waivers.

Last week we reported that the Texas Commission on Next Generation Assessments and Accountability (TCONGAA) had finalized its report with recommendations to the Texas Legislature on testing and accountability. Today is the final day to submit comments on the U.S. Department of Education’s (ED) rules pertaining to assessment provisions under the Every Student Succeeds Act (ESSA). ATPE is pleased that a form of our previous input to Congress and ED is included in the rule proposal covering the newly created innovative assessment pilot.

As we state in our new round of comments submitted to ED, ATPE has encouraged policymakers to consider using “a scientifically valid sample of the student population to assess students and report disaggregated state-level data” in an effort to reduce “the time, emphasis, and expense placed on standardized testing.” The proposed rules will allow states to consider piloting a limited form of this testing structure at the district- and, potentially, state-level (up to seven states have the option to consider several types of innovative assessment systems and would have to submit an application for consideration by the department).

Still, it is not lost on ATPE that states’ ability to press the boundary is limited in the area where true innovation is needed. Our comments encourage the department to “look for opportunities to address the harmful nature of overusing standardized assessments as high-stakes and ineffective measures of success.” We’ve shared previous input with ED and Congress that highlights these concerns, and we remain committed to advocating for a reverse of the trend to increasingly use standardized tests as a high-stakes measure of success in public education.

The department released its proposed rules on the rule administering assessments, which were drafted by education stakeholders and professionals under a process referred to as negotiated rulemaking, and the rule pertaining to the newly created innovative assessment pilot in July. ED has released a series of draft ESSA rules over the past year and just last week released a highly anticipated proposal covering the controversial issue of supplement-not-supplant.

 


SBOE logoNext week will be a busy one for education policy stakeholders with several major hearings on the calendar. First, on Monday, Sept. 12, the Texas Education Agency (TEA) and State Board of Education (SBOE) are hosting a free public event in Austin called “Learning Roundtable – Educating the Children of Poverty.” The day-long conference will feature presentations by state and national education researchers on the challenges of turning high-poverty schools into high-achieving schools. Texas has experienced a sharp increase in the number of economically disadvantaged students, which creates greater challenges for ensuring that they have opportunities to excel in school. ATPE will be attending the event and will report on it next week. Learn more about the event here.

On Tuesday, Sept. 13, the Senate Education Committee will conduct an interim hearing to evaluate digital learning opportunities and broadband access for schools and students. The committee will also monitor the implementation of a bill that allowed for students to use alternative measures to satisfy high school graduation requirements. ATPE strongly supported the bill creating graduation committees to evaluate certain students who had failed required STAAR exams. That bill is set to expire next year unless extended by the legislature in 2017. The Select Committee on State and Federal Power and Responsibility will also meet that same day to hear testimony on the extent to which state regulations are influenced by mandates attached to federal funding.

Also on the schedule for Tuesday are some high-profile SBOE meetings: SBOE’s Committee of the Full Board will begin with a morning work session on the curriculum standards for mathematics, followed by a public hearing on instructional materials submitted in response to Proclamation 2017. The hearing will be focused on a proposed new Mexican-American studies textbook that has generated controversy and national media attention. The textbook was developed by a publishing company headed up by Cynthia Dunbar, a former member of the SBOE. It is the only textbook of its kind being offered for the SBOE’s consideration at both its September and November meetings. A group of Texas educators and experts have reviewed the book and released a new report describing its content as offensive, biased, and filled with errors. A group called the Responsible Ethnic Studies Textbook Coalition plans to hold a rally to protest the book outside the TEA headquarters at 9:30 a.m. on Tuesday.

On Wednesday, Sept. 14, SBOE meetings continue with its regular hearing by the Committee of the Full Board. Meanwhile, over at the Capitol there are two hearings of interest taking place that morning. First, the Senate Committee on State Affairs will discuss one of its interim charges to “examine the practice of using public funds and employees for the payment processing of union dues” and “make recommendations on whether Texas should end this practice.” ATPE has fought to protect educators’ rights to have access to payroll deduction for payment of their voluntary dues to our association, which is not affiliated with a union, and we will continue our work to educate lawmakers on the realities of this practice, which does not require any expenditure of public funds.

NO VOUCHERS

At the same time, the Senate Education Committee will hold another interim hearing on Wednesday, this one focused on vouchers and other “school choice programs,” such as the use of education savings accounts or tax credit “scholarships.” The committee will also monitor the implementation of recent legislation that changed the minimum instructional requirements for students from days to minutes and House Bill 1842, which changed accountability sanctions and interventions and created the means for school districts to become Districts of Innovation.

Thursday, Sept. 15 has the Senate Finance Committee looking at property tax relief and other topics. SBOE meetings continue that day with agendas for the board’s Committees on School Initiatives, Instruction, and School Finance/Permanent School Fund.
