SBOE wraps meeting with strong statement on school funding

The Texas State Board of Education (SBOE) concluded its September meeting Friday with final votes on a number of subjects.

One of the first orders of business was to approve a draft of the Long-Range Plan for Public Education (LRP). The board will delay final approval until the November meeting in order to give stakeholders longer to review the plan and changes suggested by the board Tuesday night. Member Ruben Cortez (D-Brownsville) voiced concern that the board was under pressure from the office of Gov. Greg Abbott to remove the recommendation in favor of “formula funded full-day pre-K.”

The board also approved Texas Essential Knowledge and Skills (TEKS) for Ethnic Studies: Mexican American Studies, as well as streamlining changes to the social studies TEKSMembers also voted on a number of items from each committee, including finalizing a rejection of problematic rules proposed by the State Board for Educator Certification (SBEC) that would have negatively affected teacher quality. Member Georgina Perez (D-El Paso) concluded discussion by pointing out that if certain areas are having trouble hiring teachers, the remedy should be more pay — not weakening standards. The SBEC will have a chance to fix the rule and submit changes to the SBOE in November.

Members also finalized a letter to the General Land Office (GLO) regarding a dispute over funding that could short schools roughly $450 million over the next biennium. The board voted unanimously to request the GLO reconsider its actions and provide an additional $500 million in funding for schools.

The board concluded with its annual ethics training. The next meeting is scheduled for November.

 

SBOE begins September meeting with social studies TEKS

The Texas State Board of Education (SBOE) kicked off its September meeting Tuesday with a lengthy day of public testimony regarding revisions to the Texas Essential Knowledge and Skills (TEKS) for social studies.

Some of the commentary came in response to edits to the portion addressing the Alamo that received a significant amount of news coverage and political attention over the past several days. A member of the TEKS review team, which is composed of educators who are experts in the subject matter and volunteer their time, explained the reasoning behind the edits and suggested the extraordinary attention was due to a misreading of the team’s notes, as well as a lack of outreach to team members for clarification. He offered an alternative phrasing that would satisfy all parties’ concerns, and which board members seemed amenable to adopting.

Testimony also focused on the proper way to treat slavery as the cause of Texas’s secession in the Civil War period, as well as how to discuss the role of religion, specifically Moses, as it pertains to the framing of the U.S. Constitution.

The board concluded the meeting with a discussion of the Long-Range Plan (LRP) for Public Education, which sets the state’s educational goals through the year 2030 and was released Monday. The LRP Steering Committee held ten in-person community meetings and solicited feedback from thousands of stakeholders via an online survey. Educators, parents, and community leaders were consulted at every step of the way. ATPE Lobbyist Mark Wiggins, who has followed the plan’s development for more than a year, lauded the board for an inclusive and thoughtful process that gave meaningful consideration to input from educators.

Wiggins offered a number of broad recommendations to perfect the plan, including adding language to increase the rigor of Educator Preparation Programs (EPPs). Wiggins also cautioned the board that when discussing programs that aim to place top tier teachers in schools with large numbers of at-risk students by offering differentiated pay, it’s important to ensure that the evaluation programs used to identify those top tier teachers are not based upon student test scores. Wiggins also suggested that due to the short period of time stakeholders have had to evaluate the LRP, the board would be justified in postponing final approval.

Chair Donna Bahorich (R-Houston) introduced a number of perfecting amendments, many of which addressed elements of ATPE’s general recommendations. The board discussed allowing the public more time to review the proposed amendments before voting on final adoption at the November meeting.

SBOE initially approves Ethnic Studies: Mexican American Studies curriculum

The State Board of Education (SBOE) approved the initial Texas Essential Knowledge and Skills (TEKS) for a course on Mexican American studies after amending the TEKS and name as a result of public testimony the board heard Tuesday.

On a motion by Member Georgina Perez (D-El Paso) and seconded by Member David Bradley (R-Beaumont), the board voted to change the proposed name from “Ethnic Studies: An Overview of Mexicans of American Descent” to “Ethnic Studies: Mexican American Studies.” Perez emphasized the lack of a hyphen in the new title, and explained the title would provide a consistent format for future courses focused on other ethnic groups.

Member Ruben Cortez (D-Brownsville) led the opposition to the name change, preferring to simply title the course “Mexican American Studies.” Member Tom Maynard (R-Florence) characterized the “Ethnic Studies” prefix as a sort of “area code” that implies the promise of more related courses in the future. Acknowledging the concerns raised Tuesday, the board unanimously approved the name change proposed by Perez.

Also Wednesday, the board approved requirements for instruction for a course on proper interaction with peace officers, which was created as a result of legislation passed during the 2017 legislative session, and adopted the long-term strategic asset allocation plan of the permanent school fund (PSF). The board’s three committees will meet Thursday, before the full board concludes its June meeting Friday morning.

SBOE hears public comments on ethnic studies course

The State Board of Education (SBOE) kicked off its week-long June meeting Tuesday taking public comment on several curriculum items.

The meeting began with a discussion on streamlining the Texas Essential Knowledge and Skills (TEKS) for social studies and economics. Members of the public raised concerns over the placement of the Holocaust in the TEKS, as well as concerns that the TEKS fail to properly credit slavery as the primary driver of secession leading up to the Civil War. Board Chair Donna Bahorich (R-Houston) explained that streamlining is defined by the Texas Education Agency (TEA) as deleting, confining, clarifying and narrowing the scope of TEKS. The board also heard competing arguments over the historical influence of the Bible and Judeo-Christian values on the nation’s founding documents.

The majority of testimony revolved around a new ethnic studies course approved by the board earlier this year. After dispute over textbooks for an innovative course on Mexican-American studies stretched over the course of several meetings, the board acknowledged advocates’ interest in a standardized course and approved the creation of statewide TEKS in April. At the same meeting, Member David Bradley (R-Beaumont) led members in designating the new course “Ethnic Studies: An Overview of Americans of Mexican Descent.” This was viewed as a slight by advocates, who expressed their disapproval Tuesday and requested the board designate the class “Mexican-American Studies,” as they had originally requested.

More than 40 people signed up to testify. The board could hold another vote on the name Wednesday at the earliest, and members still have the option of changing the name at a later meeting regardless of what happens this week.

SBOE approves Mexican American studies course

The State Board of Education (SBOE) met Wednesday morning for a list of items, beginning with an update from Texas Education Agency (TEA) Commissioner Mike Morath on a recent glitch with the STAAR test, statewide test scores and the special education corrective action plan.

The board took testimony Wednesday morning from members of the public advocating for the addition of Texas Essential Knowledge and Skills (TEKS) for an elective course in Mexican American Studies. This has been an ongoing topic of conversation and debate at the board.

On a motion by Member Georgina Perez (D-El Paso), the board ordered the TEA to develop TEKS for a Mexican American Studies course based upon an innovative course created by Houston ISD. Agency staff suggested that without making modifications to the Houston ISD course, initial TEKS could be ready to be considered on first reading by June.

The board also approved a motion by outgoing Member David Bradley (R-Beaumont) to rename the course “Ethnic Studies: An Overview of Americans of Mexican Descent,” arguing he is against “hyphenated Americans.” The amendment was forcefully opposed by Members Marisa Perez (D-Converse) and Ruben Cortez (D-San Antonio). Member Tom Maynard (R-Florence) noted that the board could amend the name again at a future date in the event constituents voice disapproval of the name change.

Finally, on another motion by Member Georgina Perez, the board voted to fast-track additional ethnic studies courses, including courses addressing Latinos, Asian and Pacific Islanders, African-Americans, and Native Americans.

The board also discussed the curriculum for instruction on Proper Interaction with Peace Officers, which was required by Senate Bill (SB) 30 passed by the 85th Texas Legislature in response to recent officer-involved shootings around the country. The agency has planned a pair of videos to supplement the instruction, and the board voted on first reading to add elements to the current proposal that would require completion of the instruction to be recorded in each student’s record.

Finally, TEA staff updated the board on the new TEKS review process currently underway for social studies. Teacher reviewers participate in a rolling working group format under the new process. Through this process, one of the working groups created a rubric assigning points to certain historical figures in order to determine who should be specifically included in the TEKS. Materials developed by the working groups can be viewed on the TEA website. Staff aims to present the new TEKS to the board for first reading in September and a final vote in November.

Board committees are scheduled to meet Thursday morning, and several board members are expected to participate in an update Thursday afternoon on the Long-Range Plan for Public Education. The full board formally returns Friday.

From the Texas Tribune: One Texas Board of Education primary result could spell a return to culture wars

Over her 16 years on the State Board of Education, Pat Hardy has rallied for her share of socially conservative measures. She’s endorsed keeping “pro-American” values in history textbooks. She’s backed emphasizing “states’ rights” instead of slavery as the cause of the Civil War. And she’s supported teaching “both sides” of arguments around climate change.

But her Republican challengers in the March 6 primaries — Feyi Obamehinti and Cheryl Surber— are telling voters that they’re even further to the right. (Surber’s campaign Facebook page even refers to her as the “Donald Trump of the Texas State Board of Education” candidate.)

“It’s probably true!” Hardy said. “Which is funny because I’m very conservative. But they are to the right of me.”

The Fort Worth representative, a retired public school social studies teacher, is fighting to keep her seat in one of the most anticipated State Board of Education contests this year. Hardy’s District 11 seat is one of seven up in the 2018 midterms, including three other seats where incumbents are also fending off challengers. Three other incumbents are stepping down, prompting open races.

But experts say Hardy’s race in particular could help determine whether the board will retain its recent political equilibrium or return to a more polarized iteration characterized by frequent head-butting among the board’s liberal, moderate Republican and social conservative factions, which has earned it national notoriety for decades.

“With three open seats, this is a really important election for the state board, because the board has moved closer to the center over the last several election cycles,” said Dan Quinn, spokesperson for left-leaning state board watchdog Texas Freedom Network. “The question is whether it will continue to do that or if we’ll see a swing back to the fringe politics that have dominated the board for the last 20 years, or longer than 20 years.”

Whoever wins will be responsible for setting curriculum standards and making textbook recommendations for schools across the state, deciding what 5.4 million Texas students learn.

Over the next couple of years, the new board’s responsibilities will include the politically fraught duty of tackling a full revision of health standards, including how schools teach sex education, informing the content for textbooks Texas teachers will use for years.

“What students learn about contraception in a state with one of the highest rates of teen birth rates in the nation will be up for debate,” Quinn said.

Challenging a swing vote

The State Board of Education has 15 members, each representing nearly 2 million Texans. Though the board is made up of 10 Republicans and five Democrats, its debates often divide the board three ways — between Democrats, moderate conservatives and social conservatives.

Hardy describes herself as a Republican who doesn’t always fit the mold, often a swing vote on the board.

“You have a balance on the board, which means that each of those three groups are compelled to work with one of the others to accomplish their goals,” said David Anderson, a longtime education lobbyist at Hillco Partners. “If you lose Pat to one of the other two candidates, you lose a critical part of that balance.”

Hardy’s district covers Parker County and parts of Dallas and Tarrant counties.

Hardy does not believe Texas should subsidize private school tuition for parents. “I’ve always felt the public school was a unique thing that historically set us apart from other countries because we had free education,” she said.

Her opponents argue parents should be able to use state money to go to any type of school they want. Obamehinti, a former public school teacher and current education consultant from Keller, also homeschooled her daughter for 11 years and wants to make it easier for other parents to have the same option.

The board has no jurisdiction over whether to approve vouchers or similar programs, but candidates’ views on this issue may indicate whether they want to improve the current public education system or overhaul it in favor of a more free-market approach.

Obamehinti also supports teaching creationism in science classrooms and is skeptical of the idea that the state should approve a Mexican-American studies course, a current consideration on the board. She argues she can do a better job of reaching out to constituents than Hardy has done. “I live in District 11, and I have never had any outreach in 16 years,” she said.

Surber said she would never be a swing vote on the board. “I’m like the Donald Trump of this race. I want to hear various sides, even sides that might disagree with me,” she said. She said she is not in favor of a Mexican-American studies course for Texas because students are “in the United States of America. We’re not in Mexico. We’re not in Canada. We need to learn American history.”

She holds extreme views on many subjects and often affirms various conspiracy theories on her personal Facebook page. This week, she put up a few posts suggesting survivors of the Parkland, Florida, mass shooting who have publicly advocated for gun control measures are “crisis actors,” not students, a notion that has been widely debunked.

Two Democrats are also running for Hardy’s seat: Carla Morton, a pediatric neuropsychologist and special education advocate in Fort Worth, and Celeste Light, who has no campaign website set up and has not responded to media requests for comment.

Decisive primaries

Three State Board members — Beaumont Republican David Bradley, Dallas Republican Geraldine “Tincy” Miller and Fort Worth Democrat Erika Beltran — are stepping down this year. In all three seats, a candidate from the incumbent’s party is running unopposed in the primary: Matt Robinson in Bradley’s District 7, Pam Little in Miller’s District 12, and Aicha Davis in Beltran’s District 13.

Given their voting history, those districts are unlikely to change party hands, meaning those three candidates will win, said Mark Jones, political science professor at Rice University. “We often talk about how the primaries are decisive. In the State Board of Education, they’re 100 percent decisive,” he said. “There’s no doubt whatsoever about who’s going to win in November because of the way the districts have been drawn.”

Bradley, one of those incumbents, is widely considered one of the most socially conservative and most divisive members on the board, supporting abstinence-only education and creationism in science classes.

“I reject the notion by the left of a constitutional separation of church and state,” he said, before the board voted to adopt more right-leaning social studies curriculum standards in 2010. “I have $1,000 for the charity of your choice if you can find it in the Constitution.”

In 2016, he sent an email proposing board members walk out of a discussion about a Mexican-American studies textbook that advocates and academics considered racist, in order to “deny the Hispanics a record vote.”

Bradley’s likely replacement is Robinson, a Friendswood ISD board member and physician, the only Republican running for the District 7 seat. Bradley endorsed Robinson a few months after he filed paperwork to run.

“Generally speaking, if you voted for David Bradley in the past, you’d feel good about voting for me,” Robinson said. “If you didn’t, you might still be happy with me.”

Robinson said schools should teach abstinence-only sexual education: “I think that should be the limit of what they do.”

He supports state subsidy programs that would help parents pay for private schools, such as vouchers or education savings accounts — generally opposed by public education advocates, who see the subsidies as a potential financial drain on public schools.

But, unlike many conservatives who support these subsidies, Robinson argues a child who takes state money to a private school should have to take the state standardized test or participate in some other form of state accountability. “It would not really be fair to have no restrictions or oversight whatsoever for private schools where state dollars are going,” he said.

Miller, also leaving her seat at the end of the year, is generally considered more moderate than Bradley and is best known for pushing the state’s first law mandating schools serve kids with dyslexia. Miller has endorsed her likely replacement, Pam Little, who is a retired regional vice president at publishing company Houghton Mifflin. Little said she supports abstinence as the first approach to sex education, and has not yet made up her mind on whether health standards should include education on contraception.

When Little ran for Miller’s seat in 2012, she said that local communities should be able to decide whether to offer any additional sex education, given the state’s high teen pregnancy rate.

Beltran endorsed Davis, her likely replacement, upon retiring from the board. A 2011 transplant to Texas, Davis has been a middle and high school science and engineering teacher for the past decade.

Teach the Vote’s Week in Review: Feb. 2, 2018

Happy Groundhog’s Day! Here’s this week’s education news digest from ATPE:


Monday, Feb. 5, is your last chance to register to vote in the March 6 primary election. Registrations must be postmarked by Monday’s 30-day-out deadline in order to be effective for the upcoming Republican and Democratic primary elections. Visit the Texas Secretary of State’s website to verify your registration status, especially if you have moved since the last election.

ATPE urges all educators to participate in the upcoming primary election, for which the early voting period begins on Feb. 20, 2018. The outcomes of the overwhelming majority of elections in Texas are determined by the results of the primaries rather than the general election that takes place in November. This is because many district boundaries are drawn during the redistricting process to favor one political party over others. As a result, some races will only feature candidates from a single political party, meaning that party’s primary election will determine the ultimate winner of the race no matter what happens in November.

Since Texas is an open primary state where all voters can choose to participate in either the Republican or Democratic party primaries in March, we encourage educators to look at the candidates running in their area and decide which primary election will give them the best opportunity to decide who will represent their interests in the coming years as an elected official. Remember that regardless of which primary you choose in the spring, you can vote for any candidate regardless of party affiliations in the November general election. ICYMI: ATPE State President Carl Garner penned an editorial about why it’s important for educators to vote and promote a culture of voting. As certain politicians and wealthy special interest groups continue their efforts to intimidate educators out of voting in the upcoming primaries, ATPE’s elected leader urges his colleagues to make sure they are registered to vote, aware of the candidates’ positions on public education, and ready to make informed choices at the polls. “My fellow educators and I are fired up about voting,” wrote Garner. “We want to model what we teach, showing our students what informed and engaged citizens are supposed to do.” For more, check out Carl’s piece published yesterday by the Texas Tribune for its TribTalk website.

 


SBOE meeting in Austin, Feb. 2, 2018.

The Texas State Board of Education (SBOE) concluded its first meeting of 2018 today in Austin. The board approved a raft of items from its subordinate committees and delayed action on consideration of new curriculum standards for a Mexican-American studies course, as discussed at Tuesday’s meeting. More from that discussion can be found in this report by the Texas Tribune.

The board engaged in a lengthy discussion regarding the training required for local school board trustees. Training requirements were altered by legislation passed by the 85th Texas Legislature, which necessitated updates to administrative rules. Texas Education Agency (TEA) staff reminded the audience of the remaining public meetings to solicit input regarding the Long-Range Plan for Public Education:

SBOE begins November meeting

The State Board of Education (SBOE) met Tuesday to undertake work sessions on school finance and new textbooks. After spending the morning reviewing the history and operation of the Permanent School Fund (PSF), the board began the afternoon with an update from Texas Education Agency (TEA) Commissioner Mike Morath.

“The work related to Hurricane Harvey is ongoing,” Morath told the board. The commissioner drew the board’s attention to rule changes initiated by the State Board for Educator Certification (SBEC) that are tied to the state’s “grow your own” strategy to recruit more highly skilled teachers.

“There is increasing strain on school systems and their ability to hire teachers,” said Morath, who added the strain is most acutely felt in rural settings. The commissioner explained that there are students in schools throughout the state who are thinking of becoming doctors and lawyers. Morath then posed the question: Are we creating incentives and pathways for them to become teachers?

The SBEC rule changes subject to the board’s approval this week are aimed to help schools that offer CTE courses in the field of teaching as part of the “grow your own” strategy. The rule change would allow districts to place any teacher, regardless of their certification area, in charge of “Ready, Set, Teach” courses.

The commissioner also updated the board on improvements to the agency’s STAAR report card at www.TexasAssessment.com. Following the commissioner’s presentation, the board turned its attention to Proclamation 2018. The board voted to extend the deadline by two weeks for Kendall Hunt, a publisher that was unable to meet the published deadline as a result of the flooding caused by Hurricane Harvey.

Board members returned Wednesday to tackle a lengthy agenda. The board declined to add a Mexican-American studies textbook to the list of approved instructional materials. The board adopted changes to correct inconsistencies in the Texas Essential Knowledge and Skills (TEKS) for Career and Technical Education (CTE).

Members next turned their attention to changes to graduation requirements made by legislation passed by the 85th Texas Legislature. The board approved rule changes to align with legislation that eliminates sequencing requirements for advanced mathematics and English courses. The board debated at length how certain computer science courses could satisfy graduation requirements for languages other than English (LOTE) and/or advanced mathematics. Members cast a preliminary vote to allow courses to satisfy both requirements, while counting as a single course credit.

The board also considered rules regarding International Baccalaureate (IB) courses, and received an update following previously-adopted changes to the TEKS review process. After receiving many volunteers to serve in TEKS review work groups, TEA staff indicated more volunteers are needed for elementary-level panels.

SBOE begins June meeting with A-F update

The State Board of Education (SBOE) met Tuesday for its June session, during which the 15 members will continue work on the Texas Essential Knowledge and Skills (TEKS) for English Language Arts and Reading (ELAR) and Spanish Language Arts and Reading (SLAR) and English as a Second Language (ESL). The board is also scheduled to discuss changes to the TEKS review schedule and appoint members to a Long-Range Plan Steering Committee.

Tuesday began with an update from Texas Education Agency (TEA) commissioner Mike Morath, who reported the spring testing cycle was completed with satisfactory results. After encountering issues with scoring and test delivery in 2016, Morath stated, “All the problems with last year were resolved.”

A result of testing this year and a one-year effort to redesign the Confidential Student Report (CSR) is the new STAAR report card. The new report card goes beyond numerical results to include more information, context and terms that are easier to understand. More information on the new STAAR report card can be found on the TEA website.

The commissioner also provided a brief summary of changes to the “A through F” accountability system passed during the regular session of the 85th Texas Legislature as part of House Bill (HB) 22. The legislature compressed the system to three domains: Student achievement, school progress and closing the gaps.

The student achievement domain will primarily rely on test data to calculate student performance. Under the school progress domain, the same test data will be used to determine how much students gain year over year and how schools compare to other schools with similar levels of poverty. The closing the gaps domain will focus on identifying whether certain student groups are struggling, relative to the campus. The student achievement and school progress domains will be combined for a single “best of” score, which will be weighted against the closing the gaps domain to calculate the overall or “summative” score.

The agency will focus on outreach to stakeholders through December, and the first district-level ratings under the new system will be issued in August 2018. At that time, campus-level ratings will still be either “met standard” or “improvement required.” All campuses are scheduled to receive a “what if” report using the A through F system on January 1, 2019. Official campus-level A through F ratings will be issued in August 2019, at which time a local accountability plan framework will also be rolled out.

Districts using a local accountability plan must continue to use the three state domains, but may add as many additional domains as they like and come up with an independent formula for calculating a summative score. Only schools that have not scored a “D” or an “F” will be able to participate, and local accountability plans will be vetted through a “peer-review” process.

Under HB 22, attendance rates have been removed from the accountability system, fixing problem identifying by many elementary and middle schools. A task force has been commissioned to look at incorporating extracurricular activities, which is expected to be a five-year process.

Member Keven Ellis (R-Lufkin) asked about the effects of Senate Bill (SB) 1784, which promotes the use of “open-source instructional materials.” These materials are currently licensed through the state procurement process, which already includes accessibility requirements. Morath said the agency plans to make the process more similar to the proclamation process used by the SBOE for textbook vendors.

The board received an update from TEA staff on other bills passed during the legislative session. The agency is currently tasked with implementing 145 pieces of legislation passed by lawmakers of the 85th Texas Legislature.

The board proposed eight legislative recommendations, of which five were successfully carried out. Lawmakers expanded SBOE authority over approving instructional materials to consider suitability for subject and grade level, with an additional requirement that it be reviewed by academic experts. Member David Bradley (R-Beaumont) noted that the legislature provided no guidance regarding the definition of “suitability” and “expert,” though staff pointed out that a definition of expert already exists in agency rule.

The legislature did not allocate any funds for the long-range plan, nor did it appropriate money to increase TEA staffing in the curriculum division, which oversees and supports TEKS review and implementation. The legislature did approve a $5 million rider for data privacy and other items, as well as a $25 million rider to allow districts to access federal matching funds for the E-Rate Infrastructure Program.

Lawmakers passed SB 160, which prohibits the agency from adopting or implementing a performance indicator in any agency monitoring system that solely measure the number or percentage of students who receive special education services. This legislation was passed as a result of an investigative series by the Houston Chronicle that uncovered a de facto cap on special education enrollment.

Finally, the board recommended lawmakers conserve public free schools and prohibit public dollars from going to private schools or parents/guardians. Despite attempts by the Texas Senate to pass a voucher bill, the Texas House stood strong and prevented the passage of any private school voucher legislation. However, Gov. Greg Abbott has announced he will include vouchers on the call for a July special session. Noting that voucher proponents had focused on special needs vouchers during the regular session, Member Marty Rowley (R-Amarillo) asked what a special needs voucher would look like. Staff indicated the governor specifically mentioned HB 1335 by state Rep. Ron Simmons (R-Carrollton).

The board spent the latter half of Tuesday resuming their work on ELAR/SLAR and ELL high school TEKS. On Wednesday, the board is scheduled to discuss the broader TEKS review schedule.

Graduation committees advance in House hearing

The House Public Education Committee met Tuesday morning to consider a large agenda of Senate bills as the session winds down. The committee also approved the following bills Tuesday evening:

  • CSSB 463, which was heard earlier in the day. The bill would extend individual graduation committees (IGCs) through 2019.
  • SB 436, the Senate companion to HB 4226, which would require meetings of the Special Education Continuing Advisory Committee to be conducted in compliance with open meetings laws.
  • CSSB 529, the Senate companion to HB 2209, which would incorporate “universal design for learning” into the required training for all classroom teachers.
  • SB 585, the Senate companion to HB 545, which would require principals to allow “patriotic societies” such as Boy Scouts to speak to students about membership at the beginning of the school year.
  • SB 748, the Senate companion to HB 4027, which would add additional guidelines to the transition plan for special education students preparing to leave the public school system.
  • CSSB 1481, the Senate companion to HB 4140, which would rename the instructional materials allotment (IMA) the “instructional materials and technology allotment” and require districts to consider “open education resources” before purchasing instructional materials.
  • SB 1942, the Senate companion to HB 1692, which would allow a licensed handgun owner to store a firearm in a vehicle parked in the parking lot of a public school, open-enrollment charter school or private school. State Reps. Alma Allen (D-Houston) and Joe Deshotel (D-Beaumont) voted against the bill.
  • SB 2080, the Senate companion to HB 69, which would require each school district and open-enrollment charter school to include in the Public Education Information Management System (PEIMS) report the number of children with disabilities residing in a residential facility who are required to be tracked by the Residential Facility Monitoring (RFM) System and are receiving educational services from the district or school.

The meeting began with SB 1566 by state Sen. Lois Kolkhorst (R-Brenham), which would hand broad powers to local school boards to compel the testimony of district officials and obtain district documents. It would also require the Texas Education Agency (TEA) develop a website for boards to review campus and district academic achievement data.

SB 2131 by state Sen. Royce West (D-Dallas) would add requirements to counseling regarding postsecondary education, encouraging a focus on dual credit programs. ATPE supports this bill.

SB 1294 by state Sen. Dawn Buckingham (R-Lakeway) would prohibit “exclusive consultation,” ensuring that educators on campus-level advisory committees do not all belong to a single professional association. ATPE supports this bill.

SB 1660 by Sen. Taylor would allow districts to choose between using either minutes or days to calculate operation. According to the fiscal note, SB 1660 could cost the state $1.7 million through the biennium ending August 31, 2019.

SB 195 by state Sen. Sylvia Garcia (D-Houston) would allow additional transportation allotment funding to districts with children living within the two mile zone who are at a high risk of violence if they walk to school. In the fiscal note, the Legislative Budget Board indicated that there is insufficient data regarding the number of students who are at risk of violence to be able to calculate a fiscal impact. ATPE supports this bill.

SB 1854 by state Sen. Carlos Uresti (D-San Antonio) would require district-level committees to review paperwork requirements annually and recommend to the board of trustees instructional tasks that can be transferred to non-instructional staff. ATPE supports this bill.

SB 384 by state Sen. Konni Burton (R-Colleyville) would give the State Board of Education (SBOE) flexibility in scheduling end-of-course exams to avoid conflicts with AP/IB national tests.

SB 1883 by Sen. Campbell would modify the approval process for charter applicants and the review of charter operators. ATPE opposes the bill because the removal of elected officials from the charter school process is irresponsible. Adding unnecessary new appeal and review opportunities for charters only creates administrative bloat.

SB 1005 by state Sen. Donna Campbell (R-New Braunfels) would allow the use of the SAT or the ACT as a secondary exit-level assessment instrument to allow certain public school students to receive a high school diploma. The fiscal note estimates an annual cost of $2 million per year.

SB 1839 by state Sen. Bryan Hughes (R-Mineola) would create a certification for early childhood through grade three, and would grant the commissioner authority to set reciprocity rules regarding the ability of teachers from outside the state to obtain a certificate in Texas. ATPE believes that the State Board for Educator Certification (SBEC), as the official state body charged with the oversight of educator standards, is the more appropriate authority to set these rules.

SB 2270 by Sen. Lucio would create a pilot program in ESC Region 1 to provide additional pre-K funding for low-income students.

SB 1784 by Sen. Taylor would encourage the use of “open-source instructional materials.”

SB 2188 by Sen. Taylor would specify that a student who is 18 or older in an off home campus instructional arrangement is a full-time student if they receive 20 hours of contact a week. Part-time would be defined as between 10 and 20 contact hours per week. According to the fiscal note, SB 2188 would cost roughly $7 million through the next biennium. ATPE supports this bill.

SB 463 by state Sen. Kel Seliger (R-Amarillo) would extend individual graduation committees (IGCs) to 2019 and order the Texas Higher Education Coordinating Board to compile a report tracking the progress of IGC graduates. ATPE supports this bill.

SB 2039 by state Sen. Judith Zaffirini (D-Laredo) would develop instructional modules and training for public schools on the prevention of sexual abuse and sex trafficking. ATPE supports this bill.

SB 1483 by Sen. Taylor would establish a grant program to implement a technology lending program to provide students with electronic instructional materials. The program would be funded through instructional materials fund. The fiscal note anticipates no additional cost, but indicated the commissioner could use up to $25 million of existing funds from the instructional materials fund each biennium.

SB 1398 by Sen. Lucio makes lots of clarifying and limiting changes to the classroom video camera law. Among them, the bill would require requests in writing and only require equipment in classrooms or settings in which the child is in regular attendance or to which the staff member is assigned.

SB 1122 by state Sen. Donald Huffines (R-Dallas) would create a mechanism to abolish Dallas County Schools, one of two remaining county school districts in the state, which primarily provides transportation services to multiple independent school districts in the Dallas area.

SB 1886 by state Sen. Paul Bettencourt (R-Houston) would create an office of the inspector general at TEA appointed by the commissioner to prevent and detect criminal activity in districts, charter schools, and education service centers (ESCs). The bill would allow the new TEA inspector general to issue subpoenas in order to secure evidence.

SB 490 by state Sen. Eddie Lucio, Jr. (D-Brownsville) would require a report on the number of school counselors at each campus. ATPE supports this bill.

SB 1484 by Sen. Taylor would create a web portal and instructional materials repository to assist schools in selecting open education resources. The bill provides for a third party to provide independent analysis regarding TEKS alignment. According to the fiscal note, SB 1484 would not require additional state funding, but would result in an additional cost of $1.85 million in fiscal year 2018 and $450,000 in subsequent years that would be paid from existing instructional materials funding.

SB 1658 by Sen. Taylor would make changes to laws regarding the ownership, sale, lease, and disposition of property and management of assets of an open-enrollment charter school.

SB 2078 by Sen. Taylor would require TEA develop a model multi-hazard emergency operations plan and create a cycle of review. The fiscal note anticipates a fiscal impact of roughly $215,000 per year.

SB 2144 by Sen. Taylor would create a commission to recommend improvements to the public school finance system. ATPE supports this bill.
